Chapter 1501-1 Notice of Public Hearing

1501-1-01 [Effective until 1/24/2016] Notice of public hearing.

(A) The director of natural resources shall publish notice of public hearings to be conducted for the purpose of adopting, amending or rescinding rules under sections 119.03 to 119.13 of the Revised Code at least once in five newspapers published in different counties and of general circulation in the state.

(B) The notice shall be given at least thirty days, but not more than fifty days, prior to the hearing. The notice shall state the department's intention to adopt, amend or rescind a rule; shall include a synopsis of the proposed rule, amendment, or rule to be rescinded; shall state the reason for adopting, amending or rescinding the rule; and shall enumerate the date, time, and place of the hearing. The notice shall also state the manner in which copies of the proposed rule, amendment, or rule to be rescinded may be obtained.

(C) The director shall furnish the public notice required under section 119.03 of the Revised Code and as detailed by paragraph (B) of this rule to any person who requests notice in writing and pays a reasonable fee, not to exceed the cost of copying and mailing.

1501-1-01 [Effective 1/24/2016] Notice of a public hearing.

Public notice of hearing to be conducted by the department of natural resources shall be advertised in the register of Ohio at least thirty days, but not more than forty days, prior to the hearing. In addition to public notice given in the register of Ohio, the department may give whatever other notice it reasonably considers necessary to ensure notice contructively is given to all persons who are subject to or affected by the propsed rule, amendment or recission. The notice shall include: a statement of the department's intention to consider adopting, amending, or rescinding a rule; a synopsis of the propsed rule, amendment, or rule to be rescinded, or a general statement of the subject matter to which the proposed rule, amendment, or recission relates; a statement of the reason or purpose for adopting, amending, or rescinding the rule; and the date, time, and place of a hearing on said proposed action. The notice shall also state the place from which copies of the propsed rule, amendment, or rule to be rescinded may be obtained.
