Public notice of all regularly scheduled, special, and emergency meetings of the pavement selection advisory council (PSAC) shall be provided by the director of transportation in the manner specified by this rule. As used in this rule, "director" includes the director's agent.
(A) The director shall prepare notice of any regularly scheduled meeting no less than one week prior to the date of the meeting. Notice shall contain the caption "notice of regularly scheduled PSAC meeting" and shall state the time and place, and may state the purpose or may include the agenda. The director shall display the notice in a public area at the "Ohio Department of Transportation (ODOT), Office of Communications, 1980 West Broad Street, second floor, Columbus, Ohio, 43223."
(B) The director shall prepare notice of any special meeting no less than twenty four hours prior to the scheduled meeting time. Notice shall contain the caption "notice of special PSAC meeting" and shall state the time, place, and purpose and may include the agenda. The director shall fax the notice to news media that have requested meeting notice as provided in paragraph (C) of this rule.
(C) For any regular or special meeting, the director shall mail or fax a copy of the prepared notice to any person who has requested it in writing if the person requesting the notice has furnished a mailing address or fax number and pays the reasonable cost of copying and mailing or faxing the notice. The director also may mail the notice to all subscribers who have requested in writing to be placed on a mailing list and may post notice on the ODOT internet web site. The director may determine the reasonable cost of copying, mailing and faxing notice under this rule. The director shall provide a copy of the prepared notice to any person who personally appears at ODOT central or district office headquarters and requests the notice. Upon payment of the reasonable cost of copying, the director shall furnish a copy as a public record pursuant to section 149.43 of the Revised Code.
(D) For any emergency meeting, immediate notice of the time, place, and purpose of the meeting shall be provided by fax or telephone to news media that have requested meeting notice as provided in paragraph (C) of this rule. The director is not required to prepare written notice for any emergency meeting.
