3745-50-21 Draft permits.

(A) Upon receipt of a complete application, the director must decide whether to prepare a draft permit or issue a notice of intent to deny the permit application for Class 3 modifications, new facility permits, or renewal permits.

(B) Reserved.

(C) If the director tentatively decides to deny a Class 3 modification application or renewal application, the director must issue a notice of intent to deny. A notice of intent to deny the new facility or renewal permit application or the Class 3 modification application is a type of draft permit which follows the same procedures as any draft permit prepared under this rule. If the director subsequently decides that the tentative decision to deny the new facility or renewal permit application or the Class 3 modification application was incorrect, the director must withdraw the notice of intent to deny and prepare a draft permit under paragraph (D) of this rule.

(D) If the director decides to prepare a draft permit, the director must prepare a draft permit that contains the following information to the extent applicable:

(1) All conditions under rule 3745-50-58 of the Administrative Code;

(2) All compliance schedules under rule 3745-50-50 of the Administrative Code;

(3) All monitoring requirements under rule 3745-50-48 of the Administrative Code; and

(4) Standards for treatment, storage, and/or disposal and other permit conditions under rule 3745-50-58 of the Administrative Code.

(E) Draft permits must be accompanied by a fact sheet (see rule 3745-50-22 of the Administrative Code).
