(A) Title and term. Ohio lottery commission game number one hundred twenty-nine, “Lucky Times Ten,” shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, “sales cycle” shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game number one hundred twenty-nine.
(B) General design.
(1) Game number one hundred twenty-nine is a number match game with an instant win feature, generally known as an “instant lottery.”
(2) As used in this rule, “prize award” shall mean one of the following monetary figures which is either the total of all winning prize values appearing on the ticket or the total of all winning “prize values” multiplied by the factor revealed in the “bonus area:” five dollars, ten dollars, twenty dollars, thirty-five dollars, fifty dollars, seventy-five dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars and five hundred thousand dollars. Each ticket in game number one hundred twenty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.
(3) Holders of valid winning tickets shall scratch the covering to reveal three “winning numbers,” ten “your lucky numbers” and ten corresponding prize values. If the holder matches any one or more of “your lucky numbers” to the “winning numbers,” the holder wins the corresponding prize value shown below the matching “your lucky number(s).” The player then scratches the “bonus area” on the ticket to reveal either “no bonus this time” or one of the following factors: 2, 3, 4, 5, 7 or 10. If a numeric factor is revealed, the holder’s total prize award shall be the sum of all winning prize values on the ticket multiplied by the factor in the “bonus area.” If a numeric factor is not revealed as indicated by “no bonus this time,” the holder’s total prize award shall be the sum of all winning prize values. There are ten chances to win on each ticket.
(C) Price of tickets. The price of a ticket issued by the commission in game number one hundred twenty-nine shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize award in game number one hundred twenty-nine called a “regular prize award.”
(2) The only “prize values” which shall appear on a ticket in game number one hundred twenty-nine are: one dollar, two dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, ten thousand dollars and fifty thousand dollars. Prize values shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values.
(a) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five dollars once and “no bonus this time” is revealed shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which one of “your lucky numbers; matches one of the “winning numbers” for one dollar once and a “bonus” factor of “5” is revealed shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar five times and “no bonus this time” is revealed shall win a regular prize award of five dollars;
(d) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for ten dollars once and “no bonus this time” is revealed shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for one dollar once and a “bonus” factor of “10” is revealed shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar five times and one of the “bonus” factor of “2” is revealed shall win a regular prize award of ten dollars;
(h) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for twenty dollars once and “no bonus this time” is revealed shall win a regular prize award of twenty dollars;
(i) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for ten dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of twenty dollars;
(j) Holder of a valid winning ticket on which “your lucky numbers” match any one or two of the “winning numbers” for five dollars two times and a “bonus” factor of “2” is revealed shall win a regular prize award of twenty dollars;
(k) Holder of a valid winning ticket on which “your lucky numbers” match any one or two of the “winning numbers” for ten dollars two times and “no bonus this time” is revealed shall win a regular prize award of twenty dollars;
(l) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar five times and five dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of twenty dollars;
(m) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five dollars once and a “bonus” factor of “4” is revealed shall win a regular prize award of twenty dollars;
(n) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar four times and a “bonus” factor of “5” is revealed shall win a regular prize award of twenty dollars;
(o) Holder of a valid winning ticket on which “your lucky numbers” match any one or two of the “winning numbers” for one dollar two times and a “bonus” factor of “10” is revealed shall win a regular prize award of twenty dollars;
(p) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar five times and a “bonus” factor of “7” is revealed shall win a regular prize award of thirty-five dollars;
(q) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for fifty dollars once and “no bonus this time” is revealed shall win a regular prize award of fifty dollars;
(r) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for ten dollars once and a “bonus” factor of “5” is revealed shall win a regular prize award of fifty dollars;
(s) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five dollars once and a “bonus” factor of “10” is revealed shall win a regular prize award of fifty dollars;
(t) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for five dollars once and one dollar five times and a “bonus” factor of “5” is revealed shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars two times and five dollars six times and “no bonus this time” is revealed shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for five dollars ten times and “no bonus this time” is revealed shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for two dollars five times and a “bonus” factor of “5” is revealed shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars two times and five dollars once and a “bonus” factor of “3” is revealed shall win a regular prize award of seventy-five dollars;
(y) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for twenty dollars two times, ten dollars three times and five dollars once and “no bonus this time” is revealed shall win a regular prize award of seventy-five dollars;
(z) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for fifty dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of one hundred dollars;
(aa) Holder of a valid winning ticket on which “your lucky numbers” match any one or two of the “winning numbers” for ten dollars two times and a “bonus” factor of “5” is revealed shall win a regular prize award of one hundred dollars;
(bb) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for twenty dollars five times and “no bonus this time” is revealed shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for five dollars once and one dollar five times and a “bonus” factor of “10” is revealed shall win a regular prize award of one hundred dollars;
(dd) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one dollar ten times and a “bonus” factor of “10” is revealed shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for two dollars ten times and a “bonus” factor of “5” is revealed shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars five times and a “bonus” factor of “2” is revealed shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars ten times and “no bonus this time” is revealed shall win a regular prize award of one hundred dollars;
(hh) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for fifty dollars once and a “bonus” factor of “10” is revealed shall win a regular prize award of five hundred dollars;
(ii) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for fifty dollars three times and twenty dollars five times and a “bonus” factor of “2” is revealed shall win a regular prize award of five hundred dollars;
(jj) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one hundred dollars five times and “no bonus this time” is revealed shall win a regular prize award of five hundred dollars;
(kk) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five hundred dollars once and “no bonus this time” is revealed shall win a regular prize award of five hundred dollars;
(ll) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for five dollars ten times and a “bonus” factor of “10” is revealed shall win a regular prize award of five hundred dollars;
(mm) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars five times and a “bonus” factor of “10” is revealed shall win a regular prize award of five hundred dollars;
(nn) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars ten times and a “bonus” factor of “5” is revealed shall win a regular prize award of five hundred dollars;
(oo) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five hundred dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of one thousand dollars;
(pp) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for fifty dollars once, twenty dollars two times and ten dollars once and a “bonus” factor of “10” is revealed shall win a regular prize award of one thousand dollars;
(qq) Holder of a valid winning ticket on which “your lucky numbers” match any one or two of the “winning numbers” for one hundred dollars two times and a “bonus” factor of “5” is revealed shall win a regular prize award of one thousand dollars;
(rr) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for one thousand dollars once and “no bonus this time” is revealed shall win a regular prize award of one thousand dollars;
(ss) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten dollars ten times and a “bonus” factor of “10” is revealed shall win a regular prize award of one thousand dollars;
(tt) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one hundred dollars ten times and “no bonus this time” is revealed shall win a regular prize award of one thousand dollars;
(uu) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five hundred dollars once and a “bonus” factor of “10” is revealed shall win a regular prize award of five thousand dollars;
(vv) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one thousand dollars two times and five hundred dollars once and a “bonus” factor of “2” is revealed shall win a regular prize award of five thousand dollars;
(ww) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one thousand dollars five times and “no bonus this time” is revealed shall win a regular prize award of five thousand dollars;
(xx) Holder of a valid winning ticket on which one of “your lucky numbers” matches one of the “winning numbers” for five thousand dollars once and “no bonus this time” is revealed shall win a regular prize award of five thousand dollars;
(yy) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one hundred dollars ten times and a “bonus” factor of “5” is revealed shall win a regular prize award of five thousand dollars;
(zz) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for one hundred dollars five times and a “bonus” factor of “10” is revealed shall win a regular prize award of five thousand dollars;
(aaa) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for ten thousand dollars five times and a “bonus” factor of “10” is revealed shall win a regular prize award of five hundred thousand dollars; and
(bbb) Holder of a valid winning ticket on which “your lucky numbers” match any one or all of the “winning numbers” for fifty thousand dollars ten times and “no bonus this time” is revealed shall win a regular prize award of five hundred thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game number one hundred twenty-nine will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per ten million tickets sold will be as follows:
(a) One ticket matching for fifty thousand dollars ten times with no “bonus” factor to win five hundred thousand dollars;
(b) One ticket matching for ten thousand dollars five times with a “bonus” factor of “10” to win five hundred thousand dollars;
(c) Six tickets matching for one hundred dollars five times with a “bonus” factor of “10” to win five thousand dollars;
(d) Six tickets matching for one hundred dollars ten times with a “bonus” factor of “5” to win five thousand dollars;
(e) Six tickets matching for five thousand dollars once with no “bonus” factor to win five thousand dollars;
(f) Six tickets matching for one thousand dollars five times with no “bonus” factor to win five thousand dollars;
(g) Six tickets matching for one thousand dollars two times and five hundred dollars once with a “bonus” factor of “2” to win five thousand dollars;
(h) Six tickets matching for five hundred dollars once with a “bonus” factor of “10” to win five thousand dollars;
(i) Twenty-five tickets matching for one hundred dollars ten times with no “bonus” factor to win one thousand dollars;
(j) Twenty-five tickets matching for ten dollars ten times with a “bonus” factor of “10” to win one thousand dollars;
(k) Twenty-five tickets matching for one thousand dollars once with no “bonus” factor to win one thousand dollars;
(l) Twenty-five tickets matching for one hundred dollars two times with a “bonus” factor of “5” to win one thousand dollars;
(m) Twenty-five tickets matching for fifty dollars once, twenty dollars two times and ten dollars once with a “bonus” factor of “10” to win one thousand dollars;
(n) Twenty-five tickets matching for five hundred dollars once with a “bonus” factor of “2” to win one thousand dollars;
(o) Fifty tickets matching for ten dollars ten times with a “bonus” factor of “5” to win five hundred dollars;
(p) Fifty tickets matching for ten dollars five times with a “bonus” factor of “10” to win five hundred dollars;
(q) Fifty tickets matching for five dollars ten times with a “bonus” factor of “10” to win five hundred dollars;
(r) Fifty tickets matching for five hundred dollars once with no “bonus” factor to win five hundred dollars;
(s) Fifty tickets matching for one hundred dollars five times with no “bonus” factor to win five hundred dollars;
(t) Fifty tickets matching for fifty dollars three times and twenty dollars five times with a “bonus” factor of “2” to win five hundred dollars; and
(u) Fifty tickets matching for fifty dollars once with a “bonus” factor of “10” to win five hundred dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average winning tickets per five hundred thousand tickets sold will be as follows:
(a) One hundred tickets matching for ten dollars ten times with no “bonus” factor to win one hundred dollars;
(b) One hundred tickets matching for ten dollars five times with a “bonus” factor of “2” to win one hundred dollars;
(c) One hundred tickets matching for two dollars ten times with a “bonus” factor of “5” to win one hundred dollars;
(d) One hundred tickets matching for one dollar ten times with a “bonus” factor of “10” to win one hundred dollars;
(e) One hundred tickets matching for five dollars once and one dollar five times with a “bonus” factor of “10” to win one hundred dollars;
(f) One hundred tickets matching for twenty dollars five times with no “bonus” factor to win one hundred dollars;
(g) One hundred tickets matching for ten dollars two times with a “bonus” factor of “5” to win one hundred dollars;
(h) One hundred tickets matching for fifty dollars once with a “bonus” factor of “2” to win one hundred dollars;

(r) Six thousand five hundred forty-two tickets matching for one dollar five times with a “bonus” factor of “7” to win thirty-five dollars;
(s) Two thousand five hundred tickets matching for one dollar two times with a “bonus” factor of “10” to win twenty dollars;
(t) Two thousand five hundred tickets matching for one dollar four times with a “bonus” factor of “5” to win twenty dollars;
(u) Two thousand five hundred tickets matching for five dollars once with a “bonus” factor of “4” to win twenty dollars;
(v) Two thousand five hundred tickets matching for one dollar five times and five dollars once with a “bonus” factor of “2” to win twenty dollars;
(w) One thousand two hundred fifty tickets matching for ten dollars two times with no “bonus” factor to win twenty dollars;
(x) One thousand two hundred fifty tickets matching for five dollars two times with a “bonus” factor of “2” to win twenty dollars;
(y) Two thousand five hundred tickets matching for ten dollars once with a “bonus” factor of “2” to win twenty dollars;
(z) Six thousand two hundred fifty tickets matching for twenty dollars once with no “bonus” factor to win twenty dollars;
(aa) Eight thousand seven hundred fifty tickets matching for one dollar five times with a “bonus” factor of “2” to win ten dollars;
(bb) Seven thousand five hundred tickets matching for one dollar once with a “bonus” factor of “10” to win ten dollars;
(cc) Six thousand two hundred fifty tickets matching for five dollars once with a “bonus” factor of “2” to win ten dollars;
(dd) Eleven thousand two hundred fifty tickets matching for ten dollars once with no “bonus” factor to win ten dollars;
(ee) Twenty-three thousand seven hundred fifty tickets matching for one dollar five times with no “bonus” factor to win five dollars;
(ff) Twenty-three thousand seven hundred fifty tickets matching for one dollar once with a “bonus” factor of “5” to win five dollars; and
(gg) Twenty thousand tickets matching for five dollars once with no “bonus” factor to win five dollars.
(F) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game number one hundred twenty-nine shall be accomplished in a manner which complies with the commission’s rules and procedures.
(2) When a ticket issued in game number one hundred twenty-nine is sold or deemed sold in accordance with this rule and the covering material over any of the numbers has been removed, the holder shall be deemed to have drawn the numbers on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number one hundred twenty-nine in which the ticket was sold.
(G) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prize awards which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(H) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission’s rules, the director may declare a ticket in game number one hundred twenty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission’s liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(I) Director’s conduct of game number one hundred twenty-nine.
(1) The director shall conduct game number one hundred twenty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number one hundred twenty-nine.
(2) Names and definitions of elements of game number one hundred twenty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number one hundred twenty-nine and these elements may be given names or titles chosen by the commission.
