Rule 3344-92-01 | Law enforcement policy for public events held on the campus of Cleveland state university.
 

(A) Section 33445.21 of the Revised Code places a duty on the Cleveland state university board of trustees to maintain law and order on the Cleveland state university campus. In order to provide for the safety of persons and property on Cleveland state university's campus, it is hereby recognized and required that all law enforcement efforts or measures undertaken on Cleveland state university's campus and in every university-owned or operated facility shall be under the authority and direction of the chief of th4e Cleveland state university police department (hereinafter referred to as the "chief of university police."

(B) The procedure set forth below shall be required for all public events to be held on Cleveland state university's campus or in university-owned or operated facilities. For the purposes of this policy, public event means an event or function to which the general public is invited, whether or not an admissions fee is charged, not including events sponsored by recognized student groups which are covered by the relevant policies and procedures related to student organizations.

(1) If the public event is expected to involve five hundred or more spectators and/or participants, the university police shall be notified by the person responsible for planning the public event at least thirty days in advance of the event. All notifications made pursuant to this paragraph shall be in writing and on the appropriate university form for special events.

(2) The chief of university police or his designee shall determine the types, numbers and qualifications of any peace officers and/or other security personnel to be used at the public event, and shall communicate such determinations in writing to the person responsible for planning the event.

(3) The chief of university police or his designee shall be responsible for ensuring that all public events comply with all of the applicable requirements of section 2917.40 of the Revised Code. If the public event is subject to section 2917.40 of the Revised Code, then the person responsible for planning the public event shall submit a security plan to the chief of university policy for approval thirty days prior to the event.

(4) No public event to be held in a university-owned or operated facility or elsewhere on Cleveland state university's campus shall be permitted to go forward without the prior writing approval of the chief of university policy or his designee. The chief of university police or his designee may refrain from providing such prior written approval if, in the judgment of the chief of university policy or his designee:

(a) There will not be adequate or proper security at the public event;

(b) The public event jeopardizes the safety or persons or property;

(c) The public event does not comply with all applicable safety laws, ordinances and regulations as well as all applicable fire codes and regulations.

(5) All peace officers and other security personnel working at the public event are subject to the orders and directions of the chief of university policy or his designee. The chief of university police or his designee may order any privately employed peace officers or other security personnel off the university's campus for failure to comply with an order of the chief of university police or his designee.

(6) The chief of university policy or his designee shall have the authority to terminate any public event if, in the judgment of the chief of police or his designee:

(a) There is not adequate or proper security at the public event;

(b) The public event jeopardizes the safety of persons or property; or

(c) The public event does not comply with all applicable safety laws, ordinances and regulations as well as all applicable fire codes and regulations.

(7) If the public event is a non-university event, then the costs of providing security at the event, including the cost of all university police and all privately employed peace officers and other security personnel, shall be paid by the outside organization which is hosting or conducting the event.

(8) If there is a need during the public event for additional security personnel or for emergency medical assistance, then the university policy department must be called immediately.

(9) These procedures are in addition to, and do not replace, the procedures used by conference services or any other Cleveland state university rule or regulation.
