128-2-01 Notification of public hearings.

(A) Public notice of the proposed adoption, amendment, or rescission of any rule pursuant to section 119.03 of the Revised Code by the capitol square review and advisory board, and notice of public hearings required pursuant to rules 128-3-01, 128-4-02, 128-4-03, and 128-4-04, of the Administrative Code shall include the following information when applicable:

(1) A statement of the board’s intention to consider adopting, amending or rescinding a rule;

(2) A synopsis of the submitted proposal, proposed rule, amendment or rule to be rescinded or a general statement of the subject matter to which the submitted proposal, proposed rule, amendment, or rescission relates;

(3) A statement of the reason or purpose for adopting, amending or rescinding the rule;

(4) The date, time and place of a hearing on the proposed action.

(B) Public notice of the proposed adoption, amendment, or rescission of any rule pursuant to section 119.03 of the Revised Code by the board shall be given at least thirty days prior to the date set for the public hearing thereon, by publication of that notice in the register of Ohio. The board may give whatever other notice it reasonably considers necessary to ensure notice constructively is given to all persons who are subject to or affected by the proposed rule, amendment, or rescission, including by placing an announcement in a major newspaper of general circulation in the state capitol not less than thirty days prior to the date set for such hearing.

(C) Notice of public hearings required pursuant to rules 128-3-01, 128-4-02, 128-4-03, and 128-4-04 of the Administrative code, which require public hearings for purposes other than modification of rules, shall be given by placing an announcement in a major newspaper of general circulation in the state capitol not less than thirty days prior to the date set for such hearing.

(D) Copies of the notice of the public rules hearing and the full text of the proposed rule, amendment, or rescission shall be available at the board’s offices at least thirty days prior to the date of the hearing. Any person may receive a copy of the public notice, the full text of the proposed rule, amendment, or rescission, and the public hearing agenda upon request at the board’s offices, or by regular mail upon provision of a self-addressed envelope bearing sufficient postage.
