Ohio Laws and Rules
(A) A landowner may request that the department of agriculture include the landowner’s property in the gypsy moth suppression program. If:
(1) The block in which the landowner’s property is located is eligible for inclusion in the program pursuant to paragraph (B) of this rule; and
(2) The landowners designate a block coordinator who submits a completed application pursuant to paragraph (C) of this rule; and
(3) Each landowner within the block:
(a) Signs and submits an agreement to participate in the program pursuant to paragraph (E) of this rule; and
(b) Submits payment of the total cost to be assessed to that landowner pursuant to paragraph (E) of this rule; and
(4) Sufficient funds are available to allow the department to administer the gypsy moth suppression program for the year for which the request is made;
The department will have the block in which the landowner’s property is located treated for suppression of gypsy moth pursuant to its contract with the aerial applicator.
(B) A block may be eligible for inclusion in the gypsy moth suppression program if:
(1) The block is located within the regulated area of the gypsy moth quarantine, as set out in rule 901:5-52-04 of the Administrative Code; and
(2) The block is comprised of no less than fifty contiguous acres of treatable area; and
(3) The tree canopy covers no less than fifty per cent of the block; and
(4) No less than thirty-five per cent of the tree species within the block boundary is comprised of tree species which are designated as susceptible or resistant to gypsy moth on the list of species in Volume II, Appendix D of the Final Environmental Impact Statement, issued by the United States department of agriculture dated November 1995. This list is set out as appendix C of this rule; and
(5) The density of gypsy moth egg masses within the block is no less than either:
(a) Two hundred fifty egg masses per acre in a residential forested area; or
(b) One thousand egg masses per acre in an uninhabited forested area; and
(6) The block has received a favorable assessment review by the Ohio department of natural resources and the United States fish and wildlife service.
(C) A block may be eligible for participation in the gypsy moth suppression program if the director has received the following on or before the first day of September of the calendar year immediately preceding the year for which treatment for the block is sought:
(1) A completed application, the form of which is attached to this rule as appendix A. An application shall be deemed complete when it contains each of the following on a form prescribed by the director:
(a) The full name, mailing address and daytime telephone number of the block coordinator; and
(b) The full name and address of each participating landowner owning property within the block; and
(c) The township or municipal corporation in which the block to be treated is located; and
(d) The county where the block to be treated is located; and
(e) The preferred product for control of gypsy moth in the block to be treated; and
(f) The original signature of each participating landowner owning property within the block; and
(g) The original signature of the block coordinator; and
(2) A map detailing the boundaries of the block to be included in the suppression program. This map shall:
(a) Clearly outline all boundaries for each property forming the block to be treated; and
(b) Identify by full name the owners of each property contained within the block to be treated; and
(c) Show the scale used when drawing the map. This scale shall be one of the following:
(i) For blocks less than two hundred acres in size, the scale shall be one inch equals two hundred feet; or
(ii) For blocks greater than or equal to two hundred acres, the scale shall be one inch equals four hundred feet.
(D) When calculating the total cost to be assessed to a landowner, the department shall:
(1) First determine the total cost per acre to the department for gypsy moth suppression activities for the year that the landowner’s block is proposed for treatment, given the preferred pesticide product to be used within the landowner’s block. The total cost per acre shall be calculated by determining the total expense of aerial spraying for gypsy moths to be incurred by the department in that year for the preferred pesticide product to be used in the block, divided by the number of acres proposed to be treated in that year using that same pesticide. The total expense of aerial spraying for the suppression of gypsy moth shall be calculated per the current contract between the department and the aerial spray contractor.
(2) Multiply the total cost per acre calculated pursuant to paragraph (D)(1) of this rule by the number of acres that the landowner has requested be treated. In no case shall the total cost to be assessed to a landowner exceed fifty per cent of the department’s cost to treat the block in which the landowner’s property is located
(E) A landowner whose block has been approved for inclusion in the gypsy moth suppression program shall sign an agreement, the form for which is attached to this rule as appendix B, and submit the signed agreement with payment equal to the total cost assessed to the landowner as calculated under paragraph (D) of this rule to the department on or before the first day of March of the calendar year in which the treatment is sought. If the agreement and payment equal to the total cost assessed to the landowner are not received on or before the first day of March, the treatment may not be scheduled.

AGREEMENT
ARTICLE I – Recitals
THIS AGREEMENT is made and entered into between the State of Ohio, Department of Agriculture, hereinafter called the Department, 8995 East Main Street, Reynoldsburg, Ohio, 43068, and

a Landowner seeking treatment within Block #___________ for the purpose of suppression of the gypsy moth on their property.
WHEREAS, the gypsy moth is potentially the most significant insect pest of Ohio’s forests, woodlots and shade trees, and that eradication or exclusion of this pest is generally considered to be impossible within present day constraints; and
WHEREAS, it is the Department’s stated objective to minimize the adverse impacts on forest resources and people in those areas of the state generally infested with gypsy moth; and
WHEREAS, the Landowner, through the Block Coordinator, has made application to participate in Ohio’s Gypsy Moth Suppression Program, by submitting a Cooperative Gypsy Moth Suppression Program Survey Request Application, attached hereto as Exhibit 1, for treatment of the Block within which the Landowner owns property.
WHEREAS, the Department has determined that the Block has met the eligibility requirements of Ohio Administrative Code 901:5-52-08.
WHEREAS, authority exists under Section 927.701 of the Revised Code for the Department to enter into this Agreement with the Landowner to accomplish the abovestated objective; and
NOW, THEREFORE, in consideration of the promises and mutual covenants herein, the parties hereto mutually agree with each other as follows:
ARTICLE II – Duties and Consideration
A. The Department shall:
1. Coordinate the spraying of the Block in accordance with the terms and conditions of the Department’s contract with the aerial spray contractor.
2. Apply federal cost-share funding to the total contracted cost of treatment of the Block.
3. To send a statement of billing to the Block Coordinator on or before February 15 of the calendar year in which the treatment is scheduled. This bill will show the total cost of treating the entire block and the total cost to be assessed to each Landowner within the Block. The total cost to be assessed to each Landowner owning property in the Block shall be equal in accordance with the procedure set out in Revised Code 927.701 and O.A.C. 901:5-52-08(D).
B. The Landowner shall:
1. Authorize _____________________, hereinafter known as the Block Coordinator, to act as the liaison between the Landowner and the Department as necessary to carry out the provisions of this Agreement.
2. On or before March 1 of this year, pay to the ODA the total cost to be assessed to the Landowner, as set out in the statement of billing, in order to fulfill the purposes of this Agreement.
C. The Parties further agree:
1. That the gypsy moth suppression program is limited to and conducted solely through aerial application of either Dimilin or Bt.k.
2. That the Department does not guarantee or warrant in any way the effectiveness of the pesticide or methods used in the treatment of the Block, nor does the Department imply that the Landowner’s participation in the suppression program will result in a quantifiable impact on the gypsy moth infestation within the Block after treatment.
3. That if, after the first day of March of the calendar year in which the suppression treatment is scheduled for the Block, the Landowner elects to discontinue participation in this program, the Landowner’s share of the cost of treatment will not be refunded.
4. That the Landowner releases the State of Ohio and its employees from any claims, damages, lawsuits, costs, judgments, expenses, and any other liabilities that may arise out of or are related to the aerial spraying of the Block.
ARTICLE III – Time of Performance
The term of this Agreement shall be effective upon the date of signature, and shall terminate June 30, _____, the year in which the Block is scheduled for treatment, unless terminated earlier pursuant to the provisions of this Agreement, or as a result of all work on this matter being completed.
ARTICLE IV – Cancellation/Termination
1. If, by reason of force majeure, the Department or its spray contractor is unable to perform under this Agreement, the Agreement shall terminate and the Landowner’s share of the cost of treatment will not be refunded.
2. The State of Ohio funds are contingent on the availability of lawful appropriations by the Ohio General Assembly. If the Ohio General Assembly fails at any time to continue funding for the federal cost-share due hereunder, this Agreement terminates as of the date that the funding expires, without further obligation by the state, and the total cost assessed to and paid by the Landowner shall be refunded.
3. The cost-share percentage is based on the current arrangement with the USDA Forest Service and the current budgetary constraints for the state of Ohio. In the event that funding is not appropriated by the State of Ohio and/or the USDA Forest Service and the Department is consequently unable to perform its duties under this Agreement, this Agreement shall terminate as of the date that the funding expires, without further obligation by the state, and the total cost assessed to and paid by the Landowner shall be refunded.
ARTICLE V – Entire Agreement
This Agreement, including the Recitals which are expressly made a part of this Agreement, constitutes the entire agreement between the Landowner and the Department, and there are no other agreements between them, either oral or written.
