Chapter 901:1-9 Hog Cholera Biologics

901:1-9-01 The use of hog cholera biologics.

(A) The use of any hog cholera serum, inactivated vaccine, living hog cholera vaccine, or hog cholera vaccine which contains any live virus, is prohibited in this state, except that made by a manufacturing plant licensed by the United States Department of Agriculture.

(B) The use of living hog cholera biologic or hog cholera vaccine which contains any live virus is prohibited in this state, except when used by a licensed veterinarian, and upon written permit issued by the director of agriculture or his authorized representative.

(C) Any person who shall use or administer any vaccine or product which contains living hog cholera biologic or hog cholera vaccine which contains any live virus within the state shall within five (5) days furnish a report of the use of such vaccine to the Ohio Department of Agriculture.

901:1-9-02 The sale and distribution of living hog cholera biologics.

(A) The sale and distribution of living hog cholera biologics or hog cholera vaccine which contains any live virus is prohibited except upon written permit from the director of agriculture or his authorized representative.

(B) Except upon a permit from the director of agriculture, no person shall sell or deliver to other than a veterinarian licensed to practice within the state of Ohio any living hog cholera biologic or hog cholera vaccine which contains any live virus: Provided, producers of living hog cholera virus or vaccine may sell and deliver such hog cholera virus or vaccine to said licensed veterinarians or to said producers’ bona fide agents or sales representatives if a proper record of such sales is furnished the department of agriculture. Re-sale or delivery of living hog cholera virus or vaccine by any said agents or representatives shall be made only to said licensed veterinarians, and a report of such sale by said agents or representatives shall be furnished the director of agriculture within five (5) days of said sale, furnishing the name and address of the person to whom sold or delivered.

(C) Any person, agency or company who shall consign, ship or transport into Ohio or who shall sell, dispose of or distribute within the state of Ohio, any living hog cholera biologic or who shall dispose of or distribute any hog cholera vaccine which contains any live virus shall immediately furnish a report of such disposal or distribution to the Ohio Department of Agriculture, stating the kind and amount of product involved, with the full name and address of the consignee or recipient of the product.
