Rule 901:11-1-01 | Definitions.

 

As used in divisions 901:3 and 901:11 of the Administrative Code and the materials incorporated under rule 901:11-1-02 of the Administrative Code:

(A) "Director" means the director of agriculture or an official, employee, or contractor of the department of agriculture designated by the director of agriculture.

(B) "Drug" means:

(1) Articles recognized in the official "United States Pharmacopoeia," "Official Homeopathic Pharmacopoeia of the United States," or "Official National Formulary," or any supplement to any of them;

(2) Articles intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in man or other animals;

(3) Articles (other than food) intended to affect the structure or any function of the body of man or other animals; and,

(4) Articles intended for use as a component of any articles specified in paragraph (B)(1), (B)(2), or (B)(3) of this rule, but does not include devices or the components, parts, or accessories.

(C) "Hermetically sealed container" means a container that is designed and intended to be secure against the entry of microorganisms, thereby maintaining the commercial sterility of the container's contents after processing.

(D) "Other hooved mammals" means the species of animals as described in section 1, paragraph X of the PMO.

(E) "PMO" means the 2019 revision of the "Grade "A" Pasteurized Milk Ordinance" and its appendices, United States department of health and human services, public health service/food and drug administration. A copy of which can be found on the Ohio department of agriculture website www.agri.ohio.gov.

(F) "Sterilized" when used in reference to piping, equipment, and containers used for milk and milk products, means rendering the piping, equipment, and containers free of viable microorganisms by application of heat, a chemical sterilant or other appropriate treatments.
