Rule 1501:21-24-02 | Compliant dam discount.
The compliant dam discount program established by section 1521.063 of the Revised Code is to be administered as follows:
(A) The owner of the dam will receive an annual ten per cent discount, to the nearest dollar, off the annual fee if the dam has an approved and up-to-date emergency action plan in accordance with rule 1501:21-21-04 of the Administrative Code. In order to maintain the discount, the owner must submit the emergency action plan update as set forth by rule 1501:21-21-04 of the Administrative Code to the chief by June thirtieth of each year.
(B) The owner of the dam will receive an annual fifteen per cent discount, to the nearest dollar, off the annual fee if the dam is in good condition and meets all requirements deemed necessary by the chief in accordance with rule 1501:21-21-04 of the Administrative Code. For purposes of this discount, the chief will evaluate the condition of the dam at each periodic inspection as set forth by rule 1501:21-21-01 of the Administrative Code or more frequently as necessary. The dam owner will provide whatever documentation is necessary to verify the condition of the dam.
(C) The discounted amount will be reflected on the annual invoice sent to the dam owner.
(D) If the annual fee is not paid within sixty days following the statutory due date, the full amount of the fee plus penalty and interest is owed as established by section 1521.063 of the Revised Code.
