(A) Title and term. Ohio lottery commission game number one hundred fifteen, “Best of 7’s II,” shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, “sales cycle” shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number one hundred fifteen.
(B) General design.
(1) Game number one hundred fifteen is a key number match game with a “tripler” feature and an additional “bonus” feature, generally known as an “instant lottery.”
(2) As used in this rule, “prize award” shall mean one of the following monetary amounts which is the sum of all winning prize values appearing on the ticket: Seven dollars, fourteen dollars, twenty-eight dollars, seventy-seven dollars, two hundred seven dollars, four hundred fourteen dollars, one thousand seven dollars, seven thousand dollars, seventy thousand dollars, and seven hundred seventy-seven thousand dollars. Each ticket in game number one hundred fifteen shall be imprinted in such a way that prize awards from the set listed above may be won.
(3) Holders of valid tickets will remove the covering off the entire play area to reveal two “7’s numbers,” ten “your numbers,” ten prize amounts and a “fast $77” bonus area. If the player matches any one or more of “your numbers” to either of the “7’s numbers,” the player wins the corresponding prize amount shown below the matched “your numbers.” If the player reveals a “777” symbol in any of the “your numbers” play spots, the player wins triple the corresponding prize amount shown below that number automatically. Also, if the player reveals the number “7” in the “fast $77” bonus area, the player wins seventy-seven dollars automatically. Including the “fast 77,” there are eleven chances to win on each ticket, but players may win only up to ten times on each ticket.
(C) Price of tickets. The price of a ticket issued by the commission in game number one hundred fifteen shall be seven dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game number one hundred fifteen called a “regular prize award.”
(2) The only “prize values” which shall appear on a ticket in game number one hundred fifteen are: One dollar, two dollars, five dollars, seven dollars, fourteen dollars, twenty-eight dollars, fifty dollars, seventy-seven dollars, one hundred dollars, one thousand dollars, seven thousand dollars, seventy thousand dollars and seven hundred seventy-seven thousand dollars. Prize values shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize amounts.
(a) Holder of a valid winning ticket on which seven dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of seven dollars;
(b) Holder of a valid winning ticket on which one dollar appears seven times below “your numbers” which match the “7’s numbers” shall win a regular prize award of seven dollars;
(c) Holder of a valid winning ticket on which five dollars appears once and two dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of seven dollars;
(d) Holder of a valid winning ticket on which the “777” symbol is revealed once for two dollars tripled, and on which one dollar appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of seven dollars;
(e) Holder of a valid winning ticket on which fourteen dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of fourteen dollars;
(f) Holder of a valid winning ticket on which five dollars appears once, two dollars appears four times and one dollar appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of fourteen dollars;
(g) Holder of a valid winning ticket on which the “777” symbol is revealed two times for two dollars tripled two times, and on which two dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of fourteen dollars;
(h) Holder of a valid winning ticket on which one dollar appears seven times and seven dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of fourteen dollars;
(i) Holder of a valid winning ticket on which twenty-eight dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of twenty-eight dollars;
(j) Holder of a valid winning ticket on which the “777” symbol is revealed once for seven dollars tripled, and on which two dollars appears three times and one dollar appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of twenty-eight dollars;
(k) Holder of a valid winning ticket on which fourteen dollars appears two times below “your numbers” which match the “7’s numbers” shall win a regular prize award of twenty-eight dollars;
(l) Holder of a valid winning ticket on which seven dollars appears four times below “your numbers” which match the “7’s numbers” shall win a regular prize award of twenty-eight dollars;
(m) Holder of a valid winning ticket on which the number “7” is revealed in the “fast $77” bonus area for seventy-seven dollars shall win a regular prize award of seventy-seven dollars;
(n) Holder of a valid winning ticket on which one hundred dollars appears two times and seven dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of two hundred seven dollars;
(o) Holder of a valid winning ticket on which twenty-eight dollars appears seven times, seven dollars appears once and two dollars appears two times below “your numbers” which match the “7’s numbers” shall win a regular prize award of two hundred seven dollars;
(p) Holder of a valid winning ticket on which one hundred dollars appears two times, fifty dollars appears four times and fourteen dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of four hundred fourteen dollars;
(q) Holder of a valid winning ticket on which the “777” symbol is revealed once for fifty dollars tripled, and on which one hundred dollars appears two times, seven dollars appears two times and fifty dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of four hundred fourteen dollars;
(r) Holder of a valid winning ticket on which the “777” symbol is revealed three times for one hundred dollars tripled three times, and on which one hundred dollars appears once and seven dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of one thousand seven dollars;
(s) Holder of a valid winning ticket on which the “777” symbol is revealed two times for fifty dollars tripled two times, and on which one hundred dollars appears seven times and seven dollars appears once below “your numbers” which match the “7’s numbers” shall win a regular prize award of one thousand seven dollars;
(t) Holder of a valid winning ticket on which one thousand dollars appears seven times below “your numbers” which match the “7’s numbers” shall win a regular prize award of seven thousand dollars;
(u) Holder of a valid winning ticket on which the “777” symbol is revealed four times for one thousand dollars tripled once and one hundred dollars tripled three times, and on which one thousand dollars appears three times and fifty dollars appears two times below “your numbers” which match the “7’s numbers” shall win a regular prize award of seven thousand dollars;
(v) Holder of a valid winning ticket on which seventy thousand dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of seventy thousand dollars;
(w) Holder of a valid winning ticket on which the “777” symbol is revealed three times for seven thousand dollars tripled three times, and on which seven thousand dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of seventy thousand dollars; and
(x) Holder of a valid winning ticket on which seven hundred seventy-seven thousand dollars appears once below one of “your numbers” which matches one of the “7’s numbers” shall win a regular prize award of seven hundred seventy-seven thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game number one hundred fifteen will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets sold per five million tickets sold will be as follows:
(a) Two tickets matching for seven hundred seventy-seven thousand dollars once to win seven hundred seventy-seven thousand dollars;
(b) Two tickets revealing the “777” symbol for seven thousand dollars tripled three times, and matching for seven thousand once dollars once to win seventy thousand dollars;
(c) Two tickets matching for seventy thousand dollars once to win seventy thousand dollars;
(d) Four tickets revealing the “777” symbol four times for one thousand dollars tripled once and one hundred dollars tripled three times, and matching for one thousand dollars three times and fifty dollars two times to win seven thousand dollars; and
(e) Four tickets matching for one thousand dollars seven times to win seven thousand dollars.
(3) Mathematical reasoning indicates that, over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold will be as follows:
(a) One ticket revealing the “777” symbol two times for fifty dollars tripled two times, and matching for one hundred dollars seven times and seven dollars once to win one thousand seven dollars;
(b) One ticket revealing the “777” symbol three times for one hundred dollars tripled three times, and matching for one hundred dollars once and seven dollars once to win one thousand seven dollars;
(c) Three tickets revealing the “777” symbol once for fifty dollars tripled, and matching for one hundred dollars two times, seven dollars two times and fifty dollars once to win four hundred fourteen dollars;
(d) Three tickets matching for one hundred two times, fifty dollars four times and fourteen dollars once to win four hundred fourteen dollars;
(e) Five tickets matching twenty-eight dollars seven times, seven dollars once and two dollars two times to win two hundred seven dollars;
(f) Five tickets matching for one hundred dollars two times and seven dollars once to win two hundred seven dollars;
(g) Five thousand one hundred fifty tickets revealing the number “7” in the “fast $77” bonus area to win seventy-seven dollars;
(h) Two thousand five hundred tickets matching for seven dollars four times to win twenty-eight dollars;
(i) Two thousand five hundred tickets matching for fourteen dollars two times to win twenty-eight dollars;
(j) Two thousand five hundred ticket revealing the “777” symbol once for seven dollars tripled, and matching for two dollars three times and one dollar once to win twenty-eight dollars;
(k) Two thousand six hundred tickets matching twenty-eight dollars once to win twenty-eight dollars;
(l) Ten thousand tickets matching for one dollar seven times and seven dollars once to win fourteen dollars;
(m) Ten thousand tickets revealing the “777” symbol two times for two dollars tripled two times, and matching for two dollars once to win fourteen dollars;
(n) Eight thousand seven hundred fifty tickets matching for five dollars once, two dollars four times and one dollar once to win fourteen dollars;
(o) Sixteen thousand two hundred fifty tickets matching for fourteen dollars once to win fourteen dollars;
(p) Thirty thousand tickets revealing the “777” symbol once for two dollars tripled, and matching for one dollar once to win seven dollars;
(q) Thirty-one thousand two hundred fifty tickets matching for five dollars once and two dollars once to win seven dollars;
(r) Thirty thousand tickets matching for one dollar seven times to win seven dollars; and
(s) Thirty-three thousand seven hundred fifty tickets matching for seven dollars once to win seven dollars.
(F) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game number one hundred fifteen shall be accomplished in a manner which complies with the commission’s rules and procedures.
(2) When a ticket issued in game number one hundred fifteen is sold or deemed sold in accordance with this rule and the covering material over any of the numbers has been removed, the holder shall be deemed to have drawn the numbers on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number one hundred fifteen in which the ticket was sold.
(G) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(H) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price, or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director for the commission’s rules, the director may declare a ticket in game number one hundred fifteen void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission’s liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(I) Director’s conduct of game number one hundred fifteen.
(1) The director shall conduct game number one hundred fifteen in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number one hundred fifteen.
(2) Names and definitions of elements of game number one hundred fifteen used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number one hundred fifteen and these elements may be given names or titles chosen by the commission.
