Rule 1501:31-3-05 | Possession of gill nets.

 

Under authority of sections 1531.08, 1533.44, and 1533.55 of the Revised Code, the chief of the division of wildlife hereby orders that:

(A) It shall be unlawful for any person to draw, set, place, locate, use, maintain, or possess gill nets in the state of Ohio, except:

(1) Bona fide manufacturers and dealers in gill netting or gill nets may possess and transport gill netting or gill nets in this state in the regular course of their business.

(2) Persons who hold a valid wild animal collecting permit issued by the chief of the division of wildlife under section 1533.08 of the Revised Code may possess and transport gill nets so long as such nets are used in accordance with the permit.

(B) All definitions set forth in rule 1501:31-1-02 of the Administrative Code shall apply to this rule.

(C) All provisions in section 1533.55 of the Revised Code not mentioned in or modified by this rule shall remain in effect.
