The division of cannabis control shall establish and maintain an electronic database to monitor adult-use and medical marijuana from its seed source through its cultivation, processing, testing, and dispensing. The division may contract with a separate entity to establish and maintain all or any part of the electronic database on behalf of the department.

The electronic database shall allow for information regarding adult-use and medical marijuana to be updated instantaneously. A license holder shall submit to the division any information the division determines is necessary for maintaining the electronic database.

Information reported or collected under this section, including all data contained in the electronic database, is confidential and is not a public record for the purposes of section 149.43 of the Revised Code. The division and any entity under contract with the division shall not make public any information reported to or collected by the division under this section that identifies or would tend to identify any specific adult-use consumer or medical marijuana patient. Information or data that does not identify a specific adult-use consumer or medical marijuana patient may be released in summary, statistical, or aggregate form.
