Rule 3358:5-5-08 | Employee complaint and grievance policy.

 

The college recognizes disputes may arise in the workplace. Employees are encouraged to seek informal resolution as early as possible. Any employee may verbally present and discuss concern with their supervisor, and this informal process will remain entirely conversational and non-procedural. If informal resolution is not successful or appropriate, employees may use the formal resolution process. Management is responsible to facilitate a fair, equitable and timely resolution of workplace concerns.

(A) Definitions

(1) Informal concern: Any workplace issue raised verbally or informally that does not meet the definition of a formal complaint.

(2) Formal complaint: A formal complaint is a workplace concern or dispute submitted in writing by an employee regarding the interpretation, application, or alleged violation of a college policy, procedure or workplace practice.

(B) This policy applies to all Clark state employees to include, full-time and non-exempt staff, full-time faculty, adjunct faculty, student workers, substitutes and/or temporary employees.

(C) No reprisals or retaliatory actions will be taken against an employee for raising a concern.

(D) The president shall inform the board of trustees of any formal complaints that are appealed to the president and provide the final disposition of those matters.

(E) This policy shall be administered as set forth in the associated employee issue resolution procedures.

(F) Human resources shall be assigned the responsibility of developing, implementing, and maintaining the employee issue resolution policy and procedures.
