Rule 5180:3-7-08 | Child's education and health information.
(A) When is a public children services agency (PCSA) to complete and distribute the DCY 01443 "Children's Education and Health Information" form?
The PCSA is to complete and distribute the DCY 01443 when a child is in the custody of the PCSA.
(B) To whom is the PCSA to provide a copy of the DCY 01443?
The DCY 01443 is to be provided to the following individuals, as applicable, no later than seven calendar days from completing or updating the DCY 01443:
(1) The child's parent, guardian, or custodian.
(2) The child's caregiver.
(3) The child's pre-finalized adoptive parent.
(4) The private child placing agency (PCPA).
(C) When is a PCSA to update the DCY 01443?
The PCSA is to update the DCY 01443 when any of the following occur:
(1) At least once every one hundred eighty calendar days from whichever occurs first:
(a) Date the original PCSA court complaint was filed.
(b) Date of placement.
(c) Date of court-ordered protective supervision.
(d) Date of parent, guardian, or custodian's signature on the "Family Case Plan" for in-home supportive services only.
(2) The PCSA is to update the DCY 01443 within seven calendar days when any of the following occur:
(a) There is a placement change for the child.
(b) There is change in information or new information regarding the child's health.
(c) There is change in information or new information regarding the child's education or school.
(D) What information is recorded in the DCY 01443 pertaining to the child's medical history?
The DCY 01443 is to contain the most recent information available regarding a child's medical history, including, but not limited to, the following:
(1) Name(s) and address(es) of the child's health care provider(s).
(2) Child's known medical concerns.
(3) Child's medications.
(4) A record of the child's immunizations.
(5) Any other pertinent health information concerning the child, such as:
(a) Child's medication allergies and any other known allergies.
(b) Childhood illnesses.
(c) Child's last physical, optical, and dental exams.
(d) Child's ongoing care or specialist appointments.
(E) What information is to be contained in the DCY 01443 pertaining to the child's educational placement and services?
The DCY 01443 form is to contain the most recent information available regarding a child's educational placement and services, including, but not limited to, the following:
(1) Name and address of the child's educational provider at the time of removal.
(2) Name(s) and address(es) of the child's current educational provider(s), if the child did not remain in the school the child was attending at the time of placement.
(3) Documentation of efforts made to maintain the child in the same school the child was attending at the time of removal, or reasons why remaining in the same school was not in the child's best interest.
(4) Documentation that the current educational setting is appropriate for the child's needs or that the agency is working to arrange immediate enrollment in an appropriate educational setting.
(5) Child's grade level performance.
(6) Child's school records, including, but not limited to the following:
(a) Child's grade level.
(b) Disciplinary and behavior issues.
(c) Attendance.
(7) Any other pertinent educational information concerning the child's educational placement and services, including, but not limited to the following:
(a) Special education requirements.
(b) Any developmental delays or learning disabilities.
(F) How is a PCSA to complete the DCY 01443 if recent health and education information is unavailable?
The PCSA is to complete the following steps:
(1) Describe on the DCY 01443 the reasons why the information is unavailable, and the steps being taken by the PCSA to obtain the information.
(2) Upon receiving the updated information, the PCSA is to update the DCY 01443 within seven calendar days.
(3) Provide a copy of the updated form to the parent, guardian, and the child's caregiver and the PCPA.
(G) When is a PCSA to provide foster children with a copy of the DCY 01443?
The PCSA is to provide a foster child age fourteen and older and youth who are emancipating with a copy of the most recent DCY 01443, free of charge, and document the date provided to the youth in the Ohio comprehensive child welfare information system (Ohio CCWIS).
(H) Can a PCSA redact school or medical information from the DCY 01443 form?
A PCSA is to redact information identifying the child's current school or medical provider from the DCY 01443 form provided to the parent, guardian, or custodian if the agency determines that sharing this information could result in adverse or negative consequences for the child. The rationale for withholding this information is to be fully explained and documented in Ohio CCWIS.
