Rule 4713-7-01 | Processing of applications for licensing and examination.
 

All applications for licensing and examination shall be made electronically. For the purposes of filing an electronic application with the Ohio elicensing system, the applicant shall create and maintain a registered "User ID" and password for the system. The use of the "User ID" password created by the applicant is the sole responsibility of the applicant or licensee to secure and maintain, and use shall be limited to filing an electronic application for initial licensure and examination and subsequent renewals of such licenses. The "User ID" and password shall constitute the legally recognized signature of applicant or licensee for the purpose of this rule and may not be transferred, distributed, or shared with any other person. All application fees are non-refundable.

Rule 4713-7-02 | No communication between applicants during examination.
 

Each examinee shall be assigned an individual workstation. The examinees shall not communicate with other examinees during the examination and they shall not have any written material, unless provided by the board. Electronic devices are prohibited within the examination area with the exception of calculators, which may be furnished by the board. An applicant found violating any rule or participating in any other type of misconduct shall be dismissed and the applicant shall automatically fail the examination.

Rule 4713-7-08 | Applications to practice branches of cosmetology or barbering from active duty military members, spouses of active duty military members, or veterans.
 

The Ohio state cosmetology and barber board has evaluated military training and education in branches of the United States armed services and finds the armed forces provide no education or training in any branch of cosmetology or barbering that is equivalent to Ohio's standards. Active duty military members, spouses of active duty military members, or veterans are eligible for temporary licensure pursuant to section 4743.041 of the Revised Code in any branch of cosmetology or barbering if they meet the following requirements:

(A) Active duty military members or spouses of active duty military members are exempt from having to take an examination to practice any branch of cosmetology or barbering in the state of Ohio while in active duty status and for the six-months following discharge from active duty upon filing the following:

(1) A board-approved application;

(2) Proof that the applicant holds an active license, or equivalent, to practice any branch of cosmetology or barbering in any other state, territory of the United States, or the District of Columbia; and

(3) In the case of an active duty military member a copy of the member's current military orders or copy of current military I.D. card, or

(4) In the case of an application from a spouse of an active duty military member, provide the following:

(a) Proof the applicant is married to an active duty military member by providing a notarized copy of a marriage certificate;

(b) Proof the spouse (not the applicant) is assigned to a duty station in this state by providing a copy of the official active duty military orders; or

(c) Proof the spouse (not the applicant) has been assigned to active duty in a foreign country and the applicant is residing in the state of Ohio during the spouse's deployment.

(5) In the case of a veteran who was honorably discharged and is relocating to the state of Ohio within six months of discharge, a copy of the veteran's discharge paperwork relecting their status and discharge date.

(6) In the case of a spouse of a veteran who was honorably discharged and is relocating to the state of Ohio within six months of discharge, provide the following:

(a) Proof the applicant is married to a veteran who was honorably discharged and is relocating to the state of Ohio within six months of discharge by providing a notarized copy of a marriage certificate;

(b) A copy of the veteran's discharge paperwork relecting their status and discharge date.

(B) A temporary license issued pursuant to section 4743.041 of the Revised Code shall be valid for six years from the date of original issuance.

(C) A temporary license issued pursuant to section 4743.041 of the Revised Code is nonrenewable.

(D) There is no fee associated with a temporary license issued pursuant to section 4743.041 of the Revised Code.

(E) Veterans coming from out of state are eligible for a license to practice any branch of cosmetology or barbering in the state of Ohio in accordance with the provisions of rules 4713-7-09 and 4713-7-16 of the Administrative Code.

(F) Active duty military members, spouses of active duty military, veterans, and the spouse of a veteran, are eligible to take the appropriate advanced practice license examination for each branch of cosmetology pursuant to section 4713.30 of the Revised Code.

(G) The board shall prioritize and expedite an application under this rule received from an active duty military member, the spouse of an active duty military member, a veteran, spouse of a veteran, or the surviving spouse of a veteran. The board shall record, track, and monitor such applications through the eLicense Ohio system.

Rule 4713-7-09 | Out of state license holder applications for Ohio licenses.
 

Applications for Ohio licenses to practice cosmetology, any branch of cosmetology, or barbering, from individuals holding valid licenses to practice cosmetology, any branch of cosmetology, or barbering, in other states, or from other countries, shall be processed in accordance with the provisions of this rule. Persons from other jurisdictions must provide certified proof of holding an equivalent license issued by their state or country of origin, and certified proof of training hours.

(A) Upon application to the board to practice cosmetology, or any branch of cosmetology pursant to section 4713.34 of the Revised Code, barbering pursant to section 4709.08 of the Revised Code, or boutique services pursant to section 4713.69 of the Revised Code, the board shall issue a license to practice to an applicant who is licensed or registered in another state to practice, as appropriate, if all of the following conditions are satisfied:

(1) The applicant holds a valid license in another state;

(2) The applicant has satisfactory work experience, a government certification, or a private certification as described in that chapter of their respective license or registration type in a state that does not issue that license or registration.

(B) Upon application to the board to practice cosmetology, or any branch of cosmetology, as provided for in section 4713.34 of the Revised Code, and submission of required application fee(s), a person who is licensed or registered as a cosmetologist, or in any branch of cosmetology, under the laws of another country, shall be granted licensure in the state of Ohio upon taking and passing Ohio's practical and theoretical examinations provided the total amount of hours required to complete their program were at least eighty percent of the program hours required in the state of Ohio and the licensing jurisdiction requires that testing occur at a facility managed by a centralized governing licensing body.

(1) The board may waive the requirement to take and pass Ohio's practical examination, and theoretical examinations examination, or both, for any individual who holds a valid license to practice cosmetology, or a branch of cosmetology other than manicuring, from another jurisdiction if all of the following are met:

(a) The individual has held an active license or equivalent in cosmetology, or a branch of cosmetology;

(b) The licensing authority required at least eighty percent of the program hours required in the state of Ohio at the time the license was granted;

(c) The licensing jurisdiction required a practical examination at the time the license was granted;

(d) The licensing jurisdiction required a theory examination at the time the license was granted; and

(e) The licensing jurisdiction extends similar reciprocity opportunities to individuals licensed in Ohio.

(2) If an individual licensed by another jurisdiction meets all of the requirements listed in paragraph (A) of this rule, with the exception of paragraph (A)(1)(c) or (A)(1)(d) of this rule, the board may waive the respective examination requirement that was previously completed in the original licensing jurisdiction.

(C) Upon application to the board to practice barbering, as provided for in section 4709.08 of the Revised Code, and submission of required application fee(s), a person who is licensed or registered as a barber, under the laws of another country, shall be granted licensure in the state of Ohio upon taking and passing Ohio's practical and theoretical examinations provided the total amount of hours required to complete their program were at least eighty percent of the program hours required in the state of Ohio and the licensing jurisdiction requires that testing occur at a facility managed by a centralized governing licensing body.

(1) The board may waive the requirement to take and pass Ohio's practical examination, and theoretical examination, or both, for any individual who holds a valid license to practice barbering from another jurisdiction if all of the following are met:

(a) Is at least eighteen years of age;

(b) The licensing jurisdiction required at least eighty percent of the program hours required in the state of Ohio at the time the license was granted;

(c) The licensing jurisdiction required a practical examination at the time the license was granted;

(d) The licensing jurisdiction required a theory examination at the time the license was granted; and

(e) The licensing jurisdiction of the applicant extends similar reciprocity opportunities to individuals licensed in Ohio.

(2) If an individual licensed by another jurisdiction meets all the requirements listed in paragraph (B)(1) of this rule, with the exception of paragraph (B)(1)(c) or (B)(1)(d) of this rule, the board may waive the respective examination requirement that was previously completed in the original licensing jurisdiction.

(D) After issuance of a license to practice cosmetology, any branch of cosmetology, or barbering in accordance with this rule, the board shall not provide certified verification of licensure to any other state, territory of the United States, District of Columbia, or other country until one year after the date of issuance. The restriction on certification and transferability of licensure under this division do not apply to any of the following:

(1) A person who is an active duty military member or spouse of an active duty military member who provides proof of military orders transferring them or their spouse to another state, territory of the United States, District of Columbia, or another country; or

(2) A person who presents valid proof of the necessity to move to another state, territory of the United States, District of Columbia, or another country due to acceptance of a spouse's employment or illness of an immediate family member.

Rule 4713-7-10 | Testing fraud.
 

(A) Any individual who presents false identification or is caught attempting to test for another individual shall be barred from entering the examination, and the applicant shall receive a failing grade on any part of the examination scheduled for that day.

(B) Any individual who is caught cheating on an examination shall be immediately removed from the examination and shall receive a failing grade on any part of the examination scheduled for that day.

(C) Any individual who violates paragraph (A) or (B) of this rule shall be prohibited from reapplying for examination for a period of thirty days.

(D) Any individual who violates paragraph (A) or (B) of this rule shall be subject to additional disciplinary action from the board.

Rule 4713-7-11 | Temporary pre-examination work permit.
 

Qualified applicants for examination under Chapter 4713. of the Revised Code are eligible for a temporary pre-examination work permit.

(A) Every applicant who desires to practice cosmetology or a branch thereof prior to examination shall obtain a temporary pre-examination work permit from the board. The temporary pre-examination work permit actively authorizes the holder to engage in the practice of cosmetology or branch of cosmetology under the supervision of a board licensee who is licensed in cosmetology or the branch of cosmetology for which the applicant has applied for examination. The temporary pre-examination work permit may be extended one time by the board. However, no person is entitled to more than one extension, and applicants are not permitted to practice beyond the date of the extension. The temporary pre-examination work permit of a person who fails any part of the examination shall not be extended.

(B) On the date of examination, after successfully passing the examination, the temporary pre-examination work permit may be extended to allow the applicant to continue to work pending receipt of the applicant's license. Applicants will not be permitted to practice beyond the expiration date of the extension.

Rule 4713-7-12 | Barber teacher training program.
 

(A) In addition to the requirements set forth in division (C) of section 4709.10 of the Revised Code, an applicant for a barber teacher license shall complete a board-approved barber teacher training program, either as a stand-alone program or as part of an individual's assistant barber teacher program, that meets the following requirements:

(1) The program shall consist of not less than five hundred clock hours of training; and

(2) The program curriculum shall comply with all requirements established by the board.

(B) Each applicant for a barber teacher license must provide proof of successful completion of a board-approved barber teacher training program as part of their application to take the board's barber teacher license examination.

Rule 4713-7-13 | Eligibility of graduates of managing programs for advanced practice examination.
 

Individuals that completed a manager training program approved pursuant to provisions under section 4713.30 of the Revised Code effective prior to September 13, 2016, are eligible to take the advanced practice examination for the branch of cosmetology studied.

An individual who is scheduled to take an examination under section 4709.07 of the Revised Code, but fails to appear for the examination, must reapply for the examination and pay the fee required under division (A)(1) of section 4709.12 of the Revised Code.
