1501:31-11-01 No trespass game refuge; Mosquito reservoir.

(A) It shall be unlawful for any person to trespass at any time without a permit from the chief of the division of wildlife within a certain area on the Mosquito reservoir posted as "State Game Refuge, Trespassing Unlawful" more particularly described as follows:

Beginning at a point in Mecca township, Trumbull county where the Hoagland-Blackstub road (county road #203) intersects the Mahan Denman road (county road #240), said point also being a common corner of lots 3, 4, 13, and 14 of the Kirtland tract. (A) It shall be unlawful for any person to trespass or hunt at any time without a permit from the division of wildlife within a certain area on the Killdeer plains wildlife area posted with signs reading "State Game Refuge, Trespassing Unlawful." Further provided, fishing and wildlife observation shall be permitted in this area which is posted with signs reading "Open To fishing Or Wildlife Observation Permitted." Said area more particularly described as follows:

Located in Marseilles and Pitt townships, in Wyandot county and Salt Rock township in Marion county, Ohio. Beginning at the junction of township road T-108 and road T-77 thence easterly following the centerlines of road T-77 to road 25 (Meeker-Upper Sandusky road). Thence northerly following the center line of road 25 (Meeker-Upper Sandusky road) to the junction of road T-68 and road 25 thence easterly following the centerline of road T-68 to the junction of road 119 and road T-68. Thence northerly following the centerline to the junction of road 119 and road 71, thence westerly on road 71 following the centerline to the junction of road T-108 and road 71. Thence southerly on road T-108 following the centerline to the junction of road T-108 and road T-77.

(A) It shall be unlawful for any person to trespass or hunt at any time without a permit from the division of wildlife within a certain area on the Killdeer plains wildlife area posted with signs reading "State Wildlife Refuge, Trespassing Unlawful." Further provided, fishing and wildlife observation shall be permitted in this area which is posted with signs reading "Open To fishing Or Wildlife Observation Permitted." Said area more particularly described as follows:

Located in Marseilles and Pitt townships, in Wyandot county , Ohio. Beginning at the junction of township road TH-108 and former road CH-75 (accessible electric APV trail) thence easterly following the centerlines of former road CH-75 (accessible electric APV trail) to road CH-115. Thence southerly following the center line of road CH-115 to the junction of road CH-68 and road CH-115 thence easterly following the centerline of road CH-68 to the junction of road CH- 119 and road CH-68. Thence northerly following the property boundary to the junction with road CH-71, thence westerly on road CH-71 following the centerline to the junction of road TH-108 and road CH-71. 1501:31-11-05 Restricted migratory bird hunting area; Mercer county.

(A) It shall be unlawful for any person to possess, hunt or take ducks, geese, or any other migratory bird at any time without a permit from the division of wildlife on or within an area in Mercer county posted as "Restricted Zone Unlawful to Hunt Waterfowl" or "Public Hunting Area, Permit Required" or to trespass within an area posted as "Controlled Waterfowl Hunting Area, Trespass Permit Required" more particularly described as follows:

Located in Jefferson, Butler and Franklin townships, in Mercer county, beginning at the junction of state route 127 and Brown road, thence south on the east edge of state route 127 to the junction of state route 127 and state route 703, thence eastwardly on the north edge of state route 703 to the east side of the village of Montezuma, thence northward on the west edge of state route 219 to the junction of state route 219 and Windy Point road, thence north along Windy Point road to the northeast corner of Shademore landing, thence westwardly across Grand Lake St. Marys to the point of beginning. And beginning at a corner post at intersection of It's It road and state route 703, thence south 1,135 feet to a corner post, thence west 1,581 feet to a corner post, thence north 1,368 feet to a corner post, thence northwest along the old "C.H. & D Railroad" bed, 1,800 feet to a corner post, thence southeast along state route 703, 4,375 feet to the point of beginning containing approximately 67 acres more or less. (A) It shall be unlawful for any person to possess, hunt, or take ducks, geese, or any other migratory birds at any time, on or within an area in Auglaize county posted as "Restricted Zone, Unlawful to Hunt Waterfowl" more particularly described as follows:

Located in St. Marys township, Auglaize county beginning at a point six rods east of the southwest corner of the east half of the northwest quarter of said section 9 and running thence north 160 rods to the north line of said section, thence east with the section line to the right-of-way of the "Nickel Plate" railroad right-of-way, thence continuing 1,192 feet to the line fence running north and south in the tract formerly the property of Flora L. Berry, thence proceeding south along said property line on a straight line extended to the center of the reservoir pike or Greenville road, thence westerly along the center of said road to the place of beginning.

1501:31-11-08 Waterfowl hunting area.

(A) The following regulations shall apply to the hunting of waterfowl in a portion of or on state and federal waterfowl management areas, comprised of Mercer wildlife area, Mercer county; Ottawa national wildlife refuge, Lucas and Ottawa counties; Pickerel creek, Sandusky county; Killdeer plains wildlife area, Wyandot and Marion counties; and Mosquito creek wildlife area, Trumbull county; Grand river wildlife area, Trumbull county; Killbuck wildlife area, Wayne and Holmes counties pipe creek wildlife area in Erie county and Magee marsh wildlife area in Ottawa and Lucas counties.

(1) It shall be unlawful for any person to hunt upon the above-named wildlife management areas at any time, except on Pickerel creek, Mosquito creek, Grand river and Killdeer plains where hunting is permitted except on the area posted with signs reading "Restricted Zone Trespassing Unlawful," "Controlled Waterfowl Hunting Area" or "No Trespassing Zone."

(2) It shall be unlawful for any person to possess any species of waterfowl taken within a waterfowl management area, after two hours of the conclusion of their permitted hunt, that was not taken to a wildlife check station for inspection. Provided further, it shall be unlawful for any hunter to leave Pickerel creek wildlife area who has not returned his or her daily permit to the check station within two hours after the end of the day's hunt.

(3) It shall be unlawful for any person to hunt within a waterfowl management area without a permit issued by the wildlife division stating times and dates for which the permit is valid.

(4) It shall be unlawful for any person to trespass without a permit within a waterfowl management area when posted with signs reading "Permit Required" or "Controlled Waterfowl Hunting Area."

(5) It shall be unlawful for any person to hunt or shoot any place on a waterfowl management area except within seventy-five yards of his assigned blind or from within their assigned zone, except for the purpose of killing waterfowl which has been crippled.

(6) It shall be unlawful for any person to use or possess more than twenty-five shells or any combination of those used and possessed, the total of which exceeds twenty-five within the confines of a waterfowl management area, except on those portions of Mosquito creek operated as a same-day drawing, Grand river, Pickerel creek, Ottawa national wildlife refuge and Killdeer plains where the total will be twenty-five shells.

(7) It shall be unlawful for any person to hunt more than one time during a season on each of the waterfowl management areas, except at Pickerel creek, Killdeer plains, Killbuck, Pipe creek wildlife area and those portions of Mosquito creek and Grand river using a same-day drawing system.

(8) It shall be unlawful for any person to hunt more than one time during the portion of waterfowl season from opening day through the weekend after Thanksgiving on Magee marsh wildlife area. This paragraph shall not apply during the month of September.

(9) It shall be unlawful for any person to hunt any wild animal except the species specified on the permit while on a state or federal-operated waterfowl management area.

(10) It shall be lawful to hunt teal during the special teal season at any legal time.

(B) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

1501:31-11-09 Pickerel creek refuge.

(A) It shall be unlawful for any person to trespass at any time without a permit from the division of wildlife within a certain area on the Pickerel creek wildlife area posted with signs reading, "State Game Refuge, Trespassing Unlawful." Said area more particularly described as follows.

Located in sections 1, 35 and 36, Riley township, Sandusky county, Ohio. Commencing at the junction of the west line of section 36 and the center line of Raccoon creek thence northerly and northeasterly on and along the meandering center line of said Raccoon creek to the north line of said section 36; thence east on the north line of said section 36 to its intersection with the low water mark of Sandusky bay; thence southeasterly on and along the low water line of Sandusky bay to its intersection with the east line of the east half of the southwest quarter of section 36; thence south along the west edge of Riley township road 256 to a point some 330 feet south of the southeast corner of the north half of the northwest quarter of section 1; thence west along a straight line to the west line of section 1; thence north along the west line of section 1 to a point 660 feet south of the northwest corner of section 1; thence east along a line parallel to the north line of said section 1 to the east edge of Riley township road 254; thence northerly and northwesterly along the east edge of Riley township road 254 to its intersection with the west line of section 36; thence north along the west line of said section 36 to the northwest corner of the southwest quarter of said section 36; thence west along a straight line to the middle of Raccoon creek; thence northerly and northwesterly on and along the meandering centering line of said Raccoon creek to the place of beginning.

(B) The lands described above shall be closed to all persons except authorized personnel of the division of wildlife while such persons are in the performance of their official duties, or those issued a permit by the chief of the division of wildlife.

1501:31-11-10 Restricted migratory bird hunting area; Mosquito reservoir.

(A) It shall be unlawful for any person to possess, hunt, or take ducks, geese, or any other migratory birds at any time, on or within the area posted as "Restricted Zone, Unlawful to Hunt Waterfowl" or "State Game Refuge, Hunting Unlawful" and more particularly described as follows:

Located in Mecca, Greene and Bloomfield townships in Trumbull county, beginning at the intersection of township road 240 and county highway 263, thence in a northerly direction to the intersection of county highway 263 and township road 234, thence in a westerly direction to the intersection of township road 234 and the Pennsylvania railroad, thence in a northerly direction to the intersection of the Pennsylvania railroad and state route 87, thence in an easterly direction to the intersection of state route 87 and state route 46, thence in a southerly direction to the junction of state route 46 and township road 240, thence in a westerly direction along township road 240 or a line of buoys where such road is inundated by water, to the point of beginning.

(B) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

1501:31-11-11 No hunting area; game refuge; Mosquito creek wildlife area.

(A) It shall be unlawful for any person to trespass at any time without a permit from the chief of the division of wildlife within certain areas of the Mosquito creek wildlife area posted as "State Game Refuge, Trespassing Unlawful", located in portions of Trumbull county within the following boundaries.

Beginning at a point where state route 46 and state route 87 intersects, thence west on state route 87 to state route 45, thence east on state route 45 to Peck Leach road (Twp. 234), thence east on Peck Leach road to Townline road, thence south on Townline road to Mahan Denman road (twp. 240), thence south on Mahan Denman road across Mosquito lake to the intersection of state route 46 and Mahan Denman road, thence north on state route 46 to state route 87 to the point of beginning.

(B) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

1501:31-11-12 General regulations; refuges.

(A) All state game refuges established by the chief of the division of wildlife shall be posted with state signs designating such areas.

No person shall at any time hunt, trap, take or possess a wild animal on any area owned, acquired by lease, agreement or otherwise under control of the division of wildlife, which has been designated a state game refuge except when authorized by the chief of the division of wildlife, except that fish may be taken and possessed on state game refuges unless expressly prohibited.

(B) It shall be unlawful for any person at any time to hunt, take or possess any wild animal, except fish, frogs, or turtles, without written approval by the chief of the division of wildlife on any land or water designated as a state game refuge.

(C) Any division employee or other authorized persons may enter upon any land or water posted as game refuges after permission for such trespass is authorized by the wildlife chief.

(D) It shall be unlawful for any person to hunt any wild animal within any area posted with signs reading "National Wildlife Refuge, Unauthorized Entry Prohibited."

(E) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

1501:31-11-13 No trespass wildlife refuge; International Center for the Preservation of Wild Animals. [Rescinded].

1501:31-11-15 Urbana wildlife area refuge.

(A) It shall be unlawful for any person to trespass at any time within a certain area on the Urbana wildlife area, posted as "State Game Refuge, Trespassing Unlawful," without written permission from the chief of division of wildlife, and more particularly described as follows:

Beginning at the intersection of Short Game Farm road and Game Farm road, thence westerly for 5,625 feet to a point, thence south for 3,320 feet, thence east for 2,772 feet, thence south for 1,914 feet, thence east for 2,735 feet to Game Farm road, thence north to beginning point (5,280 feet).

(B) The lands described above shall be closed to all persons except for persons tending crops, persons authorized to hunt by special permit issued by the chief or his agent, and authorized division of wildlife personnel in the performance of their official duties.

(C) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

1501:31-11-16 Green island refuge.

(A) It shall be unlawful for any person to enter at any time without written permission from the chief of the division of wildlife within a certain area on the Green island refuge, posted with signs reading "State Game Refuge, Trespassing Unlawful," more particularly described as follows:

A tract of land situated on Green island in lake Erie, Ottawa county, Ohio, beginning at a point on said island twenty-five feet true west of the vertical centerline of the abandoned stone lighthouse tower, and proceeding true north a distance of one hundred ninety-five feet, more or less, to a point on the shoreline of lake Erie; thence, easterly, southerly, and westerly along said shoreline to a point; thence true north a distance of two hundred thirty-five feet, more or less to a point of beginning, containing 15.80 acres, more or less.

(B) The lands described above shall be closed to all persons except authorized division of wildlife personnel while such persons are in the performance of their official duties, or those issued a permit by the chief, division of wildlife.

(C) All definitions set forth in rule 1501:31-1-02 of the Administrative code shall apply to this rule.

(A) It shall be unlawful for any person to hunt or take ducks, geese, or any other migratory bird at any time from any watercraft or floating conveyance on or within the water area posted with signs reading "Restricted Zone - Unlawful To Hunt Migratory Birds From Water." Said area is more particularly described as follows:

Known as and being an area known as the open water areas of Muddy creek bay lying within sections 20, 21, 22, and 23, T6N, R16E Bay township, Ottawa county, Ohio and sections 27, 28, and 29, T6N R16E Rice township, and sections 26, 27, 28, and 34, T6N R16 Riley township, Sandusky county, Ohio, and being more particularly described as follows:

1501:31-11-18 Killbuck refuge.

(A) It shall be unlawful for any person to enter at any time without written permission from the chief of the division of wildlife within a certain area on the Killbuck refuge, posted with signs reading "State Game Refuge, Trespassing Unlawful," more particularly described as follows:

(1) Beginning at the southwest corner of Wooster township in Wayne county and continuing due east along the boundary between Wooster and Franklin townships for a distance of three thousand two hundred feet; thence due north for a distance of two thousand four hundred twenty-five feet; thence due west for a distance of five hundred forty feet; thence due south for a distance of one thousand seven hundred ten feet; thence due west for a distance of two thousand six hundred forty feet to the boundary between Wooster and Plain townships; thence due south along the boundary between Wooster and Plain townships for a distance of six hundred seventy feet to the point of beginning.

(2) Begining at a point where state highway 83 intersects County Line road, thence northerly on state highway 83 to Force road, thence westerly on Force road to township road 76, thence southerly on township road 76 to Shreve Eastern road to County Line road, thence easternly on County Line road to state highway 83.

(B) The lands described above shall be closed to all persons except authorized personnel of the division of wildlife while such persons are in the performance of their official duties, or those issued a permit by the chief of the division of wildlife.

(A) It shall be unlawful for any person to trespass from November first through March first without a permit from the chief of the division of wildlife within a certain area of the Big Island wildlife area posted as "No Trespassing Zone" and more particularly described as follows:

Located in Big Island township, Marion county, beginning at point 83 degrees 14.85 minutes west, 40 degrees 34.30 minutes north, proceed west for a distance of 1,471 feet to a point on the bank of Glade Run, 83 degrees 15.17 minutes west, 40 degrees 34.31 minutes north; then proceed south-southwest a distance of 815 feet to a point along Glade Run, 83 degrees 15.09 minutes west, 40 degrees 34.195 minutes north, then proceed east a distance of 1,080 feet to the point 83 degrees 14.86 minutes west, 40 degrees 34.19 minutes north, then proceed north a distance of 658 feet to the point of beginning, 83 degrees 14.85 minutes west, 40 degrees 34.30 minutes north.
