Rule 5122-36-01 | Purpose and definitions.
 

(A) The purpose of the RSS program is to provide cash assistance to medicaid-eligible aged, blind, or disabled adults who have increased needs due to a medical or behavioral health condition which may not be severe enough to require institutionalization. The RSS cash payment is used together with the individual's personal income to help prevent premature or unnecessary institutionalization and to deinstitutionalize those aged, blind, or disabled adults who do not need care in a long term care facility and are able to return to the community through alternative living arrangements. OhioMHAS is the RSS administrative agency, although area agencies on aging assist with level of care determinations and county departments of job and family services determine financial eligibility for the program.

(B) Definitions

As used throughout this chapter, the following definitions apply:

(1) "RSS" means the residential state supplement program implemented under section 5119.41 of the Revised Code.

(2) "Individual" means a person who is applying for or receiving RSS payments.

(3) "CDJFS" means "county department of job and family services."

(4) "OhioMHAS" means the Ohio department of mental health and addiction services.

(5) "Legal representative" means a person that an individual or probate court designates to make decisions for the individual. Examples of types of legal representatives are guardians, conservators, and attorneys-in-fact who are nominated through a power of attorney, including a durable power of attorney for health care.

Rule 5122-36-02 | RSS non-financial eligibility.
 

(A) An individual is to meet all criteria specified in paragraph (C) of rule 5160:1-5-01 of the Administrative Code to be eligible for RSS payments. OhioMHAS first determines whether the individual meets the non-financial eligibility criteria and then the appropriate CDJFS completes the financial eligibility determination. The RSS non-financial eligibility criteria are all of the following:

(1) The individual is at least eighteen years of age.

(2) The individual meets at least the criteria for a protective level of care as specified in rule 5160-3-06 of the Administrative Code. An individual who is receiving (or authorized for) medicaid vendor payment of the nursing facility stay and is being discharged from a nursing facility as defined in section 5165.01 of the Revised Code meets this requirement without the need for an additional level of care assessment by the local area agency on aging.

(3) The individual does not require more than one hundred twenty days of skilled nursing care, as defined in section 3721.01 of the Revised Code, during any twelve month period unless the individual resides in a licensed residential care facility authorized to provide skilled nursing care in accordance with section 3721.011 of the Revised Code.

(4) The individual does not have a cognitive impairment which requires the presence of another person on a twenty-four hour a day basis for the purpose of supervision to prevent harm.

(5) The individual has been accepted for placement or is residing in one of the following living arrangements:

(a) A class two residential facility of the type described in division (B)(1)(b) of section 5119.34 of the Revised Code that is licensed by and in good standing with the Ohio department of mental health and addiction services; or

(b) Either a residential care facility, as defined in section 3721.01 of the Revised Code, that is licensed and in good standing with the Ohio department of health under section 3721.02 of the Revised Code, or an assisted living program, as defined in section 173.51 of the Revised Code, as long as either of the following applies:

(i) The facility or program is in a county where there are no class two residential facilities licensed by the Ohio department of mental health and addiction services; or

(ii) There are no open beds in licensed class two residential facilities within the county that provide housing to individuals with mental illness.

Individuals who were enrolled in the RSS program on November 20, 2014, may continue to reside in the living arrangement they were in on that date without regard to the living arrangement's eligibility pursuant to this paragraph.

(6) The individual is not related to the owner or caregiver of the living arrangement.

(7) The individual is not a participant in any federal waiver program.

(8) The individual is not a participant in the Ohio department of job and family services' program of all-inclusive care for the elderly (PACE).

(9) The individual is not enrolled in a medicare or medicaid-certified hospice program.

(10) The individual is not a consumer of any home and community-based waiver program.

(11) The individual or legal representative has executed a release of information form permitting exchange of information between OhioMHAS, the Ohio department of medicaid, the Ohio department of job and family services, the CDJFS, the local area agency on aging, the living arrangement operator, and other care providers and key contacts as needed for continuity of care and eligibility determination.

(B)

(1) Except as provided in paragraph (B)(2) of this rule, if the individual no longer meets all the criteria in paragraph (A) of this rule, the individual is ineligible for the RSS program.

(2) An individual who meets all of the criteria in paragraph (A), except for the criteria in paragraph (A)(5) of this rule, maintains non-financial eligibility for the RSS program as long as the individual has continuously remained in the same living arrangement since November 15, 1990, and that living arrangement received state supplementation on that date under former section 5101.531 of the Revised Code (repealed July 1, 1993).

(C) OhioMHAS may determine that an individual is responsible for repaying an RSS payment the individual received on or after the date the individual became ineligible for RSS or moved from an eligible living arrangement described in rule 5122-36-04 of the Administrative Code. In such cases where the payment has already been deposited or redeemed by the individual or the individual's legal representative, but not yet submitted to the eligible living arrangement, the individual or legal representative is to return the funds by sending a check or money order, made payable to the "Ohio Treasurer of State," to: "RSS Return Payments, c/o OhioMHAS, 30 East Broad Street, 36th Floor, Columbus, Ohio 43215." The full name of the individual to whom the payment relates, as well as the time period for which the returned payment covers, is to be applied on the memo line of the check or money order. If, however, the RSS payment has not been deposited or redeemed, the individual or legal representative is to return the original check to the address specified in this paragraph. If the individual or legal representative has already submitted the payment to the eligible living arrangement, the living arrangement is to return the payment to OhioMHAS in accordance with paragraph (B) of rule 5122-36-04 of the Administration Code.

All returns of funds described in this paragraph are to be made not later than thirty days after the individual became ineligible for RSS or the individual moved from an eligible living arrangement described in rule 5122-36-04 of the Administrative Code.

Rule 5122-36-03 | Application process.
 

(A) An individual or legal representative may apply for the RSS program by submitting an ODM 07120 form or its electronic equivalent to the appropriate CDJFS or by applying through an electronic system designated by OhioMHAS. In addition, the individual or legal representative will include with the RSS application an application for medicaid if the individual is not currently a medicaid recipient.

(B) OhioMHAS will record the following information about the individual:

(1) The individual's name, address, telephone number, date of birth, and social security number;

(2) If the individual has a legal representative, the legal representative's name, address, and telephone number; and

(3) Whether the individual receives social security, SSI, or SSDI benefits.

(C) The day the RSS application is completed and submitted to OhioMHAS will be considered the date of application.

(D) Once a completed application has been submitted to OhioMHAS, OhioMHAS will make the non-financial eligibility determination available to the department of medicaid and the CDJFS within ten business days. The department of medicaid and the CDJFS will use the non-financial eligibility determination for the determination of medical assistance eligibility in accordance with rule 5160:1-5-01 of the Administrative Code.

(E) OhioMHAS will allow any individual to withdraw from the RSS application process at any time.

(F) OhioMHAS will offer enrollment in the RSS program to any individual when both of the following are the case:

(1) The individual is determined eligible in accordance with rule 5160:1-5-01 of the Administrative Code; and

(2) RSS program funds are sufficient to provide cash assistance to all enrollees.

(G) OhioMHAS may deny an individual's enrollment in the RSS program if the applicant fails to cooperate in the enrollment process for either of the following reasons:

(1) The individual did not apply for medicaid pursuant to rule 5160:1-2-10 of the Administrative Code before the tenth working day after the date of the determination of RSS non-financial eligibility; or

(2) The individual did not select a living arrangement for a determination of the living arrangement's appropriateness before the thirtieth day after the date of determination of medicaid eligibility in rule 5160:1-2-10 of the Administrative Code.

An application denied for the reasons listed in this paragraph will be held as pending by OhioMHAS until such time as the applicant requests it be withdrawn or updates the application to be in compliance with this paragraph.

(H) Consistent with division (D) of section 5119.41 of the Revised Code, if an applicant is denied eligibility for the RSS program pursuant to rules in this chapter, the appropriate CDJFS or the department of medicaid will notify the applicant of the right to a hearing and how to request one. If the individual requests a hearing, the hearing is to be provided in accordance with section 5101.35 of the Revised Code.

Rule 5122-36-04 | Responsibilities of the living arrangement.
 

(A) A living arrangement described in paragraph (A)(5) of rule 5122-36-02 of the Administrative Code is eligible to accept RSS payments from an individual who receives RSS payments only if all of the following are the case:

(1) The living arrangement accepts the allowable fee in rule 5122-36-05 of the Administrative Code as payment in full for all accommodations, supervision, and personal care services the living arrangement provides to an individual who receives RSS payments. The living arrangement will not request additional payment for these services from the individual, the individual's representative, the individual's family, or any other local, state, or federal agency.

(2) The living arrangement provides OhioMHAS or its designee with access to any RSS records pertaining to the individual receiving RSS payments.

(3) The living arrangement allows each individual receiving RSS payments to meet privately with OhioMHAS or its designee.

(4) The living arrangement notifies OhioMHAS or its designee at least ten days before transferring or discharging an individual receiving RSS payments to another living arrangement.

(5) The living arrangement notifies OhioMHAS or its designee of any significant changes in the status of an individual receiving RSS payments that might affect that individual's needs.

(6) The living arrangement does not act as legal guardian or attorney-in-fact under a power of attorney for any individual receiving RSS payments unless it was appointed guardian or named attorney-in-fact before July 1, 2000.

(7) The living arrangement does not act as a representative payee for RSS payments.

(8) The living arrangement maintains the required licensure described in paragraph (A)(5)(a) or (A)(5)(b) of rule 5122-36-02 of the Administrative Code.

(9) The living arrangement responds to and cooperates with the OhioMHAS quarterly RSS resident verification process concerning individuals enrolled in the program.

(10) The living arrangement returns any RSS payment that it receives for an individual who was disenrolled from the program or left the living arrangement before the beginning of the month for which the payment was made.

(11) The living arrangement gives a prorated portion of any RSS payment to an individual who finds it necessary to leave the living arrangement before the end of the month for which the payment was made. The living arrangement is to pay even if the individual fails to give the minimum notice of departure that an admissions agreement or other contract between the living arrangement and the individual requires.

(12) The living arrangement permits each individual receiving RSS payments to have daily access to the individual's personal funds during regularly-scheduled office hours, as specified in a posted notice that is available to each individual.

(13) The living arrangement has each individual receiving RSS payments sign receipts for all funds exchanged between the individual and the living arrangement including those pertaining to payment for care, spending money, and any purchases the living arrangement makes on the individual's behalf. Additionally, the living arrangement will provide each individual with a quarterly itemized account statement, and, if the individual gives the living arrangement permission to do so, provide OhioMHAS's designee with this statement.

(14) The living arrangement provides transportation for each individual receiving RSS payments as needed.

(15) The living arrangement refrains from charging an individual receiving RSS payments more than the usual and customary rate for furnishing transportation or purchasing items.

(16) The living arrangement provides for the needs of an individual receiving RSS payments as determined by OhioMHAS's designee. If the living arrangement cannot meet the individual's needs, it will cooperate with OhioMHAS's designee to relocate the individual to a living arrangement that can meet the individual's needs.

(B) OhioMHAS may determine that a living arrangement is responsible for repaying an RSS payment the living arrangement has received on or after the date the individual to whom the payment relates became ineligible for RSS or the individual moved from the eligible living arrangement. The living arrangement is to return the funds by sending a check or money order, made payable to the "Ohio Treasurer of State," to: "RSS Return Payments, c/o OhioMHAS, 30 E. Broad Street, 36th Floor, Columbus, Ohio 43215." The full name of the individual to whom the payment relates, as well as the time period for which the returned payment covers, is to be applied on the memo line of the check or money order.

A return of funds described in this paragraph is to be made not later than thirty days after the date the individual to whom the payment relates became ineligible for RSS or the individual moved from an eligible living arrangement.

Rule 5122-36-05 | Determination of RSS payment.
 

(A) The amount of each RSS payment is determined in accordance with paragraph (G) of rule 5160:1-5-01 of the Administrative Code.

(B) The allowable fee is the amount an individual receiving RSS payments pays to a living arrangement and is one thousand six hundred dollars per month.

(C) The personal needs allowance is at least two hundred dollars per month.

(D) The approval date for the an individual's RSS payment is determined by OhioMHAS and does not occur before the date of placement in a living arrangement that meets all the criteria in paragraph (A) of rule 5122-36-04 of the Administrative Code or the date when all financial and non-financial eligibility requirements are met, whichever occurs last.
