Rule 3745-266-602 | Standards - ignitable spent refrigerant recycled for reuse.
(A) Persons who do any of the following: recover (i.e. remove from an appliance and store in an external container) ignitable spent refrigerants, recycle ignitable spent refrigerants for reuse either in equipment owned by the same owner or in compliance with motor vehicle air conditioner (MVAC) standards in 40 CFR Part 82 Subpart B, or who send recovered refrigerant off-site to be recycled for reuse, shall, as applicable:
(1) Recover or recycle, or recover and recycle, for reuse the ignitable spent refrigerant using equipment certified for that type of refrigerant and appliance under 40 CFR 82.36 or 40 CFR 82.158, or 40 CFR 82.36 and 40 CFR 82.158, as appropriate; and
(2) Not speculatively accumulate the ignitable spent refrigerant in accordance with paragraph (C) of rule 3745-51-01 of the Administrative Code.
(B) Persons who receive ignitable spent refrigerants from off-site, and are not a transfer facility that stores the refrigerants for less than ten days before sending the refrigerant to another site to be recycled for reuse, shall:
(1) If recovering the refrigerant, recover the ignitable spent refrigerant using equipment that is certified for that type of refrigerant and appliance under 40 CFR 82.36;
(2) Meet the applicable emergency preparedness and response requirements of rules 3745-51-400 to 3745-51-420 of the Administrative Code; and
(3) Not speculatively accumulate the ignitable spent refrigerant in accordance with paragraph (C) of rule 3745-51-01 of the Administrative Code.
(C) Persons receiving ignitable spent refrigerant from off-site to be recycled for reuse under this subpart shall:
(1) Maintain certification by U.S. EPA under 40 CFR 82.164;
(2) Meet the applicable emergency preparedness and response requirements of rules 3745-51-400 to 3745-51-420 of the Administrative Code; and
(3) Starting on January 1, 2029, not speculatively accumulate the ignitable spent refrigerant in accordance with paragraph (C) of rule 3745-51-01 of the Administrative Code.
