3770:1-9-109 Game number one hundred nine.

(A) Title and term. Ohio lottery commission game number one hundred nine “Picture Frame Bingo” shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, “sales cycle” shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number one hundred nine.

(B) General design.

(1) Game number one hundred nine is an instant lottery game within which are contained four separate games referred to as “card 1,” “card 2,” “card 3” and “card 4” on the ticket. To win a prize award(s), the player is required to scratch off the covering over the “caller’s card” to reveal twenty-five bingo numbers, plus “five bonus numbers” for a total of thirty bingo numbers. The player then scratches off the overlay for all corresponding numbers contained on cards 1 through 4 on each ticket. Prizes may be won if the matched numbers revealed on any one “card” form the following: A complete horizontal or vertical line of five matched spaces or four matched spaces and the “free” space in the middle; a diagonal line of four matched spaces and the “free” space in the middle; matching numbers in all four corners; two complete diagonal lines forming an “X” including eight matched numbers and the “free” space; a “small picture frame” (or square) consisting of two horizontal lines and two vertical lines containing a total of eight matched numbers surrounding the “free” space; and a “large picture frame” (or square) consisting of two complete horizontal lines and two vertical lines containing a total of sixteen matched spaces. The prizes available are printed beside each “card.” A player may win up to four times on one ticket but may win only once per “card.”

(2) As used in this rule, “prize value” shall mean one of the following monetary figures as they appear in each separate card:

(a) “Card 1” ? three dollars, twenty dollars, fifty dollars and one hundred dollars;

(b) “Card 2” ? five dollars, fifty dollars, one hundred dollars and one thousand dollars;

(c) “Card 3” ? ten dollars, seventy-five dollars, one thousand dollars and two thousand five hundred dollars; and

(d) “Card 4” ? fifteen dollars, one hundred dollars, one thousand five hundred dollars and twenty thousand dollars.

(3) Each separate “card,” 1 through 4, in instant game number one hundred nine shall be imprinted in such a way that prize awards from the sets listed above may be won.

(C) Price of tickets. The price of a ticket issued by the commission in game number one hundred nine shall be three dollars.

(D) Structure, nature and value of prize awards.

(1) There shall be one type of prize in game number one hundred nine called a “regular prize award.” A single ticket may generate no more than four prize awards. The sum of all prize awards on a ticket constitutes a regular prize.

(2) As used in this rule, the only “prize awards” that can be won in game number one hundred nine are: Three dollars, five dollars, eight dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, thirty dollars, thirty-five dollars, fifty dollars, seventy-five dollars, one hundred dollars, one thousand dollars, one thousand five hundred dollars, two thousand five hundred dollars and twenty thousand dollars. Each separate “card,” 1 through 4, in instant game number one hundred nine shall be imprinted in such a way that prize awards from the set listed above may be won.

(3) Prize awards shall be distributed in games (cards) 1 through 4 as follows:

(a) Holder of a valid winning ticket winning three dollars on a horizontal, vertical or diagonal line in “card 1” shall win a regular prize award of three dollars;

(b) Holder of a valid winning ticket winning five dollars on a horizontal, vertical or diagonal line in “card 2” shall win a regular prize award of five dollars;

(c) Holder of a valid winning ticket winning three dollars on a horizontal, vertical or diagonal line in “card 1,” and five dollars on a horizontal, vertical or diagonal line in “card 2” shall win a regular prize award of eight dollars;

(d) Holder of a valid winning ticket winning ten dollars on a horizontal, vertical or diagonal line in “card 3” shall win a regular prize award of ten dollars;

(e) Holder of a valid winning ticket winning fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of fifteen dollars;

(f) Holder of a valid winning ticket winning five dollars on a horizontal, vertical or diagonal line in “card 2,” and ten dollars on a horizontal, vertical or diagonal line in “card 3” shall win a regular prize award of fifteen dollars;

(g) Holder of a valid winning ticket winning twenty dollars on four corners in “card 1” shall win a regular prize award of twenty dollars;

(h) Holder of a valid winning ticket winning five dollars on a horizontal, vertical or diagonal line in “card 2,” and fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of twenty dollars;

(i) Holder of a valid winning ticket winning ten dollars on a horizontal, vertical or diagonal line in “card 3,” and fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of twenty-five dollars;

(j) Holder of a valid winning ticket winning twenty dollars on four corners in “card 1,” and five dollars on a horizontal, vertical or diagonal line in “card 2” shall win a regular prize award of twenty-five dollars;

(k) Holder of a valid winning ticket winning twenty dollars on four corners in “card 1,” and ten dollars on a horizontal, vertical or diagonal line in “card 3” shall win a regular prize award of thirty dollars;

(l) Holder of a valid winning ticket winning twenty dollars on four corners in “card 1,” and fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of thirty-five dollars;

(m) Holder of a valid winning ticket winning twenty dollars on four corners in “card 1,” five dollars on a horizontal, vertical, or diagonal line in “card 2,” ten dollars on a horizontal, vertical or diagonal line in “card 3” and fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of fifty dollars;

(n) Holder of a valid winning ticket winning fifty dollars on an “X” in “card 1” shall win a regular prize award of fifty dollars;

(o) Holder of a valid winning ticket winning fifty dollars on four corners in “card 2” shall win a regular prize award of fifty dollars;

(p) Holder of a valid winning ticket winning fifty dollars on four corners in “card 2,” ten dollars on a horizontal, vertical or diagonal line in “card 3” and fifteen dollars on a horizontal, vertical or diagonal line in “card 4” shall win a regular prize award of seventy-five dollars;

(q) Holder of a valid winning ticket winning seventy-five dollars on four corners in “card 3” shall win a regular prize award of seventy-five dollars;

(r) Holder of a valid winning ticket winning one hundred dollars on four corners in “card 4” shall win a regular prize award of one hundred dollars;

(s) Holder of a valid winning ticket winning one hundred dollars on an “X” in “card 2” shall win a regular prize award of one hundred dollars;

(t) Holder of a valid winning ticket winning one hundred dollars on a “small picture frame” consisting of a square containing two horizontal lines and two vertical lines of eight matched numbers surrounding the “free space” in “card 1” shall win a regular prize award of one hundred dollars;

(u) Holder of a valid winning ticket winning one thousand dollars on an “X” in “card 3” shall win a regular prize award of one thousand dollars;

(v) Holder of a valid winning ticket winning one thousand dollars on a “small picture frame” consisting of a square containing two horizontal lines and two vertical lines of eight matched numbers surrounding the “free space” in “card 2” shall win a regular prize award of one thousand dollars;

(w) Holder of a valid winning ticket winning one thousand five hundred dollars on an “X” in “card 4” shall win a regular prize award of one thousand five hundred dollars;

(x) Holder of a valid winning ticket winning two thousand five hundred dollars on a “large picture frame” consisting of a square containing two complete horizontal lines of ten matched spaces and two complete vertical lines of sixteen matched spaces in “card 3” shall win a regular prize award of two thousand five hundred dollars; and

(y) Holder of a valid winning ticket winning twenty thousand dollars on a large frame consisting of two complete horizontal lines of ten matched spaces and two complete vertical lines of ten matched spaces in “card 4” shall win a regular prize award of twenty thousand dollars.

(E) Number of prize awards. The number of prize awards in any sales cycle of game number one hundred nine will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:

(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

(2) Mathematical reasoning indicates that the number of winning tickets sold per ten million tickets in the following prize categories will be as follows:

(a) Five tickets winning twenty thousand dollars in “card 4” to win twenty thousand dollars;

(b) Six tickets winning two thousand five hundred dollars in “card 3” to win two thousand five hundred dollars;

(c) Seven tickets winning one thousand five hundred dollars in “card 4” to win one thousand five hundred dollars;

(d) Five tickets winning one thousand dollars in “card 2” to win one thousand dollars; and

(e) Five tickets winning one thousand dollars in “card 3” to win one thousand dollars.

(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold will be as follows:

(a) Sixty-two tickets winning one hundred dollars in “card 1” to win one hundred dollars;

(b) Fifteen tickets winning one hundred dollars in “card 2” to win one hundred dollars;

(c) Fifteen tickets winning one hundred dollars in “card 4” to win one hundred dollars;

(d) Twenty tickets winning seventy-five dollars in “card 3” to win seventy-five dollars;

(e) Twenty tickets winning fifty dollars in “card 2,” ten dollars in “card 3” and fifteen dollars in “card 4” to win seventy-five dollars;

(f) Four hundred tickets winning fifty dollars in “card 2” to win fifty dollars;

(g) Four hundred tickets winning fifty dollars in “card 1” to win fifty dollars;

(h) Four hundred seventy tickets winning twenty dollars in “card 1,” five dollars in “card 2,” ten dollars in “card 3” and fifteen dollars in “card 4” to win fifty dollars;

(i) Five hundred tickets winning twenty dollars in “card 1” and fifteen dollars in “card 4” to win thirty-five dollars;

(j) Five hundred tickets winning twenty dollars in “card 1” and ten dollars in “card 3” to win thirty dollars;

(k) Seven hundred ninety-eight tickets winning twenty dollars in “card 1” and five dollars in “card 2” to win twenty-five dollars;

(1) Eight hundred tickets winning ten dollars in “card 3” and fifteen dollars in “card 4” to win twenty-five dollars;

(m) Three thousand tickets winning five dollars in “card 2” and fifteen dollars in “card 4” to win twenty dollars;

(n) Two thousand tickets winning twenty dollars in “card 1” to win twenty dollars;

(o) Three thousand five hundred tickets winning five dollars in “card 2” and ten dollars in “card 3” to win fifteen dollars;

(p) One thousand five hundred tickets winning fifteen dollars in “card 4” to win fifteen dollars;

(q) Eleven thousand five hundred tickets winning ten dollars in “card 3” to win ten dollars;

(r) Eighteen thousand five hundred tickets winning three dollars in “card 1” and five dollars in “card 2” to win eight dollars;

(s) Thirty-three thousand five hundred tickets winning five dollars in “card 2” to win five dollars; and

(t) Sixty-six thousand five hundred tickets winning three dollars in “card 1” to win three dollars.

(F) Frequency of prize drawings.

(1) Random imprinting of prize awards on all tickets issued in game number one hundred nine shall be accomplished in a manner which complies with the commission’s rules and procedures.

(2) When a ticket issued in game number one hundred nine is sold or deemed sold in accordance with this rule and the covering material over any of the numbers has been removed, the holder shall be deemed to have drawn the number on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number one hundred nine in which the ticket was sold.

(G) Special claim, entry. Receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(H) Validity of tickets.

(1) A mechanical error in printing prize awards, symbols, words of other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not mechanically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price, or a replacement ticket of equal price.

(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission’s rules, the director may declare a ticket in game number one hundred nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission’s liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of equal price.

(I) Director’s conduct of game number one hundred nine.

(1) The director shall conduct game number one hundred nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number one hundred nine.

(2) Names and definitions of elements of game number one hundred nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number one hundred nine and these elements may be given names or titles chosen by the commission.
