1501:14-3-13 Controlled Placement of Lime Mining Wastes (LMW).

(A) Transportation and compaction

(1) When transporting, placing and compacting LMW, the permittee shall comply with all applicable emission controls required by R. C. 3704 and the rules thereunder;

(2) LMW shall be placed in a controlled manner to prevent mass movement;

(3) The placement area shall be constructed to minimize the infiltration of water;

(4) The placement areas shall be within the permit, shown as affected or proposed to be affected and bonded;

(5) The final configuration shall be compatible with the natural drainage pattern and surroundings and suitable for intended uses;

(6) The design of LMW placement area shall be certified by a qualified registered engineer in conformance with professional standards;

(7) The permittee shall minimize disturbances and adverse impacts of the operation of fish, wildlife, and related environmental values, and achieve enhancement of such resources where practicable; and

(8) The placement and use of LMW shall be protective of human health and the environment and not damage public or private property.
