Chapter 5537-4 Tolls
Every operator of a vehicle shall obtain either a toll ticket upon entering the turnpike or shall have in their possession at the time of entry a valid and properly mounted electronic tolling transponder recognized by the E-ZPass® group of tolling authorities. Upon exiting the turnpike, every operator using the turnpike shall pay the toll prescribed by the commission through cash remittance or electronic means, except when such use shall have been exempted from such payment by the commission. The toll prescribed shall be based upon the vehicle class assigned by the toll collection system and the distance traveled on the turnpike.
No operator of a motor vehicle shall enter or leave the turnpike except through the tollplaza lanes (except in case of an emergency, and, in such case, such entrance or exit may be made only under the control and supervision of a police officer or a service vehicle from an official turnpike contract garage .) No operator of a motor vehicle on the turnpike shall commit any act or omission with intent to defraud or evade payment of a toll. Operators of a motor vehicle who are observed attempting to defraud or evade payment of a toll while on the turnpike may be cited by a police officer. Each instance in which the operator of a motor vehicle has failed to remit payment of a toll to the commission for more than thirty days after issuance of a notice by the commission to the operator that the toll is due shall be considered a willful attempt to defraud or evade payment of the toll. In each such instance, the commission may assess an additional fine of one hundred dollars against the operator of the motor vehicle who has failed to pay a toll for a period of more than thirty days.
The operator of a motor vehicle who, for any reason, does not have a toll ticket upon reaching the exit toll plaza at which he/she seeks to leave the turnpike shall be charged a toll for the applicable motor-vehicle classification from the most distant toll plaza on the turnpike.
The operator of a motor vehicle on the turnpike who exits at the same toll plaza at which the operator entered, if not so authorized, shall be charged the toll for the appropriate vehicle classification from the most distant toll plaza on the turnpike.
Public police officers, emergency vehicles, or clearly marked federal or state of Ohio and United States military vehicles, while in the discharge of their official duties, shall be afforded ready access to the turnpike without the payment of tolls.
