5123:2-3-15 Procedures to waive licensure rule requirements.

(A) For adequate reasons and when requested in writing, the director or a designee may grant the licensee written, time-limited permission to waive certain conditions or specific requirements of rules under Chapter 5123:2-3 of the Administrative Code and rules under other chapters of the Administrative Code adopted by the department pursuant to section 5123.19 of the Revised Code to license and regulate the operation of residential facilities and the services provided at such facilities.

(B) The department may require the provider to solicit input from the county board as part of the request to waive a licensure rule requirement.

(C) A request to waive licensure rule requirements will be decided by the director or a designee within ten working days of receipt.

(D) Permission to waive certain conditions or specific requirements as specified in paragraph (A) of this rule shall not be contrary to the life, safety or interests of the individuals residing in the residential facility and the public.
