Chapter 3301-58 Value-Added Progress Dimension
3301-58-01
Levels of academic progress in reading and mathematics relative to a standard year of academic growth.
This rule applies only to schools and districts for which value-added calculations can be computed.
(A) As required by section 3302.021 of the Revised Code, a standard year of academic growth is defined as progress that falls within two standard errors of measurement of the average amount of progress schools and districts make during the current school year. Performance in reading and mathematics for each school and district will be compared to the average growth computed separately for reading and for mathematics in grades three through eight in a base year. The base year will be periodically updated to meet acceptable statistical practice. For the purpose of incorporating the value-added progress dimension into the accountability system in 2010-2011 as described in paragraphs (I) to (K) of rule 3301-58-03 of the Administrative Code, the value-added results for the 2008-2009 and 2009-2010schoolyears shall be recomputed to meet the standard defined in this paragraph.
(B) A composite determination of academic progress will be computed for each school and district by combining progress in reading and mathematics at the component grade levels.
(C) The levels of academic progress shall be described by one of the following three categories:
(1) Exceeds growth expectations;
(2) Meets growth expectations; and
(3) Does not meet growth expectations.
(D) Exceeds growth expectations shall indicate that a school or district has made greater progress than the standard year of academic growth.
(E) Meets growth expectations shall indicate that a school or district has made a standard year of academic growth.
(F) Does not meet growth expectations shall indicate that a school or district has made less progress than the standard year of academic growth.

Confidentiality of student test scores and individual student reports.
(A) In accordance with sections 3301.0711, 3301.0714, and 3319.321 of the Revised Code and the Family and Educational Rights and Privacy Act (FERPA), 20 U.S.C. 1232g, individual student test scores and individual student reports shall be made available only to a student's classroom teacher, other appropriate educational personnel, and the student's parent or guardian.
(B) In accordance with paragraph (C) of rule 3301-13-06 of the Administrative Code, each school district and participating school shall adopt a policy and establish procedures for releasing or permitting access to a student's proficiency, achievement, or diagnostic test results. The policy and procedures shall comply with paragraphs (G) and (H) of rule 3301-13-01 of the Administrative Code and with section 3319.321 of the Revised Code.

Incorporation of the value-added progress dimension into the accountability system.
This rule applies only to schools and districts for which value-added calculations can be computed.
(A) In accordance with section 3302.021 of the Revised Code, the value-added progress dimension shall be incorporated into the report cards and performance ratings issued for buildings and districts pursuant to section 3302.03 of the Revised Code.
(B) In accordance with division (B)(1) of section 3302.03 of the Revised Code, a school or district that would have been declared excellent and exceeds growth expectations as defined in paragraph (D) of rule 3301-58-01 of the Administrative Codein the current year shall be declared excellent with distinction.
(C) In accordance with division (B)(2) of section 3302.03 of the Revised Code, a school or district that would have been declared effective and exceeds growth expectations as defined in paragraph (D) of rule 3301-58-01 of the Administrative Codein the current year shall be declared excellent.
(D) In accordance with division (B)(3) of section 3302.03 of the Revised Code, a school or district that would have been declared in need of continuous improvement and exceeds growth expectations as defined in paragraph (D) of rule 3301-58-01 of the Administrative Codein the current year shall be declared effective.
(E) In accordance with division (B)(4) of section 3302.03 of the Revised Code, a school or district that would have been declared to be under an academic watch and exceeds growth expectations as defined in paragraph (D) of rule 3301-58-01 of the Administrative Codein the current year shall be declared in need of continuous improvement.
(F) In accordance with division (B)(5) of section 3302.03 of the Revised Code, a school or district that would have been declared to be in a state of academic emergency and exceeds growth expectations as defined in paragraph (D) of rule 3301-58-01 of the Administrative Codein the current year shall be declared to be under an academic watch.
(G) In accordance with division (B)(1) of section 3302.03 of the Revised Code, a school or district that would have been declared excellent and does not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at leasttwo consecutive years shall be declared effective.
Note: For the 2010-2011 school year reports only, the provisions in this paragraph apply only if a school or district that would have been declared excellent and does not provide growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years.
(H) In accordance with division (B)(2) of section 3302.03 of the Revised Code, a school or district that would have been declared effective and does not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at leasttwo consecutive years shall be declared in need of continuous improvement.
Note: For 2010-2011 school year reports only, a school or district that would have been declared effective and does not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared in need of continuous improvement.
(I) In accordance with division (B)(3) of section 3302.03 the Revised Code, a school or district that would have been declared in need of continuous improvement and does not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at leasttwo consecutive years shall be declared to be under academic watch.
Note: For 2010-2011 school year reports, a school or district that would have been declared in need of continuous improvement and did not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared to be under academic watch.
(J) In accordance with division (B)(4) of section 3302.03 of the Revised Code, a school or district that would have been declared to be under an academic watch and does not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at leasttwoconsecutive years shall be declared to be in a state of academic emergency.
Note: For 2010-2011 school year reports, a school or district that would have been declared to be under an academic watch and did not meet growth expectations as defined in paragraph (F) of rule 3301-58-01 of the Administrative Code for at least three consecutive years shall be declared in a state of academic emergency.
(K) Paragraphs (B) to (J) of this rule do not apply to a school or district that otherwise would have been declared to be excellent or effective, but has its designation decreased to effective or continuous improvement on the basis of failing to make adequate yearly progress for the same two or more subgroups for three or more consecutive years pursuant to division (B)(1) of section 3302.03 of the Revised Code.
(L) Paragraphs (B) to (J) of this rule do not apply to a school or district that otherwise would have been declared to be in a state of academic watch or academic emergency, but has its designation increased to continuous improvement on the basis of making adequate yearly progress pursuant to division (B)(3)(a) of section 3302.03 of the Revised Code.
