Chapter 109:2-17 Concealed Handgun License

109:2-17-01 Fee for Initial Issuance or Renewal License.

(A) An applicant for the initial issuance, or renewal, of a license to carry a concealed handgun shall pay to the sheriff a nonrefundable license fee. The total license fee to be paid by the applicant shall not exceed forty-five dollars, except that the applicant shall additionally pay the actual cost of a criminal records check performed by the federal bureau of investigation, if one is performed.

(B) All fees collected by the sheriff for the initial issuance, or renewal, of a license to carry a concealed handgun shall be deposited into the sheriff’s concealed handgun license issuance expense fund, and each application fee shall be subsequently distributed as follows:

(1) Fifteen dollars for the actual cost of the criminal records check, paid to the bureau of criminal identification and investigation;

(2) The actual cost of a criminal records check performed by the federal bureau of investigation, if one is performed, paid to the bureau of criminal identification and investigation;

(3) An administrative fee of five dollars in the first year, which may be reduced in a graduated amount to not less than three dollars in any succeeding year, paid to the bureau of criminal identification and investigation;

(4) Any additional actual costs incurred by the sheriff in issuing the license retained in the sheriff’s concealed handgun license issuance expense fund and expended as determined by the sheriff and approved by the board of county commissioners.

(C) The distribution made from the sheriff’s concealed handgun license issuance expense fund to the bureau of criminal identification and investigation shall be the total of items: (B)(1) (if a criminal records check is performed by the bureau of criminal identification and investigation); (B)(2); and (B)(3), above;

(D) The sheriff shall waive the foregoing license fee in connection with an initial issuance, or renewal, application submitted by an applicant who is a retired peace officer, as defined in section 2935.01 of the Revised Code, a retired person described in division (B)(1)(b) of section 109.77 of the Revised Code, or a retired federal law enforcement officer who, prior to retirement, was authorized under federal law to carry a firearm in the course of duty, unless the retired peace officer, person, or federal law enforcement officer retired as the result of a mental disability.

109:2-17-02 Fee for Temporary Emergency License.

(A) An applicant for a temporary emergency license to carry a concealed handgun shall pay to the sheriff a nonrefundable license fee in the amount of the actual cost of conducting the criminal records check, which shall not exceed a maximum of thirty dollars.

(B) The fee collected by the sheriff for the temporary emergency license to carry a concealed handgun shall be deposited into the sheriff’s concealed handgun license issuance expense fund, with fifteen dollars subsequently paid to the bureau of criminal identification and investigation. The actual cost of a criminal records check performed by the federal bureau of investigation, if one is performed, is also to be paid to the bureau of criminal identification and investigation.
