Rule 3745-88-01 | Definitions.
 

Except as otherwise provided in this rule, the definitions in rule 3745-81-01 of the Administrative Code apply to this chapter.

(A) "Applicant" means a person filing an application for loan assistance.

(B) "Application for loan assistance" means the application and any additional information necessary to award financial assistance from the water supply revolving loan account in accordance with section 6109.22 of the Revised Code.

(C) "Disadvantaged community loan assistance" means a loan to a disadvantaged community from the water supply revolving loan account with a term not to exceed the maximum term allowed by the Safe Drinking Water Act (SDWA) or the expected design life of the project, whichever is less.

(D) "Nomination" means the application submitted to determine eligibility for inclusion on the project priority list.

(E) "Program year" means a "state fiscal year" defined as July first of the preceding year through June thirtieth of the given year. For example, the 2024 program year ran from July 1, 2023 to June 30, 2024.

(F) "Project priority list" means the list of all eligible projects for which a pre-application for a loan from the water supply revolving loan account has been submitted, arranged in order of priority points awarded to each project. This can be found in the program management plan.

(G) "Water supply revolving loan account" means the account of the drinking water assistance fund from which loans for improvements to qualifying drinking water systems are made. The drinking water assistance fund is authorized under section 6109.22 of the Revised Code.

(H) Incorporation by reference. This chapter includes references to a certain matter or material. The text of the referenced material is not included in the rules contained in this chapter. Information on the availability of the referenced material as well as the date of, or the particular edition of version of, the material is included in this rule. For material subject to change, only the specific versions in this rule are referenced. Material is referenced as it exists on the effective date of this rule. Rule 3745-88-02 | Disadvantaged community loans.
 

(A) Application requirement. Only applicants who are on the project priority list or have submitted a nomination to be on the project priority list by the nomination deadline specified by the director are eligible for disadvantaged community loan assistance for a given program year.

(B) Determination criteria for disadvantaged communities. An applicant may be deemed a disadvantaged community for the purposes of this chapter based on factors set forth by the director in the program management plan for the relevant program year, which can include, without limitation, economic affordability, median household income, population, and poverty rate.

(C) Loan assistance for disadvantaged communities. The terms and conditions of all disadvantaged community loan assistance, including but not limited to the amount, form, and duration of each award of disadvantaged community loan assistance, are to be determined by the director .
