(A) Title and term. Ohio lottery commission game number one hundred twenty-five, “Ultimate Instant III,” shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, “sales cycle” shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number one hundred twenty-five.
(B) General design.
(1) Game number one hundred twenty-five is an instant lottery game within which are contained three separate games.
(a) “Game 1” is a key number match game with an additional feature. The player removes the covering over the play area to reveal five “winning numbers,” ten “your numbers” and ten corresponding prize values. If any one or more of “your numbers” matches any of the “winning numbers,” the player wins the prize amount shown below the matching “your numbers.” If the “ultimate” symbol is revealed in any of the “your numbers” play spots, the player wins the prize value shown below that symbol automatically.
(b) “Game 2” (“Fast $10”) is a symbol match game. The player must match two like symbols to win ten dollars. Play symbols shall include: “horseshoe,” “moneybags,” “stars,” “gold bars,” “treasure chests,” “clovers,” “cash” and “sevens.”
(c) “Game 3” (“Quick $25”) is a symbol match game. The player must match two like symbols to win twenty-five dollars. Play symbols shall include: “horseshoes,” “moneybags,” “stars,” “gold bars,” “treasure chests,” “clovers,” “cash” and “sevens.”
(2) As used in this rule, “prize award” shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: three dollars, six dollars, nine dollars, ten dollars, twelve dollars, twenty-four dollars, twenty-five dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, ten thousand dollars and sixty thousand dollars. Each ticket in game number one hundred twenty-five shall be imprinted in such a way that prize awards from the set listed above may be won.
(C) Price of tickets. The price of a ticket issued by the commission in game number one hundred twenty-five shall be three dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game number one hundred twenty-five called a “regular prize award.”
(2) The only “prize values” which shall appear on a ticket in game number one hundred twenty-five are those listed as follows:
(a) “Game 1” ? one dollar, three dollars, six dollars, nine dollars, twelve dollars, twenty-four dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars and ten thousand dollars;
(b) “Game 2” ? ten dollars; and
(c) “Game 3” ? twenty-five dollars.
(3) Prize values appearing on any ticket in game number one hundred twenty-five shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values.
(a) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars once in “game 1” shall win a regular prize award of three dollars;
(b) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one dollar three times in “game 1” shall win a regular prize award of three dollars;
(c) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for six dollars once in “game 1” shall win a regular prize award of six dollars;
(d) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars two times in “game 1” shall win a regular prize award of six dollars;
(e) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one dollar six times in “game 1” shall win a regular prize award of six dollars;
(f) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for nine dollars once in “game 1” shall win a regular prize award of nine dollars;
(g) Holder of a regular valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars three times in “game 1” shall win a regular prize award of nine dollars;
(h) Holder of a regular valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one dollar six times and three dollars once in “game 1” shall win a regular prize award of nine dollars;
(i) Holder of a valid winning ticket matching two like symbols for ten dollars in “game 2” shall win a regular prize award of ten dollars;
(j) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars once in “game 1” shall win a regular prize award of twelve dollars;
(k) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars once and one dollar nine times in “game 1” shall win a regular prize award of twelve dollars;
(l) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars four times in “game 1” shall win a regular prize award of twelve dollars;
(m) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for six dollars once, three dollars once and one dollar three times in “game 1” shall win a regular prize award of twelve dollars;
(n) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twenty-four dollars once in “game 1” shall win a regular prize award of twenty-four dollars;
(o) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars once, six dollars once and three dollars two times in “game 1” shall win a regular prize award of twenty-four dollars;
(p) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for nine dollars once, three dollars once and one dollar two times in “game 1,” and matching two like symbols for ten dollars in “game 2” shall win a regular prize award of twenty-four dollars;
(q) Holder of a valid winning ticket matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of twenty-five dollars;
(r) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for fifty dollars once in “game 1” shall win a regular prize award of fifty dollars;
(s) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for three dollars three times and six dollars once in “game 1,” matching two like symbols for ten dollars in “game 2” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of fifty dollars;
(t) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one dollar nine times and six dollars once in “game 1,” matching two like symbols for ten dollars in “game 2” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars once, nine dollars two times, six dollars once, three dollars four times and one dollar two times in “game 1” shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one hundred dollars once in “game 1” shall win a regular prize award of one hundred dollars;
(w) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for nine dollars three times, twelve dollars two times, six dollars once, three dollars two times and one dollar two times in “game 1,” matching two like symbols for ten dollars in “game 2” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of one hundred dollars;
(x) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars three times, six dollars six times and three dollars once in “game 1,” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of one hundred dollars;
(y) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twenty-four dollars two times, nine dollars five times, three dollars two times and one dollar once in “game 1” shall win a regular prize award of one hundred dollars;
(z) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars five times, nine dollars once and six dollars once in “game 1,” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of one hundred dollars;
(aa) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for twelve dollars four times, twenty-four dollars once and one dollar three times in “game 1” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for five hundred dollars once in “game 1” shall win a regular prize award of five hundred dollars;
(cc) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one hundred dollars five times in “game 1” shall win a regular prize award of five hundred dollars;
(dd) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one hundred dollars once, fifty dollars seven times, nine dollars once and six dollars once in “game 1,” matching two like symbols for ten dollars in “game 2” and matching two like symbols for twenty-five dollars in “game 3” shall win a regular prize award of five hundred dollars;
(ee) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one thousand dollars once in “game 1” shall win a regular prize award of one thousand dollars;
(ff) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for five hundred dollars two times in “game 1” shall win a regular prize award of one thousand dollars;
(gg) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for five hundred dollars once, one hundred dollars two times and fifty dollars six times in “game 1” shall win a regular prize award of one thousand dollars;
(hh) Holder of a valid winning ticket matching one of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for ten thousand dollars once in “game 1” shall win a regular prize award of ten thousand dollars;
(ii) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for one thousand dollars ten times in “game 1” shall win a regular prize award of ten thousand dollars; and
(jj) Holder of a valid winning ticket matching any one or more of “your numbers” to any of the “winning numbers” or revealing the “ultimate” symbol for ten thousand dollars six times in “game 1” shall win a regular prize award of sixty thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game number one hundred twenty-five will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per five million tickets sold in the following prize categories will be as follows:
(a) Two tickets winning ten thousand dollars six times in “game 1” to win sixty thousand dollars;
(b) Three tickets winning one thousand dollars ten times in “game 1” to win ten thousand dollars;
(c) Three tickets winning ten thousand dollars once in “game 1” to win ten thousand dollars;
(d) Three tickets winning five hundred dollars once, one hundred dollars two times and fifty dollars six times in “game 1” to win one thousand dollars;
(e) Three tickets winning five hundred dollars two times in “game 1” to win one thousand dollars;
(f) Three tickets winning one thousand dollars once in “game 1” to win one thousand dollars;
(g) Five tickets winning one hundred dollars once, fifty dollars seven times, nine dollars once and six dollars once in “game 1,” ten dollars in “game 2” and twenty-five dollars in “game 3” to win five hundred dollars;
(h) Five tickets winning one hundred dollars five times in “game 1” to win five hundred dollars; and
(i) Five tickets winning five hundred dollars once in “game 1” to win five hundred dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five hundred thousand tickets sold will be as follows:
(a) Three tickets winning twelve dollars four times, twenty-four dollars once and one dollar three times in “game 1,” and twenty-five dollars in “game 3” to win one hundred dollars;
(b) Three tickets winning twelve dollars five times, nine dollars once and six dollars once in “game 1” to win one hundred dollars;
(c) Three tickets winning twenty-four dollars two times, nine dollars five times, three dollars two times and one dollar once in “game 1” to win one hundred dollars;
(d) Three tickets winning twelve dollars three times, six dollars six times and three dollars once in “game 1,” and twenty-five dollars in “game 2” to win one hundred dollars;
(e) Three tickets winning nine dollars three times, twelve dollars two times, six dollars once, three dollars two times and one dollar two times in “game 1,” ten dollars in “game 2” and twenty-five dollars in “game 3” to win one hundred dollars;
(f) Three tickets winning one hundred dollars once in “game 1” to win one hundred dollars;
(g) Five hundred fifty tickets winning twelve dollars once, nine dollars two times, six dollars once, three dollars four times and one dollar two times in “game 1” to win fifty dollars;
(h) Five hundred seventy-five tickets winning one dollar nine times and six dollars once in “game 1,” ten dollars in “game 2” and twenty-five dollars in “game 3” to win fifty dollars;
(i) Eight hundred tickets winning three dollars three times and six dollars once in “game 1,” ten dollars in “game 2” and twenty-five dollars in “game 3” to win fifty dollars;
(j) Six hundred tickets winning fifty dollars once in “game 1” to win fifty dollars;
(k) Two thousand two hundred fifty tickets winning twenty-five dollars in “game 3” to win twenty-five dollars;
(l) One thousand six hundred fifty tickets winning nine dollars once, three dollars once and one dollar two times in “game 1,” and ten dollars in “game 2” to win twenty-four dollars;
(m) One thousand seven hundred tickets winning twelve dollars once, six dollars once and three dollars two times in “game 1” to win twenty-four dollars;
(n) One thousand seven hundred tickets winning twenty-four dollars once in “game 1” to win twenty-four dollars;
(o) One thousand two hundred fifty tickets winning six dollars once, three dollars once and one dollar three times in “game 1” to win twelve dollars;
(p) One thousand two hundred fifty tickets winning three dollars four times in “game 1” to win twelve dollars;
(q) One thousand two hundred fifty tickets winning three dollars once and one dollar nine times in “game 1” to win twelve dollars;
(r) One thousand two hundred fifty tickets winning twelve dollars once in “game 1” to win twelve dollars;
(s) Five thousand tickets winning ten dollars in “game 2” to win ten dollars;
(t) Five thousand tickets winning one dollar six times and three dollars once in “game 1” to win nine dollars;
(u) Three thousand seven hundred fifty tickets winning three dollars three times in “game 1” to win nine dollars;
(v) Five thousand tickets winning nine dollars once in “game 1” to win nine dollars;
(w) Eight thousand seven hundred fifty tickets winning one dollar six times in “game 1” to win six dollars;
(x) Eight thousand seven hundred fifty tickets winning three dollars two times in “game 1” to win six dollars;
(y) Ten thousand tickets winning six dollars once in “game 1” to win six dollars;
(z) Thirty-two thousand five hundred tickets winning one dollar three times in “game 1” to win three dollars; and
(aa) Forty-one thousand two hundred fifty tickets winning three dollars once in “game 1” to win three dollars.
(F) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game number forty-two shall be accomplished in a manner, which complies with the commission’s rules and procedures.
(2) When a ticket issued in game number one hundred twenty-five is sold or deemed sold in accordance with this rule and the covering material over any of the numbers has been removed, the holder shall be deemed to have drawn the numbers on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number one hundred twenty-five in which the ticket was sold.
(G) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prize awards which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(H) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission’s rules, the director may declare a ticket in game number one hundred twenty-five void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission’s liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(I) Director’s conduct of game number one hundred twenty-five.
(1) The director shall conduct game number one hundred twenty-five in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number one hundred twenty-five.
(2) Names and definitions of elements of game number one hundred twenty-five used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number one hundred twenty-five and these elements may be given names or titles chosen by the commission.
