3301-73-02 Delegation.

(A) The state board authorizes the superintendent, on its behalf, to initiate proceedings under Chapter 119. of the Revised Code warranting an action pursuant to section 3319.31 of the Revised Code, including, but not limited to, automatic revocation or denial of a respondent’s license.

(B) The superintendent’s authority under section 3319.31 of the Revised Code extends to notifying the person that an investigation has been completed and, based upon that investigation, determining whether the results warrant initiating an action for the state board to limit, suspend, revoke or deny licensure pursuant to section 3319.31 of the Revised Code.

(C) The superintendent shall notify the respondent of his/her rights under Chapter 119. of the Revised Code including his/her right to a hearing and to be represented by counsel.

(D) The state board authorizes the superintendent, on its behalf, to issue a written order revoking or denying issuance of licensure and reinstating licensure under division (C) of section 3319.31 of the Revised Code.
