Rule 5180:2-9-29 | Bathrooms.
(A) What are the requirements for bathrooms in a residential facility?
(1) A residential facility is to have a bathroom for every eight children of the same sex that can be placed in the facility.
(2) A residential facility may have congregate bathrooms that have more than one sink, toilet, and shower.
(3) Each bathroom must have:
(a) Each toilet capable of flushing.
(b) Each sink with both hot and cold running water.
(c) Each shower with both hot and cold running water.
(B) Can a private, single bathroom be used to meet the bathroom requirement for a residential facility?
If a residential facility has a private, single bathroom containing one sink, one flushing toilet, and one bath or shower, the bathroom may be used to meet the ratio requirement of one bathroom for every eight children, or fraction thereof.
(C) Are infants and toddlers counted in the bathroom ratio?
Children at a crisis care facility who are still using diapers and under the age of three are not to be counted in the bathroom ratio requirements of paragraphs (A) and (B) of this rule.
(D) What is the standard for bathroom access in a residential facility?
(1) A children's residential center (CRC) is to have at least one bathroom with a toilet and sink on the floor with the sleeping rooms.
(2) Bathrooms in a residential facility are to be situated so as to allow direct access to them without the necessity of passing through a bedroom, except when a bedroom has an attached bathroom used only for the children who reside in that bedroom.
(E) What hygiene items and equipment must be available in bathrooms?
Each bathroom in a residential facility is to have toilet paper, towels or air dryers, soap, and wastebaskets available for use.
(F) Do bathtubs and showers need safety features?
Bathtubs and showers in a residential facility are to have nonskid surfaces.
(G) What privacy requirements apply to showers and toilets?
Except for bathtubs exclusively used to bathe children age zero to three in a crisis care facility, all bathtubs and showers in a residential facility are to have enclosures or screens which afford individual privacy. When more than one toilet is located in the same bathroom, each toilet is to be partitioned and include a door capable of remaining closed.
