101-3-01 Notice procedure.

This regulation is adopted in accordance with division (A) of section 119.03 of the Revised Code which reads in pertinent part as follows:

Each agency shall adopt a rule setting forth in detail the method which such agency shall follow in giving notice as to the adoption, amendment, and rescission of rules.

The joint legislative ethics committee in giving public notice as to the adoption, amendment, and rescission of any rule shall:

(A) Publish, at least once, a notice in a newspaper of general circulation in the cities of Akron, Cincinnati, Cleveland, Columbus, Dayton, and Toledo, and in such other cities as the committee may determine from time to time. Said publication shall appear no more than forty-five nor less than thirty days prior to the date set for the hearing of the proposed action. The notice shall include:

(1) A statement of the committee’s intention to consider adopting, amending, or rescinding a rule;

(2) A synopsis of the proposed rule, amendment or rule to be rescinded or a general statement of the subject matter to which such proposed rule relates;

(3) The date, time and place of the hearing on the proposed action.

(B) File with the secretary of state, at least thirty days prior to the date set for the public hearing on the proposal, a copy of the proposed rule to be adopted, amended, or rescinded.

(C) Furnish a copy of the text of said proposed rule to be adopted, amended, or rescinded to any person upon request.
