Chapter 3701-1 General Provisions

3701-1-01 Public notice - rulemaking hearings.

(A) At the direction of the secretary of the public health council, public notice of the intention of the council to conduct a public hearing on a proposal to adopt, amend, or rescind a rule, when required by section 119.03 of the Revised Code, shall be provided in accordance with this rule. The public notice shall be published in the register of Ohio at least thirty days prior to the date set for the public hearing. The public notice shall include all of the following:

(1) A statement of the council’s intention to consider adopting, amending, or rescinding a rule;

(2) A synopsis of the proposed rule, amendment, or rule to be rescinded or a general statement of the subject matter to which the proposed rule, amendment, or rescission relates;

(3) A statement of the reason or purpose for adopting, amending, or rescinding the rule; and

(4) The date, time, and place of the public hearing on the proposed action, which shall not be earlier than the thirty-first or later than the fortieth day after the proposed rule, amendment or rescission is filed.

(B) The secretary of the council shall maintain a mailing list of all persons who make a request to receive a copy of each public notice provided for in paragraph (A) of this rule, and shall send via e-mail or regular mail a copy of the public notice to each person on the subscription list at least thirty days prior to the date set for the hearing.

3701-1-02 Notice of regular and special meetings of the public health council.

(A) A notice of each regular and special meeting of the public health council shall be filed forthwith by the secretary of the council with the director of health, stating the time and place of each regular meeting of the council and the time, place, and purpose of each special meeting of the council. Any person may determine or obtain such information by writing to the “Secretary of the Public Health Council, c/o The Office of the General Counsel, 246 N. High Street, Columbus, Ohio 43215” as provided in paragraph (B) of this rule, by telephoning (614) 466-4882, or by e-mailing to odhlegal@odh.ohio.gov.

(B) Any person may obtain reasonable advance written notification in the form of a copy of the agenda of all meetings of the council at which any specific type of public business is to be discussed or may request to be placed upon a mailing list to receive a copy of the agenda for all council meetings. The secretary of the council may require persons on the mailing list established in accordance with this paragraph to pay a reasonable charge for receiving the agenda not to exceed the cost of copying and mailing.

(C) The secretary of the council shall maintain a list of news media which have requested notification, and such media shall be given at least twenty-four hours advance notice of each special meeting of the council, except in the event of an emergency requiring immediate official action. In the event of an emergency, the director of health or the secretary of the council on behalf of the members of the council calling the meeting shall notify the news media that have requested notification immediately of the time, place, and purpose of the meeting.

(D) A special meeting for the purpose of addressing a singular issue may be called upon the request of any four members of the council or upon request of the director of health.
