Chapter 3301-58 Value-Added Progress Dimension

3301-58-01 Levels of academic progress in reading and mathematics relative to a standard year of academic growth.

This rule applies only to schools and districts for which value-added calculations can be computed.

(A) As required by section 3302.021 of the Revised Code, a standard year of academic growth is defined as progress that falls within one standard error of measurement of the average amount of progress schools and districts make during the 2006-2007 school year. Performance in reading and mathematics for each school and district will be compared to the average growth computed separately for reading and for mathematics in grades three through eight for the state during the 2006-2007 school year.

(B) A composite determination of academic progress will be computed for each school and district by combining progress in reading and mathematics at the component grade levels.

(C) The levels of academic progress shall be described by one of the following three categories:

(1) Above average;

(2) Average; and

(3) Below average.

(D) Above average performance shall indicate that a school or district has made greater progress than the standard year of academic growth.

(E) Average performance shall indicate that a school or district has made a standard year of academic growth.

(F) Below average performance shall indicate that a school or district has made less progress than the standard year of academic growth.

3301-58-02 Confidentiality of student test scores and individual student reports.

(A) In accordance with sections 3301.0711, 3301.0714, and 3319.321 of the Revised Code and the Family and Educational Rights and Privacy Act (FERPA), 20 U.S.C. 1232g, individual student test scores and individual student reports shall be made available only to a student’s classroom teacher, other appropriate educational personnel, and the student’s parent or guardian.

(B) In accordance with paragraph (C) of rule 3301-13-06 of the Administrative Code, each school district and participating school shall adopt a policy and establish procedures for releasing or permitting access to a student’s proficiency, achievement, or diagnostic test results. The policy and procedures shall comply with paragraphs (G) and (H) of rule 3301-13-01 of the Administrative Code and with section 3319.321 of the Revised Code.

3301-58-03 Incorporation of the value-added progress dimension into the accountability system.

This rule applies only to schools and districts for which value-added calculations can be computed.

(A) In accordance with section 3302.021 of the Revised Code, the value-added progress dimension shall be incorporated into the report cards and performance ratings issued for buildings and districts pursuant to section 3302.03 of the Revised Code.

(B) In accordance with division (B)(1) of section 3302.03 of the Revised Code, a school or district that would have been declared excellent and achieves above average growth as defined in paragraph (D) of rule 3301-58-01 of the Administrative Code for at least two consecutive years shall be declared excellent with distinction.

(C) In accordance with division (B)(2) of section 3302.03 of the Revised Code, a school or district that would have been declared effective and achieves above average growth as defined in paragraph (D) of rule 3301-58-01 of the Administrative Code for at least two consecutive years shall be declared excellent.

(D) In accordance with division (B)(3) of section 3302.03 of the Revised Code, a school or district that would have been declared in need of continuous improvement and achieves above average growth as defined in paragraph (D) of rule 3301-58-01 of the Administrative Code for at least two consecutive years shall be declared effective, except as provided in paragraph (L) of this rule.

(E) In accordance with division (B)(4) of section 3302.03 of the Revised Code, a school or district that would have been declared to be under an academic watch and achieves above average growth as defined in paragraph (C) of rule 3301-58-01 of the Administrative Code for at least two consecutive years shall be declared in need of continuous improvement.

(F) In accordance with division (B)(5) of section 3302.03 of the Revised Code, a school or district that would have been declared to be in a state of academic emergency and achieves above average growth as defined in paragraph (D) of rule 3301-58-01 of the Administrative Code for at least two consecutive years shall be declared to be under an academic watch.

(G) In accordance with division (B)(1) of section 3302.03 of the Revised Code, a school or district that would have been declared excellent and achieves below average growth as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared effective.

(H) In accordance with division (B)(2) of section 3302.03 of the Revised Code, a school or district that would have been declared effective and achieves below average growth as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared in need of continuous improvement.

(I) In accordance with division (B)(3) of section 3302.03 the Revised Code, a school or district that would have been declared in need of continuous improvement and achieves below average growth as defined in paragraph (C) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared to be under an academic watch, except as provided in paragraph (K) of this rule.

(J) In accordance with division (B)(4) of section 3302.03 of the Revised Code, a school or district that would have been declared to be under an academic watch and achieves below average growth as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared to be in a state of academic emergency.

(K) A school or district that is declared in need of continuous improvement on the basis of failing to make adequate yearly progress for more than two consecutive years (pursuant to division (B)(2)(b) of section 3302.03 of the Revised Code) for more than one subgroup (pursuant to division (B)(6) of section 3302.03 of the Revised Code) and otherwise would have been declared excellent or effective and also has achieved below average growth as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall not be declared to be under an academic watch.

(L) A school or district that is declared in need of continuous improvement on the basis of making adequate yearly progress pursuant to division (B)(3)(a) of section 3302.03 of the Revised Code and would not have been declared in need of continuous improvement if it had not met adequate yearly progress shall not be declared effective on the basis of achieving above average growth as defined in paragraph (D) of rule 3301-58-01 of the Administrative Code for at least two consecutive years.
