Chapter 901-15 Laboratory Services

901-15-01 Agreement for the performance of laboratory services.

(A) The Department of Agriculture may perform laboratory services as listed in regulations 901-15-01 through 901-15-05 inclusive, at the rates stated therein, when in the opinion of the Director of Agriculture, the department has personnel and facilities available to perform such services.

(B) The department may require any person desiring a laboratory service listed in regulations 901-15-01 through 901-15-05 inclusive to:

(1) Sign a laboratory services agreement with the department as approved by the director;

(2) Pay the department in advance or pay a deposit for the desired service;

(3) Submit a schedule, listing dates and numbers of samples to be submitted when requesting services on a recurring basis.

(C) All monies received for laboratory services will be credited to operating rotary 701-601.

(D) Any agreement for laboratory services:

(1) Shall terminate in not more than one year from the date on which it was approved by the director;

(2) May be terminated by either party with a written notice to the other party, to be effective thirty days from date of notice;

(E) For laboratory services not listed in regulations 901-15-01 through 901-15-05 the rates are to be established by mutual agreement between parties based on the following criteria:

(1) Personnel and facilities are available for such service;

(2) The fee for such service must be deposited with the department;

(3) The rates for such services are to be based on the following:

(a) Equipment set-up and clean-up time;

(b) Sample preparation time;

(c) Analyst time;

(d) Supervisor time;

(e) Equipment and facilities overhead.

901-15-03 Services performed by the division of plant industry.

(A) Samples for seed testing shall be tested in order of receipt during the period of January first through May thirty-first of each year and charges made in accordance with the fee schedules contained in paragraphs (C), (D) and (E) of this rule.

(B) Samples for seed testing shall be tested for purity and germination, when requested and in order of receipt, without cost during the period of June first through December thirty-first of each year in accordance with the following schedule:

(1) Three samples of seed of any kind, excluding mixes of seed; or

(2) One sample of seed that is a mixed seed sample.

(C) The fee for purity testing performed in accordance with rule 901-15-01 of the Administrative Code for each sample submitted exceeding the limitation in paragraph (B) of this rule shall be:

(1) For cereals, including barley, oats, rye, wheat and similar species: $9.50;

(2) For all vegetables: $10.50;

(3) For legumes and forages, including alfalfa, clovers, millet, trefoil, rape, lespedeza, sudangrass, vetch and similar species: $12.50;

(4) For the following grasses: timothy, brome and redtop: $18.00;

(5) For grasses other than timothy, brome and redtop: $20.00. The fluorescence test for ryegrass is an additional fee of $4.50;

(6) For corn and soybeans: $12.50; and

(7) For flowers: $10.00.

(D) The fee for germination testing performed in accordance with rule 901-15-01 of the Administrative Code for each sample submitted exceeding the limitation in paragraph (B) of this rule shall be:

(1) For cereals, including barley, oats, rye, wheat and similar species: $7.50;

(2) For the following vegetables: beets, spinach, carrots, parsnips, asparagus and parsley: $11.50;

(3) For vegetables other than beets, spinach, carrots, parsnips, asparagus and parsley: $10.00.

(4) For legumes and forages, including alfalfa, clovers, millet, trefoil, rape, lespedeza, sudangrass, vetch and similar species: $8.50;

(5) For the following grasses: timothy, brome and redtop: $12.00;

(6) For grasses other than timothy, brome and redtop: $14.50;

(7) For corn and soybeans: $9.00; and

(8) For flowers: $12.00.

(E) The fee for the following services performed in accordance with rule 901-15-01 of the Administrative Code shall be, for each sample submitted:

(1) For a cold test: $17.00;

(2) For an Ohio noxious weed seed examination: half of the purity testing fee for that particular type of seed as established in paragraph (C) of this rule . If the sample is for a seed mixture, the fee shall be half of the purity testing fee for the seed forming the largest component of the mixture by weight;

(3) For germination-only testing, the separation fee per component of a mixture: $5.00;

(4) For excessive contamination with weed or other crop seed: $3.50 for each whole per cent, or part thereof that the contamination exceeds one per cent of the total amount of the seed sample, by weight; and

(5) For tetrazolium testing: $20.00.

Metrology laboratory rates for checking and calibrating all weights, measures and provers, flasks, graduates, cylinders, and other precision glassware, scales, rules and steel tapes, and timing devices.

(A) Testing for all devices in the metrology laboratory will be done at the following rates:

Time involved in testing or calibrating devices and to complete related paperwork and certificate at $80.00/hour.

Minimum charge: One-half hour ($40.00).

(I) Fees – out of state

Fees charged non-residents are one and one-half times the listed fee. In addition, a ten dollar accession fee is charged for each group of samples submitted by a non-resident.

(J) Fees – referral/returned specimen fee

(1) For specimens referred to other laboratories or returned to a client, a twelve dollar shipping fee will be assessed in addition to the lab test cost.

(2) Failure to submit samples appropriately may result in an additional handling fee of $25.00 per accession.

(K) Fee discounts

The department of agriculture may lower the fees charged for specific laboratory services when it will realize a savings in the average cost of providing the service due to the volume of work to be performed, materials provided, costs shared or any other factor which significantly lowers the cost to the department. Any such lowering of fees shall be specified in writing and signed by the purchaser of the services and the director of agriculture or his designee.

(L) Ohio residents

The department of agriculture may charge a $5.00 fee for each accession created.
