Rule 4501:2-11-01 | Electronic clearance device.

 

Only in-cab electronic clearance devices meeting the following criteria are authorized for use by operators of commercial motor vehicles to bypass a fixed platform scale facility.

(A) The in-cab electronic clearance device must be compatible with the computer system installed at the fixed platform scale facility.

(B) The in-cab electronic clearance device shall be issued for a specifically identified commercial motor vehicle and shall be used only in the specifically identified commercial motor vehicle. The vehicle information may be compared with the electronic clearance device located in the fixed platform scale facility to determine if the in-cab electronic clearance device is authorized for that particular vehicle.

(C) The in-cab electronic clearance device shall be equipped with a signal light, either self-activated or activated by pressing a test button, that will indicate the last signal received by the device. Any peace officer, for the purpose of verifying a bypass signal, shall have unobstructed access to the in-cab electronic clearance device.

(D) As the operator of a commercial motor vehicle approaches a fixed platform scale facility, the in-cab electronic clearance device shall receive and display a visual or audible signal indicating either:

(1) A green light or other affirmative bypass signal; or such affirmative signal shall permit the operator to bypass that particular fixed platform scale facility.

(2) A red light, other negative signal, or no signal shall require the operator to enter the fixed platform scale facility.

(E) The in-cab electronic clearance device must be located in an area of the commercial motor vehicle that is easily accessible to the driver and does not create a view obstruction. The in-cab electronic clearance device is prohibited from being utilized by the driver as a hand-held device.
