Chapter 4709-7 Barber Shop Licenses

4709-7-01 Application for operation of barber shop.

All applicants for a license for the operation of a barber shop, under provisions of section 4709.09 of the Revised Code, shall apply to the board regarding the requirements for the operation of a shop and for the procedure to follow in making application for licensure.

4709-7-02 Floor plan.

(A) Upon written request the executive director shall provide a shop an application for licensure and a copy of the sanitary rules. After carefully reading this material, the applicant shall file with the board a floor plan in accordance with the board's rules. So that the board may determine the convenience of the location of rooms, the services intended to be offered, equipment and the sufficiency of the equipment, the floor plan shall be drawn to scale, showing in detail the size of the premises, the relationship of all rooms and equipment, all windows and doors, all exhaust equipment, and all plumbing and electrical facilities. This floor plan shall be done in a professional manner. The location of any cosmetological service area(s), if included as part of the shop premises, must clearly be shown in the floor plan. The applicant must submit an updated application to the barber board if the cosmetological service area(s) are added and where not shown in an original floor plan. The applicant who adds a cosmetological service area(s) must also comply with all statutes and rules under R.C. section 4713.

(B) Whenever a licensed barber shop desires to alter the original floor plan filed with the board or desires to add other services, the proposed revised floor plan shall be filed with the board prior to commencing any such construction or offering other services.

(C) No pin ball machines, electronics video games, or pool tables shall be included in a barber shop.

4709-7-03 Water supply; waste disposal.

Every shop shall be equipped with an adequate supply of hot and cold running water and proper plumbing. Every shop shall adhere to the following standards promulgated by the Ohio department of health:

(A) Every shop shall have a safe water supply and shall have a sink equipped to dispense hot and cold potable water at each back stand within five feet of the barbering chair for washing hands and barber implements;

(B) Sewage and other liquid wastes shall be disposed of in a sanitary manner;

(C) The storage and collection of solid waste shall be so conducted so as to avoid creation of health hazards, rodent harborages, insect breeding areas and accidents;

(D) Solid waste shall be stored in covered waste containers;

(E) Solid wastes shall be collected at least once a week.

4709-7-04 Plumbing permit.

All new shops, i.e., those not previously licensed as shops, and all shops which have been closed for two years or more shall be required to pass final inspection. All necessary plumbing permits and inspections of plumbing shall be obtained from the plumbing unit of the "Ohio Department of Health, 246 N. High St., Columbus, Ohio, 43215" or the appropriate local government agency intended for this purpose.

4709-7-05 Restrooms.

All shops shall be equipped with toilet facilities, which include a hand-washing sink with hot and cold running water, soap, and paper towels. Such toilet facilities shall be kept clean, sanitary, and functional at all times.

4709-7-06 Display of sign or barber pole.

Every establishment licensed to practice barbering shall display at its main entrance a sign of appropriate size which will be clearly visible from the street, and whose lettering shall be no smaller than three inches stating "barber shop" or shall display a "barber pole" as described in division (G) of section 4709.01 of the Revised Code.

4709-7-07 Notification of changes must be submitted in writing.

All shop owners shall immediately file a new shop application with the board concerning the sale, transfer, or change of ownership, as well as any change in name of their barber shops or managing barber.

4709-7-08 Resident shops.

Shops in a residential building shall maintain a separate entrance which shall not open off the living quarters, and which shall not have any doors or openings leading to the living quarters. Entrance through garages or any other rooms shall not be permitted. Shops are prohibited in a basement of a residence.

4709-7-09 Mobile home shops.

Mobile homes, motor homes, trailers or any type of recreational vehicle must be permanently set on a foundation or they shall not be approved. Rooms approved for barber services shall maintain a separate entrance which shall not open off the living quarters, and shall not have any doors or openings to the living quarters.

4709-7-10 Barber shop licenses.

(A) Shop licenses are not transferable from one address to another or from one owner to another. A shop license must be obtained from the board before any shop is permitted to open.

(B) Where there has been a change in shop ownership, or when the shop's license name has been changed, a new license must be obtained. The new license must be obtained within thirty days of the aforementioned change.

4709-7-11 Booth space.

Where a license for a "shop within a shop" (booth rental) has been issued, the board shall hold the individual operator responsible for the barber services which they perform and for the sanitary conditions of the leased space.

The shop owner will likewise be held responsible for keeping the entire shop open for inspection to the board or its authorized agents. The shop owner will be held responsible for the general sanitary condition of the entire shop.

The board's authorized inspectors shall examine the entire premises of each shop irrespective of booth space allotments.

4709-7-12 Policy on prohibiting pets.

(A) No animals shall be permitted in a barber shop. However, the Board may grant a one year exemption for only one animal per barber shop if the following requirements are met:

(1) A written request applying for such exemption is made by the owner of the barber shop;

(2) Such barber shop owner is also the owner of the animal to be exempted;

(3) The owner of the barber shop submits to the Board written documentation from a veterinarian, licensed by the State of Ohio, indicating that the animal is in good health and has received all appropriate vaccinations and related medical treatment.

(4) The owner of the barber shop submits to the Board a general liability (or equivalent) insurance policy which contains coverage in an amount which totals at least one million dollars. Such policy shall include coverage for any actions taken by such animal;

(5) The owner of the barber shop submits to the Board written documentation that the animal would not be a danger to the general health, safety and welfare of the public;

(6) Such barber shop owner shall submit a photograph of the animal which is the subject of the proposed exemption and such barber shop owner shall maintain such photograph of the animal at the barber shop;

(7) The Board may take other factors into consideration as it determines in its sole discretion.

(B) Such exemption may be renewed according to policies and procedures adopted by the Board.

4709-7-13 Inspections of shops.

All authorized agents of the board shall have the power to enter and make reasonable inspections of any shop during its regular business hours for the purpose of determining whether or not the board's rules are being observed. Persons duly authorized to make an inspection of shops shall prepare a report of such inspections on forms provided by the board. Such report shall be signed by the inspector and by the owner of the shop or by a person authorized to sign for the owner. A carbon copy of such inspection report shall be left with the owner or manager, and posted within the barbering area.

4709-7-14 Board approval and shop license.

No barber shop shall be opened for the business of barbering until a shop license is issued. Any person or persons proposing to open a barber shop in a new location or a change of ownership, or reopening of premises or facilities formerly operated as a barber shop, shall first make application and pay the fees to the Ohio state barber board for an inspection and approval of the premises. Such application must be submitted for board approval at least fifteen days prior to the opening date. The shop license must be displayed in a conspicuous place in the working area where it may readily be seen.

4709-7-15 License and photo.

It shall be the duty of the holder of a certificate of registration to post name, together with a board approved photograph, at the barber's work station, where it may readily be seen. A copy of barber board rules must be posted within the barbering area.

4709-7-16 Separation of shop.

No person shall use any room or place for barbering which is also used for residential or other business purposes, unless it is separated by a substantial ceiling high partition. This does not exclude products that are usually used and sold in barber shops. All barber chairs must be spaced not less than five feet of center.
