Chapter 3301-38 Educational Regional Service System

3301-38-01 Transfer of region within the educational regional service system.

(A) Definitions:

(1) “Educational regional service system (ERSS)” is defined by section 3312.01 of the Revised Code as a system that supports state and regional education initiatives and efforts to improve school effectiveness and student achievement.

(2) “Region” is defined by section 3312.02 of the Revised Code as one of sixteen regions that comprise the ERSS.

(3) “School district” means any city, exempted village, or local school district as defined by section 3311.01 of the Revised Code.

(B) Procedures:

(1) A school district that is proposing a transfer of region within the educational regional service system shall, in a timely manner, convene a meeting to discuss delivery of services with the region to which the district wishes to transfer.

(2) A board of education of a school district may elect, by a resolution approved by a majority of its members, to transfer from the region to which it was assigned pursuant to section 3312.02 of the Revised Code to another region. The resolution will be promptly filed with the advisory council of each region affected by the resolution and with the superintendent of public instruction. The resolution shall include the following criteria:

(a) A detailed rationale for the transfer to another region;

(b) Specific timelines for implementation of services to be provided by the region to which the district wishes to transfer;

(c) A plan to evaluate the new region; and

(d) A statement documenting the meeting described in paragraph (B)(1) of this rule.

(3) The resolution adopted by the local board of education shall not be effective until it is filed with the superintendent of public instruction. The transfer of the school district to another region shall not be effective until July first of the academic-year following the date that the resolution is filed with the superintendent of public instruction. (In other words, if a resolution is filed with the superintendent of public instruction prior to the end of the 2006-2007 academic-year, the transfer will be effective July 1, 2007.)

(C) Pursuant to section 3312.02 of the Revised Code no school district shall be permitted to transfer to a different region after June 30, 2009.
