Rule 3745-266-23 | Standards for users of materials that are used in a manner that constitutes disposal.

 

(A) Owners or operators of facilities that use recyclable materials in a manner that constitutes disposal are regulated under all applicable provisions of Chapters 3745-50, 3745-54, 3745-55, 3745-56, 3745-65, 3745-66, 3745-67, and 3745-270, and rules 3745-57-02 to 3745-57-17 and 3745-68-01 to 3745-68-16 of the Administrative Code, 40 CFR Part 124, and the requirement to notify Ohio EPA or U.S. EPA of regulated waste activity. [These requirements do not apply to products which contain these recyclable materials under the provisions of paragraph (B) of rule 3745-266-20 of the Administrative Code.]

(B) The use of waste or used oil or other material which is contaminated with dioxin or any other hazardous waste (other than a waste identified solely on the basis of ignitability) for dust suppression or road treatment is prohibited.
