Rule 3770:1-10-41 | Ohio lottery commission game number forty-one.
 

(A) Title and term. Ohio lottery commission game number forty-one, "Win For Life," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement in respect to tickets allocated to them during the period in game number forty-one.

(B) General design.

(1) Game number forty-one is a number match game with an instant win feature, generally known as an "instant lottery."

(2) As used in this rule, "prize award" shall mean one of the following monetary amounts: two dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, two hundred fifty dollars, five hundred dollars, and one thousand dollars a week for life. Each ticket in game number forty-one shall be imprinted in such a way that prize awards from the set listed above may be won.

(3) Game number forty-one shall contain two play areas described on the ticket as game one and game two. Game number one: the player matches any one or more of "your numbers" to the "lucky number" to win the prize amount shown below your matched number(s). Game number two: the player matches three like prize amounts and wins the matched prize amount or matches the word "life" three times and wins one thousand dollars a week for life.

(4) "Life" winners shall be paid annual lump sum payments of fifty-two thousand dollars, less required state and federal withholding, for the life of the prizewinner. The minimum prize amount for a "life" winner shall be seven hundred thousand dollars.

(C) Price of tickets. The price of a ticket issued by the commission in game number forty-one shall be two dollars.

(D) Structure, nature and value of prize awards.

(1) There shall be one type of prize in game number forty-one called a "regular prize."

(2) The only "prize values" which shall appear on a ticket in game number forty-one are one dollar, two dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, and a "life" symbol valued at one thousand dollars a week for the life of the prizewinner. Prize values appearing on any ticket in game number forty-one shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values.

(a) Holder of a valid ticket matching the "lucky number" for one dollar twice in game one shall win a regular prize of two dollars;

(b) Holder of a valid ticket matching two dollars three times in game two shall win a regular prize of two dollars;

(c) Holder of a valid winning ticket matching the "lucky number" for two dollars once in game one shall win a regular prize of two dollars;

(d) Holder of a valid winning ticket matching the "lucky number" for one dollar twice in game one and matching two dollars three times in game two shall win a regular prize of four dollars;

(e) Holder of a valid winning ticket matching the "lucky number" for two dollars once in game one and matching two dollars three times in game two shall win a regular prize of four dollars;

(f) Holder of a valid winning ticket matching the "lucky number" for five dollars once in game one shall win a regular prize of five dollars;

(g) Holder of a valid winning ticket matching five dollars three times in game two shall win a regular prize of five dollars;

(h) Holder of a valid winning ticket matching the "lucky number" for one dollar three times in game one and matching two dollars three times in game two shall win a regular prize of five dollars;

(i) Holder of a valid winning ticket matching the "lucky number" for ten dollars once in game one shall win a regular prize of ten dollars;

(j) Holder of a valid winning ticket matching ten dollars three times in game two shall win a regular prize of ten dollars;

(k) Holder of a valid winning ticket matching the "lucky number" for five dollars once in game one and matching five dollars three times in game two shall win a regular prize of ten dollars;

(l) Holder of a valid winning ticket matching the "lucky number" for two dollars twice plus one dollar once in game one and matching five dollars three times in game two shall win a regular prize of ten dollars;

(m) Holder of a valid winning ticket matching the "lucky number" for twenty dollars once in game one shall win a regular prize of twenty dollars;

(n) Holder of a valid winning ticket matching twenty dollars three times in game two shall win a regular prize of twenty dollars;

(o) Holder of a valid winning ticket matching the "lucky number" for ten dollars once in game one and matching ten dollars three times in game two shall win a regular prize of twenty dollars;

(p) Holder of a valid winning ticket matching the "lucky number" for five dollars twice in game one and matching ten dollars three times in game two shall win a regular prize of twenty dollars;

(q) Holder of a valid winning ticket matching the "lucky number" for five dollars three times in game one and matching ten dollars three times in game two shall win a regular prize of twenty-five dollars;

(r) Holder of a valid winning ticket matching the "lucky number" for fifty dollars once in game one shall win a regular prize of fifty dollars;

(s) Holder of a valid winning ticket matching fifty dollars three times in game two shall win a regular prize of fifty dollars;

(t) Holder of a valid winning ticket matching the "lucky number" for ten dollars three times in game one and matching twenty dollars three times in game two shall win a regular prize of fifty dollars;

(u) Holder of a valid winning ticket matching the "lucky number" for one hundred dollars once in game one shall win a regular prize of one hundred dollars;

(v) Holder of a valid winning ticket matching one hundred dollars three times in game two shall win a regular prize of one hundred dollars;

(w) Holder of a valid winning ticket matching the "lucky number" for twenty dollars twice plus ten dollars once in game one and matching fifty dollars three times in game two shall win a regular prize of one hundred dollars;

(x) Holder of a valid winning ticket matching the "lucky number" for fifty dollars three times in game one and matching one hundred dollars three times in game two shall win a regular prize of two hundred fifty dollars;

(y) Holder of a valid winning ticket matching the "lucky number" for one hundred dollars twice in game one and matching fifty dollars three times in game two shall win a regular prize of two hundred fifty dollars;

(z) Holder of a valid winning ticket matching the "lucky number" for five hundred dollars once in game one shall win a regular prize of five hundred dollars;

(aa) Holder of a valid winning ticket matching five hundred dollars three times in game two shall win a regular prize of five hundred dollars;

(bb) Holder of a valid winning ticket matching "life" three times in game two shall win a regular prize of one thousand dollars a week for the life of the prizewinner. The minimum prize amount for a "life" winner shall be seven hundred thousand dollars. (See paragraph G for claiming requirements and restrictions).

(E) Number of prize awards. The number of prize awards in any sales cycle of game number forty-one will depend upon the number of tickets sold during that cycle. Tickets shall be printed in accordance with this rule using random techniques in order that:

(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;

(2) Mathematical reasoning indicates that the number of winning tickets sold per fifteen million tickets sold in the following categories should be as follows:

(a) Five tickets matching "life" three times in game two winning one thousand dollars per week for the life of the prizewinner;

(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets sold per one hundred thousand will be as follows:

(a) One ticket matching five hundred dollars three times in game two to win five hundred dollars.

(b) One ticket matching for five hundred dollars once in game one to win five hundred dollars;

(c) Seven tickets matching for one hundred dollars twice in game one and matching fifty dollars three times in game two to win two hundred fifty dollars;

(d) Eight tickets matching for fifty dollars three times in game one and matching one hundred dollars three times in game two to win two hundred fifty dollars;

(e) Ten tickets matching for twenty dollars twice plus ten dollars once in game one and matching fifty dollars three times in game two to win one hundred dollars;

(f) Eight tickets matching one hundred dollars three times in game two to win one hundred dollars;

(g) Seven tickets matching for one hundred dollars once in game one to win one hundred dollars;

(h) Thirty-five tickets matching for ten dollars three times in game one and matching twenty dollars three times in game two to win fifty dollars;

(i) Twenty tickets matching fifty dollars three times in game two to win fifty dollars;

(j) Twenty tickets matching for fifty dollars once in game one to win fifty dollars;

(k) One hundred sixty tickets matching for five dollars three times in game one and matching ten dollars three times in game two to win twenty-five dollars;

(l) Three hundred fifty tickets matching for five dollars twice in game one and matching ten dollars three times in game two to win twenty dollars;

(m) Two hundred fifty tickets matching for ten dollars once in game one and matching ten dollars three times in game two to win twenty dollars;

(n) Two hundred fifty tickets matching twenty dollars three times in game two to win twenty dollars;

(o) One hundred fifty tickets matching for twenty dollars once in game one to win twenty dollars;

(p) Four hundred tickets matching for two dollars twice plus one dollar once in game one and matching five dollars three times in game two to win ten dollars;

(q) Three hundred fifty tickets matching for five dollars once in game one and matching five dollars three times in game two to win ten dollars;

(r) Four hundred fifty tickets matching ten dollars three times in game two to win ten dollars;

(s) Four hundred fifty tickets matching for ten dollars once in game one to win ten dollars;

(t) Seven hundred fifty tickets matching for one dollar three times in game one and matching two dollars three times in game two to win five dollars;

(u) Seven hundred fifty tickets matching five dollars three times in game two to win five dollars;

(v) Five hundred tickets matching for five dollars once in game one to win five dollars;

(w) One thousand eight hundred tickets matching for two dollars once in game one and matching two dollars three times in game two to win four dollars;

(x) One thousand nine hundred tickets matching for one dollar twice in game one and matching two dollars three times in game two to win four dollars;

(y) Three thousand four hundred tickets matching for two dollars once in game one to win two dollars;

(z) Three thousand three hundred tickets matching two dollars three times in game two to win two dollars;

(aa) Three thousand four hundred tickets matching for one dollar twice in game one to win two dollars.

(4) For the purposes of the above mathematical probabilities, all fractions have been rounded up to the nearest whole ticket number.

(F) Frequency of prize drawings.

(1) Random imprinting of prize awards on all tickets issued in game number forty-one shall be accomplished in a manner which complies with the commission's rules and procedures.

(2) When a ticket issued in game number forty-one is sold or deemed sold in accordance with this rule and the covering material over the numbers has been removed, the holder shall be deemed to have drawn the numbers on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game number forty-one in which the ticket was sold.

(G) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prizes which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules. Multiple claimants of a one thousand dollars a week for life prize award must establish one life to govern receipt of the prize. Partnerships, trusts or other artificial persons claiming a "life" prize are entitled to only the minimum guaranteed prize amount. Beneficiary(ies) of deceased "life" winner(s) shall receive the remainder of the minimum seven hundred thousand dollar prize amount in continued annual lump sum payments.

(H) Validity of tickets.

(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game number forty-one void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(I) Director's conduct of game number forty-one.

(1) The director shall conduct game number forty-one in a manner consistent with the lottery act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game number forty-one.

(2) Names and definitions of elements of game number forty-one used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game number forty-one and these elements may be given names or titles chosen by the commission.
