Rule 4906-2-30 | Decision by the board.
(A) Except as provided in Chapter 4906-6 of the Administrative Code, the board shall render a decision as to an application not later than one hundred fifty days after the date the application is determined to be complete. If the board does not render a decision within this time period, the application shall be deemed approved by operation of law, and the board shall issue a certificate to the applicant.
(B) The board may determine that the location of all or part of the proposed facility should be modified. If it so finds, it may condition its certificate upon such modifications. Persons and municipal corporations shall be given reasonable notice thereof. The decision of the board shall be entered on the board journal and into the record of the hearing. Copies of the decision or order shall be served on all attorneys of record and all unrepresented parties in the proceedings by ordinary mail.
