Chapter 4501:1-11 Replacement of Vehicle Identification

4501:1-11-01 Application for a replacement vehicle identification number (VIN) plate.

(A) Any person who is the owner of a motor vehicle, or any owner's insurer, may apply for a replacement vehicle identification number (VIN) plate or replacement vehicle parts derivative VIN plates or stickers in accordance with the provisions of this rule.

(B) The application shall be made to the registrar of motor vehicles. The application shall be in the form of an affidavit sworn to or affirmed before a notary public or other official authorized to administer oaths and shall contain the following information:

(1) The specific VIN plate or parts derivative VIN required to be replaced;

(2) Whether the VIN was removed, defaced, covered, altered, or destroyed by another person without the consent of the owner, or by accident or other casualty not due to the owner's purpose to conceal or destroy the identity of the vehicle or vehicle part, or by ordinary wear and tear; and

(3) Such other information as the registrar may prescribe.

(C) The application shall be accompanied by a valid Ohio certificate of title or certificate of title or other lawful evidence of title issued in another state, in a clear chain of title beginning with the manufacturer, satisfactory to the registrar. The registrar may require as a part of the application process that the owner obtain an Ohio certificate of title prior to the installation of the replacement VIN plates or stickers.

(D) The applicant shall submit evidence, satisfactory to the registrar, to show that the original identity of the vehicle can be established in a manner that excludes any reasonable probability that the vehicle has been stolen from another person. An official report by a peace officer, trooper of the state highway patrol, or authorized representative of the registrar may be used to satisfy this requirement.

(E) The registrar shall send by regular mail or other appropriate means the Ohio certificate of title or other lawful evidence of ownership approved by the registrar to the appropriate clerk of courts, and shall notify the owner that the title has been sent to the clerk of courts.

4501:1-11-02 Issuance of a replacement vehicle identification number (VIN) plate.

(A) If the registrar determines that the applicant has complied fully with the requirements of rule 4501:1-11-01 of the Administrative Code, a replacement VIN plate or replacement vehicle parts derivative VIN plates, die impressions, or stickers shall be obtained and installed in accordance with this rule.

(B) If it is practical to do so, the registrar shall authorize the use of the original VIN. If it is not practical to authorize the use of the original VIN, the registrar shall assign a new VIN to be used for all purposes in identifying the vehicle and its parts.

(C) If the registrar determines that a duplicate original VIN plate is reasonably available from the original manufacturer of the vehicle, the registrar shall obtain a duplicate original VIN plate to be installed in accordance with this rule.

(D) If the registrar determines that a duplicate original VIN plate is not reasonably available from the original manufacturer of the vehicle, the registrar shall cause an "Ohio replacement VIN" plate to be produced. Said Ohio replacement VIN plate may be produced by the bureau of motor vehicles, the highway patrol, or any other source as prescribed by the registrar. The registrar shall prescribe the size and design of the Ohio replacement VIN plate, which shall be designed to restore the identification of the vehicle in a manner that will deter its theft and facilitate its marketability to the extent that is practical to do so. If it is practical to do so the Ohio replacement VIN plate shall be designed for installation in the manufacturer's original location. The Ohio replacement VIN plate shall contain such security features as the registrar may prescribe.

(E) The registrar shall prescribe a method using dies, plates, stickers, or other suitable means to imprint or attach a replacement derivative VIN on the engine or transmission of the vehicle as may be required.

(F) The registrar shall prescribe a method using plates, stickers, or other suitable means to attach a replacement derivative VIN on any other parts of the vehicle as may be required.

(G) The dies, plates, stickers, or other suitable devices, materials, or equipment required to replace a derivative VIN on any vehicle part shall be obtained by the bureau of motor vehicles or shall be produced by the bureau of motor vehicles or the highway patrol.

(H) The applicant shall pay to the bureau of motor vehicles the actual cost incurred by the bureau of motor vehicles in obtaining or producing the replacement VIN plates, other devices, or materials for the vehicle in question.

(I) The registrar shall send, by regular mail or other appropriate means, a copy of the application for a replacement VIN plate and all plates and other necessary devices, or materials to the Ohio highway patrol vehicle inspection station nearest the applicant's place of residence.

4501:1-11-03 Installation of a replacement vehicle identification number (VIN) plate.

(A) Upon receipt of the copy of the application for a replacement VIN plate, all replacement plates and other necessary devices or materials, the highway patrol inspection station shall set a date and time for the inspection and installation of the replacement VIN plates and other devices. The highway patrol inspection station shall attempt to schedule a date and time which is mutually agreeable to both the owner and the highway patrol. The inspection and the inspection fee shall be in accordance with the provisions of division (E) of section 4505.11 of the Revised Code and shall include inspection of the following:

(1) The federal safety decal number;

(2) The engine and transmission numbers;

(3) Any manufacturer's applied numbers which can be traced by available record to the original VIN;

(4) Any owner's applied number which can be traced to the original owner or VIN;

(5) Any other number determined by the registrar or the highway patrol inspector to be relevant to the inspection.

(B) Upon proper identification of the motor vehicle by the highway patrol inspector, the inspector shall make appropriate arrangements to authorize and supervise the installation of the replacement VIN plate. If a duplicate original VIN plate has been obtained, it shall be installed in accordance with this rule. If a duplicate original VIN plate has not been obtained, an Ohio replacement VIN plate produced by the registrar shall be installed in accordance with this rule.

(C) If it is practical to do so, and if the applicant agrees to bear any additional expenses, the duplicate original or Ohio replacement VIN plate shall be installed in the manufacturer's original location. If it is not practical to do so, or if the applicant declines to bear the additional expenses for installation in the manufacturer's original location, the duplicate original or Ohio replacement VIN plate shall be installed in the following manners:

(1) In passenger cars, affix replacement VIN plate to a clean surface located on a portion of the left front door pillar post. If this is not practical because of the construction of the vehicle, alternate locations should be used in the following order of preference: first, in engine compartment on body driver's side of cowl; second, any portion of the left front vehicle main frame which is visible and yet protected from possible damage or destruction. A windshield decal shall be placed on the inside left lower corner of the windshield, near the original VIN plate location, stating that the vehicle is equipped with an Ohio replacement VIN plate. The registrar shall prescribe the design and specifications of the windshield decal.

(2) On motorcycles, affix the replacement VIN plate to a clean surface area on the left side near the headstock.

(3) On trailers and semitrailers, affix the replacement VIN plate to the left front corner of the trailer or semitrailer body six inches from the traffic side.

(4) On commercial cars, affix the replacement VIN plate to the left front door pillar post.

(5) On schoolbuses, buses, housecars, and motor homes, affix the replacement VIN plate to a portion of the left front door pillar post if available. If a left front door pillar post is not available, then affix the replacement VIN plate to the main passenger entryway door pillar post. If the pillar post is not available, then affix the replacement VIN plate to any portion of the left front main frame which is visible and protected from possible damage or destruction.

(6) On mobile homes, affix the replacement VIN to the left front corner of vehicle six inches from the traffic side.

(D) The replacement VIN plate shall be riveted securely to the body or the frame by, or under the direct supervision of, an Ohio highway patrol officer.

(E) If it is necessary to replace the derivative VIN on the engine or transmission or on any other vehicle part, the replacement shall be done by the method prescribed by the registrar in rule 4501:1-11-02 of the Administrative Code. The attachment or installation of any replacement derivative replacement VIN shall be done by, or under the direct supervision of, an Ohio highway patrol officer.

(F) The applicant shall bear the cost of any professional, mechanical, or labor costs incurred in the installation of any VIN plate, replacement derivative VIN, or decal.

(G) The highway patrol inspection station shall give written notification to the registrar of the results of the inspection as soon after the completion of the inspection as is practical.

4501:1-11-04 Duties of the clerk of courts.

Upon receipt of notice from the Ohio highway patrol that the vehicle inspection and installation of a replacement VIN plate and any replacement derivative VIN have been successfully completed, and upon payment of the appropriate fees by the owner, the clerk of courts shall issue a replacement title and record on the face of the Ohio certificate of title "replacement vehicle identification number plate installed" or "replacement VIN plate installed." The clerk of courts shall then release the title to the applicant.
