3770:1-7-11 Ohio lottery commission game number eleven.

(A) Title and term. Ohio lottery commission game number eleven shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period beginning on the date when ticket sales are commenced, and continuing through the date on which such sales are terminated, by the commission.

(B) General design.

(1) Game number eleven will be a number-match lottery game.

(2) A ticket in game number eleven shall consist of two detachable portions, one called the "main ticket" and the other called the "stub ticket." Neither portion of a ticket may be sold separately; however, once a ticket is sold or deemed sold in accordance with these rules, the main ticket and the stub ticket shall each have all the characteristics of a ticket as that term is defined for the purposes of these rules and the regulations of the director.

(3) There will be five types of drawings associated with the main ticket to be called regular drawings, weekly finalist selection drawings, weekly finalist prize drawings, millionaire finalist selection drawings, and millionaire prize drawings, respectively.

(4) There will be one type of drawing associated with the stub ticket to be called a regular stub drawing. During each week of the game a regular stub drawing will be conducted at which one six-digit number shall be selected at random from the set of all such numbers.

(5) During each week of the game a regular drawing will be conducted at which one one-digit number; one two-digit number; and one three-digit number shall be selected at random from the sets of all such numbers. Holders of valid tickets for a given regular drawing bearing any of the numbers drawn in that drawing shall be entitled to a prize award or eligibility for a weekly finalist selection drawing or a millionaire finalist selection drawing in accordance with this rule.

(6) A drawing of numbers in another commission game may serve as the regular drawing in this game.

(C) Price of tickets. The price of a ticket issued by the commission in game number eleven shall be fifty cents.

(D) Structure and size of prize disbursements.

(1) The main ticket shall bear one one-digit number in an area designated the "first area"; one two-digit number in an area designated the "second area"; and one three-digit number in an area designated the "third area."

(2) Based upon the numbers drawn in each regular drawing, the prizes of five dollars, ten dollars, one hundred dollars, one thousand dollars, and ten thousand dollars shall be awarded to the holders of valid tickets for that drawing as follows:

(a) A prize of five dollars if the ticket bears the two-digit number drawn in the second area;

(b) A prize of ten dollars if the ticket bears the three-digit number drawn in the third area;

(c) A prize of ten dollars if the ticket bears the one-digit number drawn in the first area and the two-digit number drawn in the second area;

(d) A prize of one hundred dollars if the ticket bears the one-digit number drawn in the first area and the three-digit number drawn in the third area;

(e) A prize of one thousand dollars if the ticket bears the two-digit number drawn in the second area and the three-digit number drawn in the third area; and

(f) A prize of ten thousand dollars if the ticket bears the one-digit number drawn in the first area, the two-digit number drawn in the second area, and the three-digit number drawn in the third area.

(3) Holders of valid tickets for a regular drawing which bear the one-digit number drawn in the first area, and who comply with all applicable provisions of this rule, shall be eligible to participate in a weekly finalist selection drawing. In each weekly finalist selection drawing, four weekly finalists shall be selected at random from the participants in that drawing. The number of participants in the weekly finalist selection drawings will vary depending upon the volume of tickets sold and the number of valid tickets received by the lottery conferring eligibility on their holders to participate in such drawings. Participants in weekly finalist selection drawings who are not selected as weekly finalists shall be eligible to participate in a millionaire finalist selection drawing.

(4) In each weekly finalist prize drawing, one first prize shall be awarded which shall be in one of the following amounts: twenty-five thousand dollars; fifty thousand dollars; seventy-five thousand dollars; one hundred fifty thousand dollars; or two hundred thousand dollars. The exact amount of this prize in each such drawing shall be determined in accordance with the provisions of this rule. Depending on the number of weekly finalists in the particular drawing, three or four additional prizes shall be awarded each to be in an amount not less than five thousand dollars nor more than ten thousand dollars.

(5) In each millionaire finalist selection drawing, a number of millionaire finalists shall be selected in order that, as nearly as is practicable, two such finalists are selected for every one million tickets sold in the game. Participants in weekly and millionaire finalist selection drawings who are not selected as finalists shall not receive a prize award. In each millionaire prize drawing, one prize of one million dollars will be awarded, and additional prizes in the amounts of one hundred thousand dollars, fifty thousand dollars, ten thousand dollars, two thousand dollars, and one thousand dollars may be awarded. Each millionaire finalist in a millionaire prize drawing shall win at least one thousand dollars.

(6) The stub shall bear one six-digit number in an area designated the "first stub area"; one distinct six-digit number in an area designated the "second stub area"; and one distinct six-digit number in an area designated the "third stub area."

(7) Based upon the numbers drawn in each regular stub drawing, the prizes of seven thousand five hundred dollars, twelve thousand five hundred dollars, and twenty thousand dollars shall be awarded to the holders of valid stub tickets for that drawing as follows:

(a) A prize of seven thousand five hundred dollars if the stub ticket bears the six-digit number drawn in the first stub area;

(b) A prize of twelve thousand five hundred dollars if the stub ticket bears the six-digit number drawn in the second stub area; and

(c) A prize of twenty thousand dollars if the stub ticket bears the six-digit number drawn in the third stub area.

(E) Number of prize disbursements.

(1) The number of prize awards in any regular drawing will depend on the number of tickets actually sold for that drawing. Tickets shall be printed using random techniques in order that:

(a) The possible numbers specified in this rule are randomly distributed throughout all the tickets printed in any given ticket issuance; and

(b) Mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning tickets in the regular drawings per one million tickets sold is as follows:

(i) Ninety-eight thousand eight hundred ninety-nine tickets winning eligibility for weekly finalist and millionaire selection drawings;

(ii) Eight thousand nine hundred eighty-nine tickets winning prizes of five dollars;

(iii) One thousand eight hundred eighty-eight tickets winning prizes of ten dollars;

(iv) Ninety-nine tickets winning prizes of one hundred dollars;

(v) Nine tickets winning prizes of one thousand dollars; and

(vi) One ticket winning a prize of ten thousand dollars.

(2) In each weekly finalist prize drawing, one first prize in an amount of twenty-five thousand dollars; fifty thousand dollars; seventy-five thousand dollars; one hundred fifty thousand dollars; or two hundred thousand dollars shall be awarded, and three or four prizes each in amounts not less than five thousand dollars nor more than ten thousand dollars shall be awarded, as follows below in this paragraph.

(a) In the first weekly finalist prize drawing in any sales cycle, and in any subsequent weekly finalist prize drawing in that cycle in which there is no continuing winner, as defined below, one of the four finalists shall be selected as the drawing winner and shall win an initial prize award of twenty-five thousand dollars. The drawing winner shall be called the continuing winner and shall be entitled to participate in the next weekly finalist prize drawing. The remaining finalists shall each win prizes not less than five thousand dollars nor more than ten thousand dollars, the expected average value of which shall be seven thousand five hundred dollars as nearly as practicable.

(b) In each weekly finalist prize drawing in which there is a continuing winner, one of the four finalists shall be selected at random as the drawing semifinal winner. Then either the drawing semifinal winner or the continuing winner shall be selected at random to be the drawing winner.

(i) If the drawing semifinal winner is selected as the drawing winner, he shall become the continuing winner and shall win a prize of twenty-five thousand dollars.

(ii) If the continuing winner is selected to be the drawing winner, the drawing semifinal winner shall receive a prize of ten thousand dollars, the continuing winner shall remain as continuing winner, and the continuing winner shall receive an additional prize award as follows:

(a) A prize of fifty thousand dollars if it is the second consecutive drawing in which he is the drawing winner;

(b) A prize of seventy-five thousand dollars if it is the third consecutive drawing in which he is the drawing winner;

(c) A prize of one hundred thousand dollars if it is the fourth consecutive drawing in which he is the drawing winner; and

(d) A prize of two hundred thousand dollars if it is the fifth consecutive drawing in which he is the drawing winner.

(iii) Those finalists not selected as the semifinal drawing winner shall each receive a prize award not less than five thousand dollars nor more than ten thousand dollars, the expected average value of which shall be seven thousand five hundred dollars as nearly as practicable.

(c) A given continuing winner may only return in four successive weekly finalist prize drawings; that is, he may not be the drawing winner in more than five consecutive drawings.

(d) Each continuing winner shall be deemed to win a single prize award equal to the total of the initial prize and the additional prizes won. The maximum prize which a continuing winner can win in consecutive weekly finalist prize drawings is five hundred thousand dollars.

(3) The commission may modify the prize structure of finalist prize drawings from time to time during the conduct of game number eleven, provided that the prize structure must comply with the requirements of this rule and the Lottery Act.

(4) In each millionaire drawing one prize of one million dollars will be awarded. The commission shall determine the exact structure of lesser prizes for the millionaire drawings. The prize structure may be modified by the commission during the conduct of the game, provided that the prize structure must comply with the requirements of this rule and of the Lottery Act. The director may limit the number of participants in any given millionaire drawing to one hundred.

(5) The number of prize awards in any regular stub drawing will depend on the number of stub tickets actually sold for that drawing. Stub tickets shall be printed using random techniques in order that:

(a) The possible numbers specified in this rule are randomly distributed throughout all the tickets printed in any given ticket issuance; and

(b) Mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning stub tickets in the regular stub drawings per one million tickets sold is as follows:

(i) One stub ticket winning a prize of seven thousand five hundred dollars;

(ii) One stub ticket winning a prize of twelve thousand five hundred dollars; and

(iii) One stub ticket winning a prize of twenty thousand dollars.

(F) Frequency of prize drawings.

(1) A regular drawing shall be held each week on a day to be determined by the director; a weekly finalist selection and a weekly finalist prize drawing shall be held in every week, on days to be determined by the director, provided that no such drawings will be held in the first week, and no weekly finalist prize drawing will be held in the second week of a given sales cycle of the game. Millionaire finalist selection drawings shall be held at such times during a sales cycle as the director shall determine, and a millionaire drawing shall be held as soon as is practicable after each date during a sales cycle on which one hundred eligible holders are determined.

(2) If holders of valid winning tickets who are eligible to participate in a weekly finalist selection drawing or a millionaire selection drawing claim their eligibility after the last such drawing of a given cycle of game number eleven, but otherwise in accordance with the Lottery Act and these rules, the director shall adopt procedures to afford such persons the opportunity to participate either in a weekly finalist selection drawing and, for the finalists there selected, the opportunity to participate in a weekly finalist prize drawing, or the opportunity to participate in a millionaire selection drawing and for the millionaire finalists there selected, in a millionaire prize drawing, as the case may be, under circumstances as similar as is practicable to the circumstances of such drawings held during the applicable sales cycle of the game. The drawing winner of the last weekly finalist prize drawing held under this paragraph shall not be entitled to participate in a succeeding weekly finalist prize drawing.

(3) A regular stub drawing shall be held each week on a day to be determined by the director.

(G) Manner of prize drawings.

(1) Prize drawings shall be open to the public and, whenever possible, persons eligible to win prizes shall be encouraged to attend and participate. Drawings may be held at the commission's headquarters, its regional offices or other places throughout the state as the director determines. The director shall inform the public as to the time and place of each prize drawing.

(2) All holders of valid tickets for a given regular drawing are eligible to win in that drawing. Prize winners shall claim their prizes, or their eligibility for a weekly finalist selection drawing or a millionaire selection drawing, won in regular drawings, by surrendering their tickets in accordance with the procedures of these rules.

(3) All drawings in game number eleven will be conducted in accordance with random procedures approved by the director. For every drawing in game number eleven, the director will approve procedures and mechanisms for the selection of winners and the awarding of prizes in order that, insofar as is possible, random selection will be achieved.

(H) Special claim, entry, receipt and validation procedures.

(1) The director shall establish special entry, claim, receipt and validation procedures governing eligibility for, and participation in, weekly finalist selection drawings and millionaire selection drawings.

(2) Eligibility for such weekly finalist and millionaire selection drawings is expressly conditioned on compliance with the provisions of this rule and the procedures of the director authorized hereunder. The director's procedures governing these drawings shall provide, without limitation, procedures for the submission to the lottery of each entry of a valid winning ticket conferring eligibility; procedures for the identification of the holder of such ticket; procedures for deadlines by which such entries must be received to be eligible for given drawings; procedures for any necessary special validation; procedures for the transmittal to the state lottery by sales agents of tickets conferring eligibility; procedures for the claim and surrender of such tickets at lottery offices; and procedures governing all other matters which he may deem necessary or advisable consistent with the provisions of these rules.

(3) As to tickets transmitted by any means for entry into weekly finalist and millionaire selection drawings, whether surrendered to sales agents or otherwise transmitted, all risk of loss in transit arising from any source shall be borne by the holders of such tickets, regardless of any negligence, misfeasance or nonfeasance on the part of any lottery sales agent or any bank providing safekeeping and depository services to the lottery, or by any lottery employee. The commission shall have no responsibility or liability as to any such tickets lost or damaged in transit or otherwise not actually received at lottery headquarters in Cleveland. All such tickets must pass all validation tests before their holders may become eligible for a weekly bonus drawing or the grand drawing.

(I) Validity of tickets. A mechanical error in printing the prize amounts on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction can be advised of the correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, and it is possible that the ticket was a winning ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a free replacement ticket if ticket sales are still continuing in that sales cycle.

(J) Director's conduct of game number eleven.

(1) The director shall conduct game number eleven in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule, 3770:1-7-11 of the Administrative Code, and the regulations of the director. As he deems it necessary or advisable, he shall adopt management regulations, orders or directives to implement and operate this lottery game.

(2) Names and definitions of elements of game number eleven used in this rule are to be considered generic terms used solely for the purpose of this rule. In actual operation, game number eleven and these elements may be given names or titles chosen by the commission.
