Rule 3745-205-50 | Applicability and definitions - air emission standards for equipment leaks.
(A) Rules 3745-205-50 to 3745-205-65 of the Administrative Code apply to owners and operators of facilities that treat, store, or dispose of hazardous wastes (except as provided in rule 3745-54-01 of the Administrative Code).
(B) Except as provided in paragraph (K) of rule 3745-205-64 of the Administrative Code, rules 3745-205-50 to 3745-205-65 of the Administrative Code apply to equipment that contains or contacts hazardous wastes with organic concentrations of at least ten per cent by weight that are managed in one of the following:
(1) A unit that is subject to the permitting requirements of rules 3745-50-40 to 3745-50-235 of the Administrative Code; or
(2) A unit (including a hazardous waste recycling unit) that is not exempt from permitting under rule 3745-52-17 of the Administrative Code (i.e., a hazardous waste recycling unit that is not a "ninety-day" tank or container) and that is located at a hazardous waste management facility otherwise subject to the permitting requirements of rules 3745-50-40 to 3745-50-235 of the Administrative Code; or
(3) A unit that is exempt from permitting under rule 3745-52-17 of the Administrative Code (i.e., a "ninety-day" tank or container) and is not a recycling unit under rule 3745-51-06 of the Administrative Code.
(C) For the owner or operator of a facility subject to rules 3745-205-50 to 3745-205-65 of the Administrative Code and who received a final hazardous waste management permit, prior to December 6, 1996, the requirements of rules 3745-205-50 to 3745-205-65 of the Administrative Code shall be incorporated into the permit when the permit is modified or renewed in accordance with rules 3745-50-40 to 3745-50-235 of the Administrative Code or reviewed in accordance with the requirements of paragraph (D) of rule 3745-50-54 of the Administrative Code. Until such date when the owner or operator receives a final hazardous waste management permit incorporating the requirements of rules 3745-205-50 to 3745-205-65 of the Administrative Code, the owner or operator is subject to the requirements of rules 3745-256-50 to 3745-256-64 of the Administrative Code.
(D) Each piece of equipment to which rules 3745-205-50 to 3745-205-65 of the Administrative Code apply shall be marked in such a manner that the equipment can be distinguished readily from other pieces of equipment.
(E) Equipment that is in vacuum service is excluded from the requirements of rules 3745-205-52 to 3745-205-60 of the Administrative Code if that equipment is identified as required in paragraph (G)(5) of rule 3745-205-64 of the Administrative Code.
(F) Equipment that contains or contacts hazardous waste with an organic concentration of at least ten per cent by weight for less than three hundred hours per calendar year is excluded from the requirements of rules 3745-205-52 to 3745-205-60 of the Administrative Code if that equipment is identified, as required in paragraph (G)(6) of rule 3745-205-64 of the Administrative Code.

(H) Purged coatings and solvents from surface coating operations subject to the "National Mission Standards for Hazardous Air Pollutants" (NESHAP) for the surface coating of automobiles and light-duty trucks at 40 CFR Part 63, subpart IIII, are not subject to the requirements of rules 3745-205-50 to 3745-205-65 of the Administrative Code.
[Comment: Rules 3745-205-52 to 3745-205-65 of the Administrative Code apply to equipment associated with hazardous waste recycling units previously exempt under paragraph (C)(1) of rule 3745-51-06 of the Administrative Code. Other exemptions under rule 3745-51-04 of the Administrative Code and paragraph (G) of rule 3745-54-01 of the Administrative Code are not affected by these requirements.]
(I) Definitions. As used in rules 3745-205-50 to 3745-205-65 of the Administrative Code, all terms have the meaning given in rule 3745-205-31 and Chapters 3745-50 to 3745-57, 3745-65 to 3745-69, 3745-205, 3745-256, and 3745-266 of the Administrative Code, and the Resource Conservation and Recovery Act.
