Chapter 901-15 Laboratory Services

901-15-01 Agreement for the performance of laboratory services.

(A) The Department of Agriculture may perform laboratory services as listed in regulations 901-15-01 through 901-15-05 inclusive, at the rates stated therein, when in the opinion of the Director of Agriculture, the department has personnel and facilities available to perform such services.

(B) The department may require any person desiring a laboratory service listed in regulations 901-15-01 through 901-15-05 inclusive to:

(1) Sign a laboratory services agreement with the department as approved by the director;

(2) Pay the department in advance or pay a deposit for the desired service;

(3) Submit a schedule, listing dates and numbers of samples to be submitted when requesting services on a recurring basis.

(C) All monies received for laboratory services will be credited to operating rotary 701-601.

(D) Any agreement for laboratory services:

(1) Shall terminate in not more than one year from the date on which it was approved by the director;

(2) May be terminated by either party with a written notice to the other party, to be effective thirty days from date of notice;

(E) For laboratory services not listed in regulations 901-15-01 through 901-15-05 the rates are to be established by mutual agreement between parties based on the following criteria:

(1) Personnel and facilities are available for such service;

(2) The fee for such service must be deposited with the department;

(3) The rates for such services are to be based on the following:

(a) Equipment set-up and clean-up time;

(b) Sample preparation time;

(c) Analyst time;

(d) Supervisor time;

(e) Equipment and facilities overhead.

901-15-03 Services performed by the division of plant health.

(A) Samples for seed testing shall be tested in order of receipt during the period of January first through May thirty-first of each year and charges made in accordance with the fee schedules contained in paragraphs (C), (D) and (E) of this rule.

(B) Samples for seed testing shall be tested for purity and germination, when requested and in order of receipt, without cost during the period of June first through December thirty-first of each year in accordance with the following schedule:

(1) Three samples of seed of any kind, excluding mixes of seed; or

(2) One sample of seed that is a mixed seed sample.

(C) The fee for purity testing performed in accordance with rule 901-15-01 of the Administrative Code for each sample submitted exceeding the limitation in paragraph (B) of this rule shall be:

(1) For cereals, including barley, oats, rye, wheat and similar species: nine dollars and fifty cents;

(2) For all vegetables: ten dollars and fifty cents;

(3) For legumes and forages, including alfalfa, clovers, millet, trefoil, rape, lespedeza, sudangrass, vetch and similar species: twelve dollars and fifty cents;

(4) For the following grasses: timothy, brome and redtop: eighteen dollars;

(5) For grasses other than timothy, brome and redtop: twenty dollars. The fluorescence test for ryegrass is an additional fee of four dollars and fifty cents;

(6) For corn and soybeans: twelve dollars and fifty cents; and

(7) For flowers: ten dollars.

(D) The fee for germination testing performed in accordance with rule 901-15-01 of the Administrative Code for each sample submitted exceeding the limitation in paragraph (B) of this rule shall be:

(1) For cereals, including barley, oats, rye, wheat and similar species: seven dollars and fifty cents;

(2) For the following vegetables: beets, spinach, carrots, parsnips, asparagus and parsley: eleven dollars and fifty cents;

(3) For vegetables other than beets, spinach, carrots, parsnips, asparagus and parsley: ten dollars.

(4) For legumes and forages, including alfalfa, clovers, millet, trefoil, rape, lespedeza, sudangrass, vetch and similar species: eight dollars and fifty cents;

(5) For the following grasses: timothy, brome and redtop: twelve dollars;

(6) For grasses other than timothy, brome and redtop: fourteen dollars and fifty cents;

(7) For corn and soybeans: nine dollars; and

(8) For flowers: twelve dollars.

(E) The fee for the following services performed in accordance with rule 901-15-01 of the Administrative Code shall be, for each sample submitted:

(1) For a cold test: seventeen dollars;

(2) For an Ohio noxious weed seed examination: half of the purity testing fee for that particular type of seed as established in paragraph (C) of this rule . If the sample is for a seed mixture, the fee shall be half of the purity testing fee for the seed forming the largest component of the mixture by weight;

(3) For germination-only testing, the separation fee per component of a mixture: five dollars;

(4) For excessive contamination with weed or other crop seed: three dollars and fifty cents for each whole per cent, or part thereof that the contamination exceeds one per cent of the total amount of the seed sample, by weight; and

(5) For tetrazolium testing: twenty dollars.

(F) The fee for the following services, conducted as part of the Ohio plant diagnostic network, shall be:

(1) Base fee: a fee of up to thirty dollars will be charged for homeowner submitted samples.The base fee includes microscopic examination of sample and moist chambering/basic culturing on media.

(2) Soybean cyst nematode (SCN) test: A fee of up to twenty-five dollars will be charged for processing a soil sample for SCN. The fee includes cyst and/or egg counts.

(3) Non-SCN nematode test: a fee of up to thirty dollars will be charged per tissue or soil sample. Fee includes extraction by Baermann funnel or pie plate method, and nematode count.

(4) Enzyme-linked immunosorbent assay (ELISA) for common pathogens: a fee of up to fifty dollars will be charged per tissue sample. Fee includes sample preparation, sample test in duplicate wells, and spectrophotometric evaluation of test wells. Fee is applicable to common pathogens and does not apply to mycotoxin or pesticide ELISA tests.

(5) Quantitative ELISA for mycotoxins: a fee of up to sixty dollars will be charged per grain or tissue samples. Fee includes sample preparation, sample test in single test well plus known standards, and spectrophotmetric evaluation of test wells.

(6) Fatty acid methyl esterase (FAME)/ gas chromatography (GC): a fee of up to sixty dollars will be charged per sample. Fee includes sample preparation and GC analysis.

(7) Double-stranded ribonucleic acid (dsRNA) analysis: a fee of up to sixty dollars will be charged per sample. Fee includes dsRNA extraction, purification, and electrophoretic analysis.

(8) Polymerase chain reaction (PCR): a fee of up to sixty dollars will be charged per sample.Fee includes DNA extraction, purification, PCR reaction, and electrophoretic analysis.

(9) Immunocapture reverse-transcription PCR (IC-RT-PCR): a fee of up to seventy dollars will be charged per sample. Fee includes immunocapture with antibody-conjugated magnetic beads, cDNA synthesis by reverse transcription, PCR reaction, and electrophoretic analysis.

(10) RT-PCR using cDNA from dsRNA or total RNA template: a fee of up to one hundred twenty-five dollars will be charged per sample. Fee includes dsRNA/total RNA extraction/purification, cDNA synthesis by reverse transcription, PCR reaction, and electrophoretic analysis.

(11) Unknown fungi ITS real time PCR assay: a fee of up to eighty dollars will be charged per sample. Fee includes DNA extraction, ITS region amplification by Real Time PCR, DNA sequencing, and sequence results subjected to a BLASTn database search.

(12) Real time PCR for detection of specific pathogens: a fee of up to seventy-five dollars will be charged per sample.

(13) Cloning and sequencing PCR products: a fee of up to one hundred dollars will be charged per PCR product to be cloned, squencing will be an additional fee of up to ten dollars per reaction. Fee includes amplification using specific primers, DNA purification, PCR products ligated into a plasmid vector, transformation of E. coli cells, and screening clones for insert by PCR.

(14) Virus detection/identification by partial purification and transmission electron microscopy (TEM): a fee of up eighty dollars will be charged per sample. Fee includes partial virus purification from plant tissue, negative staining preparation, and TEM evaluation.

901-15-04 Rates for laboratory services performed by the division of weights and measures.

Metrology laboratory rates for checking and calibrating all weights, measures and provers, flasks, graduates, cylinders, and other precision glassware, scales, rules and steel tapes, and timing devices.

(A) Testing for all devices calibrated by the metrology laboratory will be done at the following rates:

Time involved in testing or calibrating devices and to complete related paperwork and certificate at $ 80.00 /hour.

Minimum charge: One-half hour ($ 40.00 ).

(B) Travel expenses incurred by state to be paid by requestor:

(1) Motels - actual cost not to exceed the rates set by the U.S. General Service Administration, plus tax.

(2) Meals - actual cost not to exceed the rates set by the U.S. General Service Administration, plus tax.

(J) Fees - out of state

Fees charged non-residents are one and one-half times the listed fee. In addition, a ten dollar accession fee is charged for each group of samples submitted by a non-resident.

(K) Fees - shipping and handling

(1) A shipping fee will be assessed for specimens referred to other laboratories. An additional shipping fee may be assessed for infectious samples.

(2) Specimens/isolates referred to other laboratories may be assessed a fifteen dollar handling fee in addition to the shipping fee.

(3) Failure to submit samples appropriately may result in an additional handling fee of twenty-five dollars per accession.

(L) Fees - sample pooling

The department of agriculture may charge a five dollar fee for each sample group pooled by department of agriculture personnel.

(M) Fee discounts

The department of agriculture may lower the fees charged for specific laboratory services when it will realize a savings in the average cost of providing the service due to the volume of work to be performed, materials provided, costs shared or any other factor which significantly lowers the cost to the department. Any such lowering of fees shall be specified in writing and signed by the purchaser of the services and the director of agriculture or his designee.

(N) Ohio residents

The department of agriculture may charge an eight dollar fee for each accession created.
