Rule 1301:18-4-06 | Limitations on Packages of Cannabis Intended for Direct Customer Sale.

 

(A) Each cultivator, processor, and dispensary shall establish, maintain, and comply with written policies and procedures to ensure all cannabis intended for direct customer sale complies with limitations on packages of cannabis intended for direct customer sale, as applicable, and as outlined by this rule.

(B) All cannabis products intended for direct customer sale shall not contain a tetrahydrocannabinol content of more than ninety per cent.

(C) Prior to any transfer, sale, or distribution, each licensee shall place all cannabis directly into a single cannabis container. A cannabis container by itself may constitute the package intended for direct customer sale.

(1) A cannabis container that is subsequently placed into secondary packaging, the secondary packaging would then constitute the package intended for direct customer sale.

(2) Cannabis sold to customers within a cannabis device must be placed into a cannabis container prior to sale.

(D) Each package of cannabis intended for direct customer sale shall adhere to the following requirements:

(1) Each package of cannabis intended for direct customer sale shall not contain less than ninety per cent or more than one hundred ten per cent of the concentration of total target tetrahydrocannabinol content as provided in the product registration and as required by rule 1301:18-4-09 of the Administrative Code.

(2) For cannabis plants, the following limitations apply:

(a) Cannabis clones and live plants must adhere to the requirements outlined under rule 1301:18-1-01 of the Administrative Code and shall only be in a vegetative state. A clone or live plant that has proceeded to the flowering state shall not be sold;

(b) Each package for direct customer sale shall not exceed six clones;

(c) Each package for direct customer sale shall not exceed six live plants; and

(d) Each package for direct customer sale shall not exceed six seeds.

(3) The net weight of each package of dried cannabis plant material for direct customer sale shall not exceed one ounce.

(4) For raw single serving units, the following limitations apply:

(a) Each raw single-serving unit shall not exceed one gram of cannabis plant material; and

(b) Each package of raw single single-serving units for direct customer sale shall not exceed five grams of cannabis plant material.

(5) For cannabis vaporizers, the following limitations apply:

(a) Each package of cannabis vaporizers for direct customer sale shall not contain more than three vape devices or three vape cartridges, as applicable;

(b) The net weight of each cannabis vaporizer shall not exceed two grams;

(c) The THC content for each cannabis vaporizer shall not exceed ninety per cent; and

(d) The serving size for each cannabis vaporizer is one inhalation lasting two seconds.

(6) For cannabis inhalers, the following limitations apply:

(a) Each cannabis inhaler packaged for direct customer sale shall not contain more than one cannabis inhaler;

(b) The net weight of each cannabis inhaler shall not exceed one gram;

(c) The THC content for each cannabis inhaler shall not exceed eight hundred mg; and

(d) The serving size for each cannabis inhaler is one inhalation lasting two seconds.

(7) For all other cannabis concentrates, the following limitations apply:

(a) Each package of cannabis concentrate for direct customer sale shall not contain more than three containers of cannabis concentrate, three cannabis concentrate devices, or three cannabis concentrate cartridges, as applicable;

(b) The net weight of each container shall not exceed two grams;

(c) The THC content for each cannabis concentrate container, device, or cartridge shall not exceed ninety per cent, as applicable; and

(d) The serving size for each cannabis concentrate container, device, or cartridge is as follows:

(i) For all cannabis concentrates intended for smoking, combustion, or vaporization, the serving size is one inhalation lasting two seconds per serving; and

(ii) For all other cannabis concentrates, the serving size is dependent upon the intended method of administration and as required by this rule.

(8) For infused single serving units, the following limitations apply:

(a) The net weight of each infused single-serving unit shall not exceed one gram;

(b) The THC content for each infused single-serving unit shall not exceed five hundred mg; and

(c) The THC content for each package of infused single-serving units for direct customer sale shall not exceed fifteen hundred mg.

(9) For all other combination inhalable products, the following limitations apply:

(a) The net weight of each package shall not exceed one-quarter ounce; and

(b) The serving size for each combination inhalable product is one inhalation lasting two seconds.

(10) For cannabis-infused edibles, the following limitations apply:

(a) For adult-use cannabis-infused edibles:

(i) The THC content for each portion or serving shall not exceed ten mg; and

(ii) The THC content for each package of adult-use cannabis-infused edibles for direct customer sale shall not exceed one hundred mg.

(b) For medical cannabis-infused edibles:

(i) The THC content for each portion or serving shall not exceed fifty-five mg; and

(ii) The THC content for each package of medical cannabis-infused edibles shall not exceed the maximum allowable amount of THC content for ten whole portions or servings of medical edibles, as outlined in paragraph (D)(9)(b)(i) of this rule.

(11) For cannabis-infused beverages, the following limitations apply:

(a) For adult-use cannabis beverages:

(i) The THC content for each adult-use cannabis beverage container shall not exceed ten mg; and

(ii) Each package of adult-use cannabis beverages for direct customer sale shall not exceed twelve cannabis beverage containers per package.

(b) For medical cannabis beverages:

(i) For each medical cannabis beverage container, the THC content for each portion or serving shall not exceed fifty-five mg;

(ii) The THC content for each medical cannabis beverage container shall not exceed one hundred ten mg; and

(iii) The THC content for each package of medical cannabis beverages for direct customer sale shall not exceed two hundred twenty mg.

(12) For oral pouches and oral strips, the following limitations apply:

(a) The THC content for each serving, portion, or unit shall not exceed ten mg; and

(b) The THC content for each package of oral pouches or oral strips for direct customer sale shall not exceed one hundred mg.

(13) For capsules and pills, the following limitations apply:

(a) The THC content for each capsule or pill shall not exceed 50mg; and

(b) The THC content for each package of capsules or pills for direct customer sale shall not exceed one gram.

(14) For oral sprays, the following limitations apply:

(a) The net weight for each package of oral sprays for direct customer sale shall not exceed thirty mL; and

(b) The THC content for each container shall not exceed one gram.

(15) For oral drops, the following limitations apply:

(a) The net weight for each package of oral drops for direct customer sale shall not exceed thirty mL;

(b) The THC content for each portion or serving shall not exceed ten mg; and

(c) The THC content for each package of oral drops for direct customer sale shall not exceed one gram.

(16) For topical sprays, salves, lotions, or other similar cannabis-infused cosmetic products, the following limitations apply:

(a) The net weight for each package for direct customer sale shall not exceed three ounces or eighty-five grams; and

(b) The THC content for each package for direct customer sale shall not exceed one gram.

(17) For cannabis patches, the following limitations apply:

(a) The THC content for each unit or patch shall not exceed fifty mg; and

(b) The THC content for each package of patches for direct customer sale shall not exceed five hundred mg.

(18) For suppositories for rectal administration, the following limitations apply:

(a) The THC content for each suppository shall not exceed one hundred mg; and

(b) The THC content for each package of suppositories for direct customer sale shall not exceed one gram.
