Chapter 5501:2-14 | Variable Speed Limits

Rule 5501:2-14-01 | Variable Speed Limits.
 

(A) Based upon the criteria listed under paragraph (B) of this rule and taking into account any engineering study, the director may, based upon sound engineering judgment and acting in the best interest of the traveling public, establish a variable speed limit only on the portions of a street or highway as provided by law.

(B) Any variable speed established by the director should be based upon any of the following criteria or a combination thereof:

(1) Weather and other conditions affecting the visibility of the operator.

(2) Weather and other conditions affecting the pavement conditions that impact the maneuverability and stopping distance of motor vehicles.

(3) Incidents impacting or blocking lanes of travel.

(4) Congestion impacting traffic.

(5) Any other factor that affects the safe speed on a street or highway.

(C) An engineering study conducted in order to determine when variable speed limits are appropriate may be based on the following parameters including, but not limited to:

(1) Traffic volume.

(2) Operating speeds.

(3) Roadway characteristics.

(4) Crash history.

(5) Climate and weather conditions.
