Chapter 5124-3 Public Notice

5124-3-01 Public notice.

(A) Purpose. The purpose of this rule is to establish the procedure to be followed by the legal rights service (LRS) in giving reasonable public notice prior to the date set for a hearing in the adoption, amendment, or rescission of any rule under section 119.03 of the Revised Code.

(B) Definition. “Rule,” as defined in section 119.01 of the Revised Code, means any rule, regulation, or standard, having a general and uniform operation, adopted, promulgated, and enforced by any agency under the authority of the laws governing such agency; but it does not include regulations concerning internal management of the agency which do not affect private rights.

(C) Public notice of the intention of the LRS to consider adopting, amending, or rescinding any rule and a statement of the reason or purpose thereof shall be published, in the register of Ohio at least thirty days prior to the date set for the public hearing, in the form the agency determines. A copy of the notice and a copy of the rule shall also be mailed to any person who requests them and pays a reasonable fee, not to exceed the cost of mailing and copying. The public notice shall consist of a synopsis or a general statement of the subject matter of the proposed, amended, or rescinded rule and the date, time and place of the hearing. The public notice and the rule shall be available for review at the LRS office in printed form.

(D) In addition to the public notice in paragraph (C) of this rule, the LRS may give whatever other notice it considers necessary to persons affected by the proposed adoption, amendment, or rescission of a rule.

(E) The full text of the proposed, amended, or rescinded rule shall be filed with the director of the legislative service commission, the joint committee on agency rule review, the secretary of state, and the department of development’s office of small business at least sixty-five days prior to the date on which the LRS issues an order adopting the proposed rule, amendment, or rescission.
