Rule 3745-56-71 | Treatment program- land treatment.

 

(A) An owner or operator subject to this rule shall establish a land treatment program that is designed to ensure that hazardous constituents placed in or on the treatment zone are degraded, transformed, or immobilized within the treatment zone. The permit shall specify the elements of the treatment program, including all of the following:

(1) The wastes that are capable of being treated at the unit based on a demonstration under rule 3745-56-72 of the Administrative Code.

(2) Design measures and operating practices necessary to maximize the success of degradation, transformation, and immobilization processes in the treatment zone in accordance with paragraph (A) of rule 3745-56-73 of the Administrative Code.

(3) Unsaturated zone monitoring provisions that comply with rule 3745-56-78 of the Administrative Code.

(B) The permit shall specify the hazardous constituents that shall be degraded, transformed, or immobilized under rules 3745-56-70 to 3745-56-83 of the Administrative Code. Hazardous constituents are constituents identified in the appendix to rule 3745-51-11 of the Administrative Code that are reasonably expected to be in, or derived from, waste placed in or on the treatment zone.

(C) The permit shall specify the vertical and horizontal dimensions of the treatment zone. The "treatment zone" is the portion of the unsaturated zone below and including the land surface in which the owner or operator intends to maintain the conditions necessary for effective degradation, transformation, or immobilization of hazardous constituents. The maximum depth of the treatment zone shall be both of the following:

(1) No more than 1.5 meters (five feet) from the initial soil surface.

(2) More than one meter (three feet) above the seasonal high water table.
