The Legislative Service Commission staff updates the Revised Code on an ongoing basis, as it completes its act review of enacted legislation. Updates may be slower during some times of the year, depending on the volume of enacted legislation.

Section 942.04 | Civil penalties.

 

(A) The director of agriculture may assess a civil penalty against a person that violates section 942.02 of the Revised Code. The director may assess a civil penalty only if the director affords the person an opportunity for an adjudication hearing under Chapter 119. of the Revised Code. The person may waive the right to an adjudication hearing.

(B) If the opportunity for an adjudication hearing is waived or if, after an adjudication hearing, the director determines that a violation has occurred or is occurring, the director may issue an order requiring compliance with section 942.02 of the Revised Code and assess the civil penalty. The order and assessment of the civil penalty may be appealed in accordance with section 119.12 of the Revised Code.

(C) The director may assess a civil penalty for a violation of section 942.02 of the Revised Code in the following amounts:

(1) For a first violation, not more than five hundred dollars;

(2) For each subsequent violation, not more than one thousand dollars.

(D) Money collected under division (C) of this section shall be credited to the animal and consumer protection fund created in section 943.26 of the Revised Code.
