4501:2-10-13 Participation agreement.

(A) LEADS with terminal agency

I accept responsibility to comply with rules 4501:2-10-01 to 4501:2-10-14 of the Administrative Code governing LEADS. Failure to abide by these rules may result in the termination of LEADS services and/or prosecution when appropriate, as set forth in rule 4501:2-10-11 of the Administrative Code. By endorsing the agreement the administrator agrees to cooperate to:

(1) Investigate alleged violations of LEADS/NCIC/NLETS rules.

(2) Take appropriate administrative or criminal action when applicable and notify the LEADS CSO in writing as soon as possible.

(3) Maintain appropriate service level agreements on any agency owned equipment used as the primary LEADS terminal and to resolve service fees when needed.

(4) Complete the new administrator indoctrination training.

(5) Utilize only standard, LEADS accepted, network communication protocols for systems connected to LEADS. No special code or programming shall be installed on the LEADS network to communicate with an individual agency. The agency equipment shall utilize one of the standard protocols offered by LEADS. If at any time the local equipment is suspected of causing problems on the LEADS network, the local agency shall disconnect their equipment from the LEADS communications lines. The equipment shall remain disconnected until it is determined the problem does not reside in the local agency equipment or the agency equipment has been repaired at the agency expense.

(6) Allow no special programming code which would enable communication to an individual agency to be installed on systems connected to LEADS without prior approval of the chair of the LEADS steering committee.

(7) Remove any local equipment connected to LEADS that is suspected of causing system or network problems.

(C) LEADS/User agency and vendor agreement

The law enforcement automated data system, hereafter known as LEADS, is a communications network oriented toward police and other criminal justice agencies. Vendor personnel do not qualify to receive data through the LEADS network. All testing done by the vendor shall be strictly monitored by criminal justice personnel. Vendor personnel shall not remove any LEADS generated data (whether hardcopy printouts, copies of printouts, handwritten reproductions of data or electronic media copies of data) from the criminal justice agency.

LEADS is a secure network. As such, certain restrictions are placed upon the vendor community who are working with criminal justice agencies.

Dial-up remote access

Any time dial-up or remote access is permitted to the local agency equipment, the physical connection with the LEADS network shall be broken. No dial-up or remote access shall pass through to the LEADS network for any reason.

Vendor testing

Vendor personnel are prohibited from entering data or retrieving data from LEADS other than test data supplied by the criminal justice agency with whom they have contracted. Each record entered for testing shall indicate it is a test record as outlined in the LEADS and NCIC manuals. Contact with LEADS shall supply test operator license and vehicle registration records. All testing shall be done at the site of the criminal justice agency and shall be strictly monitored by LEADS certified criminal justice agency personnel. The vendor shall not be permitted to disclose, in part or in whole, any information concerning LEADS data contained within LEADS, or any data file connected to LEADS to anyone outside their organization.

All vendor testing shall be conducted using the LEADS and NCIC test databases and systems.

LEADS assistance

LEADS will not install special software or hardware in order to communicate with individual vendor equipment. LEADS is not obligated to troubleshoot a vendor’s product but may offer assistance and/or suggestions on the product’s interaction with LEADS. Any contact between vendor representatives and LEADS personnel shall be initiated through the criminal justice agency with whom the vendor has the contract.

Communications line problems

At any time the vendor/local agency equipment is suspected of causing a communications line problem, the equipment shall be disconnected from the LEADS communications line. The equipment shall remain disconnected until it is determined the vendor/local equipment is not the cause of the problem or until the vendor/local equipment is repaired.

The vendor, its personnel or agents are permitted no access to LEADS that is not expressly stated in this document. LEADS assumes no responsibility to make the vendor’s hardware or software operational on the LEADS network nor is LEADS under any obligation to continue to allow the vendor equipment access to the LEADS network either in this or any other criminal justice agency.

This document shall be signed by the vendor representative capable of making the required commitment, the criminal justice agency administrator and the chair of the LEADS steering committee before the vendor equipment shall be approved for access to the LEADS network.
